The Bombay High Court recently quashed a case of cruelty filed by a judicial officer against her husband and his family members under Section 498A of the Indian Penal Code (IPC).
The Court added that it was unethical of the Indian father to claim that he was subjected to racial discrimination by his former wife when she had spent several years with him as a married couple.
A division bench of Justices GS Kulkarni and Firdosh Pooniwalla directed the CGST commissioner to file a reply to the petition and posted the matter for hearing on February 20.
The Court found that the case before it was neither a case where the promise of marriage was "false" to begin with nor was such promise the sole reason for the complainant entering into physical relations with accused.
