Yesterday, following an application by the prosecution, Judge Donna McColgan QC ruled that the indictment faced by Mr McClean be endorsed as having no legal effect and the file closed .
Mr McClean, who was originally from Andersonstown in west Belfast but had an address in Hilden Court, Lisburn, was due to go on trial later this year on four terror-related charges.
Senior officers investigating the murder of north Belfast man Danny McClean have arrested a 32-year-old man in connection to the incident.
A PSNI statement issued on Wednesday evening said detectives from the serious crime branch made the arrest in the Belfast area.
The 32-year-old has been taken to Musgrave Police Station for questioning.

POLICE were granted additional time at the weekend to question two men in connection with the murder of Danny McClean in north Belfast.
The 54-year-old was shot at close range by a lone gunman as he sat in a car on the Cliftonville Road on February 2.
Police said on Saturday they had been granted an additional 48 hours to question two men, aged 46 and 39, who were arrested as part of the investigation on Thursday.
Both men last night remained in police custody.
