Hydro Power Litigation Update May 2021

Monday, May 3, 2021 U.S. District Court Rejects Appeal of Corps 404 Permit and Biological Opinion as Collateral Attack on FERC License Amendment Order In  Save the Colorado v. Semonite, U.S. District Judge Christine Arguello ruled that the U.S. District Court for the District of Colorado did not have jurisdiction to hear a challenge by environmental groups to a Clean Water Act (CWA) section 404 permit issued by the U.S. Army Corps of Engineers (Corps), or an associated biological opinion under the Endangered Species Act (ESA) issued by the U.S. Fish and Wildlife Service (USFWS), for the City and County of Denver’s proposed dam raise and reservoir expansion.  In a March 31 order, the district court dismissed the case, finding that the exclusive forum for challenging the dam raise was in the U.S. court of appeals because both agency approvals were “inextricably intertwined” with a license amendment granted by the Federal Energy Regulatory Commission (FERC) under th

“Where life leads.” An interesting brand, but totally nondescript. Take a drive around the perimeter of the city and try to find a spot that is not cluttered. Look at the stretch of Patterson where a ditch, once covered with vegetation, was piped, covered with grit, and decorated with wooden light poles draped with wire to a main somewhere. I’m surprised that the professional offices and businesses on the other side of the street haven’t risen in revolt. And more suggestive of a brand, consider the “improvements” to Highway 6 & 50 passing through our main commercial area. It goes below desert criteria and makes Death Valley look like an oasis with clean air. Colored imprinted concrete and gravel is not landscaping.

Garfield County commissioners formally oppose Biden's 30×30 climate crisis plan

The Board of County Commissioners unanimously adopted a resolution opposing the land preservation goal. In it, they said Garfield County relies heavily on its existing public lands for natural resource development, oil and gas leasing, grazing and recreation. To cut back on those uses, and to potentially close off even more land from resource development, could have dire impacts on the local economy, they said. “The 30×30 program, if implemented, is likely to cause significant harm to the economy of Garfield County, and injure the county’s businesses and its citizens by depriving them of access to public lands … and preventing the productive use of these lands’ resources,” the resolution reads.
