video. it lasts about 55 seconds showing bruises allegedly caused by her husband. the video shot by her neighbor, ivory madison. the attorney wants the evidence thrown out. she thought she was speaking privately to an attorney since madison is a law school graduate even though she is unlicensed in california. this decision is being made by a three-judge panel in the appeals court after the judge in this case ruled last week that the video could be shown. mirkarimi s attorney is also fighting against that video saying there s no way for her to cross-examine the testimony if lopez herself does not testify. also today, judge garrett wong will consider a motion by the prosecution to allow testimony from domestic violence expert and uc-berkeley lecture your nancy lemon. and there are a couple of other motions still undecided including one to move this trial out of san francisco. mirkarimi of course is charged with domestic violence battery, child endangerment and dissuading a witn

ktvu is finding out what happened. reporter: the lockdown is over because police discovered the man they were looking for is no longer inside that cvs store. they wrapped up their search of the cvs on 1500 broadway. you can see cars and customers are moving in and out of the parking lot just like a normal day, but it was a much different scene here earlier this morning. this is what the parking lot looked like at 7 a.m. police had their guns drawn and the entire parking lot was closed off for nearly four hours. it started at 6:40 this morning. the store wasn t open yet, but there were two employees in the back of the store, and they were the only people in the back of the store at the time. they were getting ready to open. a man walked up and approached the employees and was wearing a black ski mask. they immediately knew something wasn t right. it s not typical for anyone to walk into a store, a place of business wearing a ski mask so we have to assume the worst. reporte
