Maratha Quota Case: SC Declares Reservation Over 50% as Unconstitutional
The judgment by the constitution bench in the Maratha reservation matter is likely to clear many cobwebs.

New Delhi: A five-judge constitution bench of the Supreme Court on Wednesday has held that reservations in excess of the 50% ceiling limit are unconstitutional. The bench comprising Justices Ashok Bhushan, L. Nageswara Rao, S. Abdul Nazeer, Hemant Gupta and S. Ravindra Bhat struck down the Maharashtra State Reservation for Socially and Educationally Backward Classes (SEBC) Act, 2018 which extended reservation to the Maratha community in public education and employment in excess of the ceiling limit of 50% fixed by the Supreme Court earlier.

Fadnavis alleged that the lack of coordination among the allies of Maha Vikas Aghadi (MVA) government and the improper stand resulted in the top court s verdict.
Briefing the reporters in Nagpur, Fadnavis said, The reservation was valid in the High Court and the law was passed. The case went to the Supreme Court. We had then argued before the bench of the Chief Justice that he had not granted the stay and the law had been upheld. Today s result is sad. Sometimes there is no lawyer, sometimes there is no coordination.so, the law was postponed. The case went before a larger bench when the present government did not seem to have coordination in presenting its role.

Mumbai: The Supreme Courtâs order cancelling the reservation in education and government jobs for the Maratha community was unfortunate and the news had come at a time when the Maharashtra Government is engrossed in combating the coronavirus, said Chief Minister Uddhav Thackeray. The apex court order was unwelcome, he said, adding that he was requesting the Centre with folded hands to step in, showing the same urgency as it had done in the case of Article 370 and some other matters.

Mr. Ambedkar, the grandson of Dr. B.R. Ambedkar, said that while no OBCs (Other Backward Class) or SCs (Scheduled Caste) had ever been against poorer sections of the Maratha community, it had always been rich Marathas against their poorer brethren.
