him. can he say, look, i m the president, forget about it? no. in fact, we saw that exactly play out in clinton versus jones. that s what clinton tried to say in respect to paula jones request for a deposition. the court upheld her right to take that deposition. he went into that deposition. he lied. it gave rise to his lying in the grand jury and his impeachment. this is very dangerous territory for the president, because as kim says, the defense here is, i didn t have that acting, i didn t grope her. if he says it didn t happen, and she says it does happen, and she can prove that it happened, then he s lied. in that deposition in the paula jones case, that was part of the reason he was eventually impeached in the house of representatives. not convicted in the senate but impeached in the house. that s exactly right, wolf.
not above the law and that he would have time to do his duties. one more point about that. there s much ado being made by the president and john dowd apparently about how a subpoena or a grand jury testimony would disrupt the president s ability to do his job. the supreme court is already dealt with this issue, talking about these cases in clinton v jones and saying we have a cabinet to take on a lot of the other roles. it wouldn t take all of your time but a select portion of it. you could actually do this. to be clear, though, the nixon case was different because it dealt with the tapes not the president himself. the clinton case insofar as it relates to the subpoena from ken starr, it never went before the court, so there is an element of the unknown here. the supreme court has not had to rule on this specifically, so it is a little bit of an unknown, correct? it is an unknown and that s the important part. this is all new territory. ultimately the underlying theme and the under
jury subpoena. clinton versus jones and nixon versus the united states do not allow them to resist. and so they re preparing for the inevitable. or they still think there is wiggle room and trying to present the evidence to the president about how he could be in danger were he to sit down and use these prep sessions as a means to dissuade him from moving forward with the interview and taking it to court. or also to see maybe possibly how he performs during interview and then judge well maybe he might be okay with the special counsel maybe. but if you watch the presser or whatever it was in west virginia where he threw his notes up in the air, i don t think that is a good sign of how things might work out in that respect. well said. that is a good observation. pam, the president has said multiple times that he wants to sit down with robert mueller. watch this. would you be willing to speak under oath to give your version
this interview. i think he fully well understands what it is. i think the preparation probably speaks to the fact that he realizes that this is not a civil deposition and that he has to prepare for this thing. i think his lawyers are probably impressing him the seriousness of this. whether he will do his homework or not remains to be seen. but i would be careful about trying to analyze the president in respect of in interview. if this interview occurs. and i think it has to because i think the law of the land will require it if mueller pushes the proposition. you think it s going to happen. will be a serious i think it has to happen. because the way the law sets up with nixon versus the united states, and clinton versus jones, the president really can t resist testifying. mueller has to show that he can t get the evidence from another source as a predicate for the interview. and i think that with respect to obstruction of justice and the collusion conspiracy stuff,
