In 2021, the apex court had dismissed pleas by telecom companies seeking correction of errors in calculation of AGR dues payable by them as per the top court's October 2019 judgment.
Bharti Airtel and Vodafone Idea have requested the Supreme Court to hear their curative petitions against an earlier order in the "open court." The telecom companies are seeking rectification of alleged arithmetical errors in the calculation of adjusted gross revenue (AGR) dues by the Department of Telecommunications. The operators argue that the previous judgement resulted in a "gross miscarriage of justice." They are specifically seeking the setting aside of penalties and interest on penalties in the provisional demands raised by the DoT. The AGR dues amount to a total of INR 1.47 lakh crore ($20 billion).
Senior counsel Harish Salve, appearing for Vodafone Idea, told a Bench led by Chief Justice DY Chandrachud that its curative petition pointing to arithmetical errors in the calculation of AGRs should be heard soon. Salve was joined by senior counsel K.K. Venugopal, who appeared for Airtel, in seeking open court hearing on the curative petitions, saying that the "prejudice is so huge that there is a need for open court hearing.”
