this was what? everybody talking about the relevance of why the state of indiana needed this. is it because the state and those living there were granted gays and lesbians the opportunity to marry in november? this has been sort of a, quote, consolation prize. that s the phrase a lot of people are using. to the social conservatives. if you look a year ago in indiana, there was a fight over a constitutional gay marriage ban here at the statehouse and the social conservatives lost that fight and it was actually a pretty surprising victory for sort of your moderate republican then and the small number of liberals in this state, and what was but in all of that the legislative leaders and republican leaders sort of made these promises okay we have to do something here to keep the base happy and this is what it looks like. i think when itted started this year, i don t think anyone saw it exploding the way it has now with people calling for the

a federal judge regarding indiana earlier in the day. and this is a federal appeal s court that upheld a lower court ruling and striking down utah s gay marriage ban. the panel put that ruling on hold so that it can be appealed to the entire u.s. circuit court of a polls and perhaps to the supreme court. this will affect utah and the other states that are part of the 10th circuit and the ruling is on hold now. and a lot of people think it is something that the supreme court will take up because a number of states and federal judges ruled in state after state that gay marriage must be allowed to proce proceed. whether or not the supreme court agrees is yet to be determined. we ll stay with that on fox. and revise settlement on the
you noted that the topic hadn t been broeched. tell us more about that. reporter: we ve had a lot of speakers here. we ve had five potential republican candidates and a lot of those speakers, tlfrp only two people whose names i didn t know before i came here that spoke about gay marriage. rick santorum didn t and that was striking because we had rulings across the country that legalized gay marriage. and republicans here when i talk to them, we feel like we ve lost this issue. gay marriage will become legal in the country and we need to move to a different ground. we re not going to win the gay marriage battle. which is a striking concession. ten years ago george bush was running for president on a gay marriage ban and they put all of these gay marriage bans on states to turn out conservative voters. ten years later we have this event, the signature social conservative event of the year, no mention of gay marriage at all. in a room filled with a lot
