LINCOLN, Neb. (KLKN) – Carrie Herrera, widow of Lincoln Police Investigator Mario Herrera, who was shot in the line of duty in August and died in September, is opening up for the first time since his passing.
For most of Lincoln and the state of Nebraska, Investigator Herrera’s passing was just a few days of grief and remembrance, thoughts and prayers.
But for his family, the last five months have been filled with mountains and molehills and continues to be interrupted by a series of roadblocks.

Council votes to postpone discussion on ending Lincoln mayor’s emergency powers
The Lincoln City Council was split Monday on whether to table a discussion about ending Mayor Leirion Gaylor Baird s emergency powers.

Gaylor Baird declared a state of emergency in March related to the coronavirus pandemic.
The declaration was approved the same day by the City Council, which also approved an extension beyond the 72-hours allowed by city code.
Councilman Bennie Shobe said he thinks there’s confusion among Lincoln residents about what the emergency declaration allows the mayor to do.
“We tend to see people in our community confusing the power of the DHM and the federal funding,” he said. “I was hoping for a public hearing so we could teach the public the difference. The emergency declaration doesn’t affect the DHM and most people don’t understand that.”

Mario Herrera’s widow not receiving full benefits from city, attorney says
An attorney representing the Herrera family says they are prepared to file a lawsuit against the city if an amendment to a city ordinance isn t passed.

LINCOLN, Neb. (KLKN) – An attorney representing the family of Lincoln Police Investigator Mario Herrera, who was killed in the line of duty in September, says a city ordinance is blocking the family from obtaining Herrera’s full pension benefits.
A city ordinance passed in 1994 states that police officers or firefighters who are under a certain pension plan and are killed in the line of duty, can’t receive full benefits from both the employee’s pension and workers compensation.
