sheila dixon. good evening, i m marybeth marsden. this is the jury s third day of deliberations. brian kuebler has been standing by at the courthouse since early this morning and joins us with more. brian? reporter: that s three days and 19 hours of deliberation but again this jury asked to go home again tonight with no verdict. after passing a note this morning saying they were making great progress the dixon jury asked to be released for the third day in a row saying we have not completed deliberations but we re making progress, can we continue tomorrow ? the judge said he wanted to follow the jury s lead in this case and dismid missed them at 4:30. not totally unexpected. absolutely not. i ve been around long enough to know you can never predict what a jury will or will not do. reporter: the state prosecutor is not concerned. and neither are dixon s attorneys saying you can never know what a jury is thinking. this jury, they say, is taking this case very seriously a

two injuries. [sirens] reporter: police say suspect darryl lee smith was driving the red van you see smashed into the guard booth in hopkins hospital. police originally tried to pull him over on a minor traffic violation when he sped away. the police chopper foxtrot was in the area and followed smith through four districts until he hit his vehicle sending the van crashing into the guard booth. but he was not done yet. after the accident the individual driving the car attempted to flee on foot and officers were able to affect an arrest. reporter: you can see him handcuffed and sitting on the curb. police say he was running because he had an open drug warrant out for his arrest. now he will face multiple driving violations and charges of evading police. thankfully the guard you see here wasn t in the booth when the van slammed into it. the booth suffering more damage than himself as he was able to get out of the way just in time. the other bystander was a preacher, police

when she became ill. one of our aunts, ernestine parker learned of her death watching a news report. i m glad i found out about it. being blind for a while. so i don t know, it s just it s terrible. no matter how much you i know she loved her kids. reporter: state health officials say her death underscores the need for children to receive the h1n1 vaccine when it becomes available. this particular child was became ill and at this point we know of no other apparent condition that affected her. reporter: city leaders are offering their condolences to the family. the young lady from montebello did pass away. our prayers with her family during these really trying times. reporter: the city s health department sent workers to meet with parents at the school earlier this week and learned other children may have contracted the virus. we spoke with some parents who had children that were sick. i instructed one woman who had a sick child to take him home. reporter
