High Court Orders Seizure of APM & Muhara’s Property
The court order which has been issued by Justice Kenyatta Nyirenda dated May 4, 2021, through Lilongwe High Court Registry shows that the two only managed to pay K47 million, and now face sheriffs for the remaining 22 million kwacha.
Former President Peter Mutharika and former Chief Secretary to President Lloyd Muhara were on March 12, 2021, ordered to pay K69.5 million in legal fees to lawyers representing Malawi Law Society, Human Rights Defenders Coalition, and Association of Magistrates in Malawi.
The three appellants sought a judicial review on the decision by Mutharika through Muhara to send Chief Justice Andrew Nyirenda and Justice of Appeal Edward Twea on leave pending retirement ahead of the court-sanctioned fresh presidential election on June 23, 2020.

Barely hours after the High Court had ordered to seize and sell property of Former president Peter Mutharika and former Secretary to the President and Cabinet Lloyd Muhara for failing to pay K69.5m legal cost that came after losing a court case, the two have paid in full.

Mutharika and Muhara were ordered by the High Court to pay K69,507,461 on March 12 2021 in legal cost in a case where their decisions to send on Chief Justice Andrew Nyirenda and Justice of Appeal Edward Twea leave, pending retirement, were faulted.

Bodyguard to former President, Professor Peter Mutharika, Dabble Dissi is in the hands of police in Lilongwe on allegations of theft of a government motor vehicle.
National police spokesperson, James Kadazera, said the the suspect was arrested on Monday.
According to Kadadzera, Dissi stole a government vehicle, Toyota Prado TXL, registration number BW 687.
Kadadzera said through Malawi Police Service’s Anti-Motor Vehicle Theft Unit, they are following up on all government vehicles currently in custody of illegal persons.
“It has to be noted that the unit has a list of all government vehicles and is following up on each of them,” said Kadadzera, adding:

The two were found guilty of forcing Chief Justice Andrew Nyirenda and Justice of Appeal Edward Twea to go on leave pending retirement and were ordered to shoulder legal costs put at K69 million.

The High Court has today issued a seizure and sale order against former president Peter Mutharika and former secretary to the President and Cabinet Lloyd Muhara following their failure to square off part of legal costs after they were faulted for trying to force Chief Justice Andrew Nyirenda and Justice Edward Twea to go on leave pending retirement.
According to the order (reprinted here), out of the sum of K69, 507, 461, the two were supposed to pay they have only managed to pay K47, 437, 125.11 and they remain indebted to the applicants in the sum K22, 070, 335.89.
