why do the doj have a winning argument? well it came down to who has the greater interest, on one hand doj has a really strong interest in getting access to these documents right away, because they need to resume their criminal investigation, and the federal government in general needs to look at these documents and decide if people are in danger, spies, intelligence assets, that type of thing. on the flipside, the court says donald trump has no possesses or interest in these records. what this means though, that these classified records are now doj right, now the alternative would have been the have to run through the special master first. if they were privileged, they would end up right back in doj hands anyways. so doj now has the more quickly. hold on to, this don t let me grab. i thought what you are, saying don t, mcgraw i thought this was going to be happening with those documents. that everyone was going to have a chance to look at them, right, which was obvio
that they ve been restricted from using, in their ongoing criminal probe into these classified documents, that were seized from mar-a-lago last month. the appeals court is saying here, they are really agreeing with the justice department, saying that yes, in fact, national security could be harmed if the justice department can t continue its probe here. they set the doj has argued that the criminal investigation, and then national security investment is inextricably linked. the appeals court saying, yes, in fact, if we don t let the doj continue to use these classified documents, there will be real and significant harm on the united states and the public. notably, in this opinion as well, anderson, the 11th circuit is really faulting trump s lawyers, for not better explaining what seems to be their argument, the trump may be declassified [inaudible] his lawyers, his allies, but they ve not offered any proof in court filings or in-person. so the 11 circuit tonight criticizin
lot coming at him. and i think of all of it, that laetitia james stuff might be the stuff that most greatly concerns and disturbs him. well, it was, until the appeals court rules tonight. and then, and then, he s sitting down there, trying to figure out which is worse, losing all my money, or being convicted of federal crimes. which the federal appeals court is really paving the way for now. they are making it very clear that there is just going to be no more roadblocks between donald trump and what will ultimately be merrick garland s decision to indict him or not over those documents at his home. and betting on trump appointed judges was not the right bet, as we found out. see the 11th circuit ruling. all right lawrence, all be watching. thank you, alex. well, the two worst nights of donald trump so far are election night 2020, and tonight. on election night, when fox called the election for joe biden, he knew then he was going to lose access to the white house an
are questions from the state legislature about the potential misuse of state funds. let s start with the civil suit. that s coming from a legal group representing more than 30 of the asylum seekers, fiemg a claim against governor ron desantis and other state officials saying that the migrants experienced, quote, cruelty akin to what they fled in their home country of venezuela. it claims florida officials manipulated them, stripped them of their dignity, deprived them of their liberty, bodily autonom autonomy due process under the law. that s what they claim. basically they say desantis lied. and their lawyers are looking into these brochures used to entice those seeking a better life to travel under the guise that resettlement support was available to them. the governor keeps insisting the asylum seekers knew what they were signing up for. it was all voluntary and he claimed the humane thing to do. those migrants were being treated horribly by biden. they were hungry, home
they got him. and got more including the deadline from the review well past. today having gotten what they wanted they were called onto do something they ve notably not done in any court filing or proceedings so far, namely back up what their clients and allies are suggesting saying these documents were declassified. for the government s part today they signaled their willingness to take this all the way to the supreme court. jessica schneider starts us off and joins us now. let s talk about what the trump legal team told the special master. yeah, well what s interesting is their response to that ultimatum from the special master where he said he might have no choice but to accept the government s claims that 100 of those documents are classified, if trump s team doesn t step windup the proof that the former president declassified them. and that s really something that trump s legal team has resisted repeatedly asserting both in person in court and in legal filings. so, you
