Kendall of the Northern District of Illinois declined arguments by Hillshire Brands Company, Tyson Foods Inc., Tyson Fresh Meats Inc., Tyson Prepared Foods Inc. (collectively, the Tyson defendants) that the court should toss the turkey purchaser plaintiffs’ suits against them. This week’s opinion and order pertains to two class-actions, one filed by Sandee’s Catering, and the other by Olean Wholesale Grocery Cooperative against the nation’s largest turkey producers.  The Tyson defendants reportedly based their February motion on part of the court’s reasoning in its October 2020 opinions, that in relevant part granted Kraft Heinz Foods Company and Kraft Foods Groups Brands LLC’s (collectively, Kraft) motion to dismiss. Turkey Producers say Amended Complaint did Not Fix Issues With Unjust Enrichment Claims

Agriculture your username December 11, 2020 On Thursday, defendants in a lawsuit alleging antitrust in the turkey industry sought a judgment in their favor from the Northern District of Illinois on 27 unjust enrichment claims which they alleged are “fatally flawed.” This request was filed on the same day answers to the plaintiffs’ amended complaint were filed by each of the defendants.  The defendants asked the court in their joint motion for a judgment in its favor regarding the unjust enrichment allegations against them and explained in the accompanying memorandum that the claims did not meet the pleading standards set forth in Rule 8 of the Federal Rules of Civil Procedure and 17 of the claims contained state-specific issues.
