لقد اشتق اغلب العلماء والفقهاء المسلمين حكما من كتاب الله القران الكريم بان الدولة الكافرة غير المسلمة يدوم حكمها اذا كانت عادلة وان الدولة المسلمة تزول وتسقط اذا كانت ظالمة. يبدو ان استنباط هذا الحكم من قبل العلماء الربانيين صحيح لو راجعنا اهمية العدل في الاسلام فهو القيمة الاساسية التي لا يفرق الاسلام فيها بين مسلم وكافر. اذ يعدل بينهما ويعطي الكافر حقه رغم كفره ضد المسلم اذا ظلمه “لا يجرمنكم شنئان قوم على ان لا تعدلوا اعدلوا هو اقرب للتقوى. فلا اسلام حقيقي دون عدل وانصا�
