A Saint John judge will decide whether the plaintiffs in a class-action lawsuit against the City of Saint John will have to pay costs. Justice William Grant of the New Brunswick Court of King's Bench has reserved decision.
Suit is accusing the city of vicarious liability for the harm Kenneth Estabrooks inflicted from 1953, when he became a police officer, to 1983, when he retired from the city works department.
Four men between the ages of 58 and 66 have now described to a judge how they were terrorized as children by former Saint John police officer Kenneth Estabrooks, who died in 2005.
