Settlement Reached With Final Defendant in Farmer s Peanut Antitrust Lawsuit

Agriculture Giants your username March 12, 2021 On Thursday, the plaintiffs in a class-action lawsuit purporting that major companies in the runner peanut industry are participating in anticompetitive activities asked the Eastern District of Virginia to give preliminary approval to a $45 million settlement with one of the defendants, Golden Peanut Company LLC. This settlement follows a $57 million settlement with defendants Olam Peanut Shelling Company Inc. and Birdsong Corporation.  The plaintiffs in the lawsuit, D&M Farms, Mark Hasty, Dustin Land, Lonnie Gilbert, Daniel Howell and Rocky Creek Farm, are peanut farmers who sell to the defendants for processing.  They purported that the activities of the large processing companies were harming their businesses and breaching antitrust laws. March 10, 2021 An individual filed a class-action complaint on Tuesday against his former employer, Surgical Care Affiliates LLC (SCA), and affiliated entities, alleging Sherman Act and Clayton Act violations through lowering employee wages in an anticompetitive conspiracy among other companies in the market. The Northern District of Illinois lawsuit came on the heels of a Jan. 5 Department of Justice criminal indictment against SCA, claiming the company and others were colluding to control the labor market. SCA owns and operates about 230 outpatient care facilities across the country, serving around 1 million patients every year, with approximately 10,000 employees, according to the complaint. Plaintiff Allen Spradling was an employee of SCA from Sept. 22, 2008, until April 26, 2013, as a manager of the program management office and then as director of information technology.

Agriculture your username February 24, 2021 In an antitrust lawsuit filed against Golden Peanut Company and other Runner peanut producers accusing them of antitrust activity, a judge ruled on four motions in limine filed by the plaintiffs asking the court to exclude certain evidence before the trial in the matter.  The judge ruled that insurance crop claims and the plaintiff’s communications with other peanut farmers should be available in the evidence, but granted the other requests.  The judge filed an Order on Wednesday denying one of the plaintiff’s motions in limine asking for the court to exclude any evidence relating to the plaintiffs’ contact with other peanut farmers during the trial. The plaintiffs argued that the information is irrelevant to the antitrust activities of the defendants and is prejudicial.
