A judge decided yes, and that prelim is back in session right now. Cosby arrived just after 9 00 this morning. He did not speak. He walked into the courthouse very quietly with his team by his side. Cosby is accused of drugging and molesting Andrea Constand in 2004. Both the prosecution and defense are expected to go back and forth over evidence. Some includes cosbys own testimony in a civil case. Cosby gave that testimony to former d. A. Bruce castor under the agreement he would not be prosecuted but the current d. A. , kevin steele, vowed to prosecute cosby. Cosbys legal team has been trying to get the case dismused from the beginning. Theres a small chance the case could be thrown out but that isnt likely. A huge lightning bolt i never seen anything like it in my life. It was like this wide and came down to the v and hit the ground by her left side. On action news this noon is developing in Montgomery County. Bill cosby is back in court for his preliminary hearing. A judge is deciding if there is enough evidence for the entertainer to stand trial on a sexual abuse charge. Katherine scott is live with the latest. Reporter that is right. The purpose of todays preliminary hearing is to decide if the prosecution has enough evidence to proceed to trial. That is going on right now upstairs at the Montgomery County courthouse with a lot of people closely watching. Bill cosby is required to be here and here is video of him arriving today. Notably absent is accuser, andrea constand, she is not required to be here for the preliminary hearing. Instead a statement she made in 2005 can be relied upon and that is under appeal right now and they pointed to her absence multiple times today and his inability to ask her questions during this hearing. We have heard from two witnesses, one is a detective that was assigned to the Major Crimes Unit and
