jason, it is important to understand the limits of law. will law play a role here? surely it will. it is clear that this law, sb-8 violates the constitution. it was drafted for the purpose of evading federal court review and having it being a adjudicat. it is some what susceptible to political pressure or at least mindful of those pressures. the law takes a long time. it is going to be a while before a challenge makes its way into the state s system. it does not matter because this law was drafted purposely to ensure that it would go into effect and it will cobble in texas. that s what s going to happen. even if this law is later declared unconstitutional, you can t unring this bell. we saw this in hb-2.
