At the June 22 Cheboygan County Board of Commissioners meeting, Cheboygan County Treasurer Buffy Jo Weldon explained to the commissioners several public acts that have changed how the county handles property foreclosures.
Public Acts 255 and 256 of 2020 have made modifications to the General Property Tax Act after a Michigan Supreme Court ruling. This ruling determined that people with interest in tax foreclosed properties have rights under the Michigan Constitution to the proceeds gathered at auction over and above the amount of the back taxes, penalties, fees, interest and other costs owed on the property. This decision made a drastic change in our foreclosure law, said Weldon. We are no longer able to transfer the sales proceeds to the general fund. We haven t transferred proceeds in several years, just based on possibility of this decision.
