A longtime Franklin County assistant prosecutor has been arrested by Westerville police on misdemeanor charges of domestic violence and assault.
Brian E. Simms, 59, a Westerville resident who is an assistant prosecutor for the Franklin County Prosecutor s office, was arrested Saturday following an incident involving his wife, according to court documents.
Simms pleaded not guilty to both charges Monday in Delaware County Municipal Court and has been released from jail on his own recognizance.
The Dispatch left messages with the Franklin County Prosecutor s office on Tuesday night seeking comment.
Defense Attorney Sam Shamansky, who is representing Simms, told The Dispatch on Tuesday night that his client remains employed at the Franklin County Prosecutor s office and has been ordered to have no contact with the victim.
