On June 22, Cheboygan County Treasurer Buffy Jo Weldon updated the Cheboygan County Board of Commissioners on proceeds the county gathered from the 2019 tax foreclosure property sales, which was more than $140,000.
Starting this year and not later than Sept. 30, which has been changed from June 30 the county treasurers around the state have to submit a written report to their boards of commissioners, as well as the Michigan Department of Treasury. This needs to be done no later than that date on the second calendar year after the foreclosure on the properties being sold.
These written reports include the identified amount of sales proceeds sitting in the county s tax foreclosure fund.

Public Acts 255 and 256 of 2020 have made modifications to the General Property Tax Act after a Michigan Supreme Court ruling. This ruling determined that people with interest in tax foreclosed properties have rights under the Michigan Constitution to the proceeds gathered at auction over and above the amount of the back taxes, penalties, fees, interest and other costs owed on the property. This decision made a drastic change in our foreclosure law, said Weldon. We are no longer able to transfer the sales proceeds to the general fund. We haven t transferred proceeds in several years, just based on possibility of this decision.
