Joe, this is completely unheard of. Reporter it is, ken. Three times jahi mcmath has been declared legally dead. Three times but her lawyer now claims she has improved significantly. So much so, he is asking an Alameda County judge to declare her alive again. Attorney chris dolan says he has experts coming to the bay area to say jahi mcmath is alive. Tests show she has brain activity that wasnt there before. Dolan is asking the judge to declare she has not suffered brain death and he wants her death certificate voided. Jahi is doing so much better physically. Reporter they insisted their daughter is improving. Remember late last year, she had gone to oakland Childrens Hospital for a tonsillectomy but there were complications and she was declared brain dead. Her family fought the declaration and move

Doctor tom frieden of the centers for Disease Control and prevention said the nurses infection could have resulted from touching contaminated protective gear. The cdc is in the process of putting new safeguards in place to protect medical professionals and the public.
