Rob Burke, City Council candidate for Ward 1, filed the suit Friday afternoon.
Burke lost the election, held on May 4, to City Councilmember Bob Garrett 494 votes to 490 votes.
Burke said Monday he wanted to make sure the election process was conducted fairly.
âI feel like thereâs some questions about the integrity of the election,â Burke said. âI feel like its right for the people to know if the election was fair and the only way to know that is for a judge to look at it and see if itâs fair or not.â
Jeff Gardner, administrator of elections for Hamblen County, said he had forwarded the suit to County Attorney Chris Capps and could not comment at this time.
Election Day is here for the city of Morristown.
The city of Morristown is holding election for three City Council seats with two seats having opposition and the last seat being unopposed.
Current City Councilmember Bob Garrett faces challenger Rob Burke for the Ward 1 seat, while Councilmember Kay Senter is being challenged by Charles Cook for the Ward 3 seat. Councilmember Tommy Pedigo is running unopposed for an at-large seat.
Polls opened at 8 a.m. and will close at 8 p.m.
A threat of storms are forecasted to come through the area throughout the day with a chance of precipitation at 60%, according to the National Weather Service. The threat of rain could lead to lower voter turnout, election officials said.
