McGlynn transfers Great Clips lockdown loss suit to Colorado where business is based

McGlynn EAST ST. LOUIS – Great Clips salon owners who voluntarily dismissed a lockdown suit in Colorado and filed it in Madison County should have kept it in Colorado, U.S. District Judge Stephen McGlynn ruled on May 27.  He transferred a complaint of Holtzman Enterprises, owner of about 50 salons in Colorado and Missouri, proposing a class action against Continental Casualty.  McGlynn presided because Continental removed the complaint from Madison County circuit court to U.S. district court.  He wrote that a plaintiff’s choice of forum is entitled to deference, but less deference when the choice isn’t the plaintiff’s home.
