just hours from now a high-stakes hoe doun in a florida courtroom. i m john berman with brianna keilar and this is a new chapter in the battle over sensitive documents recovered from mar-a-lago. the immediate issue whether a special master will be appointed to oversee the documents that were seized from donald trump s beach house by the fbi. donald trump wants a special master. the government insists there is no need for one. a judge will hear arguments at 1:00 p.m. eastern time. in the blockbuster filing from the department of justice tuesday night the doj argued that the appointment of a special master would impede the government s ongoing criminal investigation and if the special master were tasked with reviewing classified documents, would impede the intelligence community from conducting its ongoing review of the national security risk that improper storage of these highly sensitive materials may have caused. trump s lawyers made several arguments in a court filing las
department saying it is already parsed through those documents, which is what is known as a filter team to look for any privileged communications. trump s lawyers acknowledged that classified material was found at mar-a-lago, but argued that should not have been a cause for alarm and should never have led to the search of trump s home. trump s lawyers insisted the national archives should have expected to find classified material because they were presidential records. let s begin this morning with cnn correspondent kara scannell. you re there, you re waiting for this hearing to dbegin. what can you tell us about the filing that came in last night right before the deadline? their main arguments. and notefably what they didn t y what they didn t argue. reporter: that s right, poppy. last night the trump team submitted their filing, 19-page filing, asking the judge to appoint a special master. that s this third party person to review the materials that were seized at mar-

doj could not be sptrusted to v the documents. trump s attorney said the filter team at the fbi is using the review the seized papers has virtually unchecked discretion in addressing potential privilege disputes. the judge was appointed by former president trump and has already indicated that she is leaning toward a special master. now, that was before the explosive brief from the justice department. it laid out the months-long effort by federal investigators to get back the government s classified records. cnn senior justice correspondent evan perez is tracking all the developments. he is joining us from washington, so what s happening so far? reporter: well, so far, we don t really know much about what s going on in court. we can t get any updates until the hearing is over, victor and alisyn, but what we know is that the trump team is going to is trying to present to the judge this idea that it is no surprise that there were what they said, sensitive documents that we
