John, i think its a tough case for the Police Officer, because in terms of looking at that tape, a Police Officer has the right to use deadly force when he reasonably believes that serious force or deadly force is going to be used against him. And in this case all he knew was there was sort of a vague complaint about an open door at a residence, and he walks around. It looks like hes going past a gate of some kind which might give the person inside the house the thought that somebody was trying to break into the house.
