The Supreme Court has agreed to hear a plea by Vikas Yadav, who is serving a 25-year jail term for the 2002 Nitish Katara murder case, regarding the denial of remission benefits. Yadav has argued that the right to remission is protected under Article 21 of the Constitution and cannot be restricted by judicial pronouncements.
The Supreme Court today said it would hear on October 3 a plea by Vikas Yadav, who is serving a 25-year jail term in the sensational 2002 Nitish Katara murder case, raising the issue of denial of remission benefit to him.
The Supreme Court on Tuesday said it is unhappy with some state governments for not filing counter-affidavits in time, while hearing a plea seeking directions for enacting well-defined laws/rules to ensure adherence to the fundamental duties as enshrined in the Constitution.
