Someone can bring a claim against an NHS trust if it is believed they, or a family member, suffered harm or died due to negligent treatment. Data from NHS Resolution, which handles such cases on behalf of the NHS, reveals 62 clinical negligence claims against Oxford University Hospitals NHS Foundation Trust (OUH) were successful in 2019-20. A total damages bill of £6.3 million was paid out in relation to these claims over the year, while further legal costs totalled £895,798.

Sam Foster, chief nursing officer at Oxford University Hospitals NHS Foundation Trust (OUH), which runs the John Radcliffe, said those on the pandemic frontline were facing a ‘hugely challenging’ situation though stressed tried and tested measures were in place to manage escalating admissions as cases in the county surge. The trust, which also runs the Churchill, Nuffield Orthopaedic Centre, and Banbury s Horton General Hospital, reported 12 deaths of patients who tested positive for Covid-19 between December 23 and 28, including five on Christmas Day.
