i think the laws and facts are clear against donald trump. turning the page to what we saw happen yesterday afternoon, just about exactly 24 hours ago and that was guilty on all counts both manslaughter charges against former minnesota police officer kim potter, the sentencing is going to happen in february, for the killing of 20-year-old daunte wright. she faces a maximum of 15 years in prison. but the prosecution is pushing for aggravating factors or blakely factors. they were successful, ellison doing so with derek chauvin and his sentencing. do you think they ll be successful here? so i don t think ultimately they ll get above the 15-year range. i think if you look at the minnesota guidelines, here is recommends a sentence of 6 1/2 to 8 years. my suspicion is that ultimately will the judge will land. it is important to know, that at sentencing, the only rule is that anything goes. things that are not admissible
under nine years as part of this. and between them, though, the prosecution will argue for what s known as aggravating factors to tack onto sort of the recommended guidelines within the state of minnesota here along with we ll hear victim impact statements, people that were who have had their lives changed from this who will argue that the sentence should be more severe than what the guidelines show. another note i want to make known is daunte wright s mother today said that his favorite number was 23, and here comes this conviction on the 23rd of december, john. omar, thank you so much for being there. perspective now from two distinguished criminal defense attorneys. sarah, were you surprised by the verdict? because we were all together last night talking about this as the jury finished for the day, no questions yesterday, and there had been some notion they might be hung.
generate 31st, that is a monday. okay. and how long would the state like to respond to the motion, the sentencing motion? could we have two weeks, your honor? ema. and that would be? february 14th. mr. frank, i think the aggravating factors we did the blakely on a unitary basis, so no further evidence would be required, correct? that is correct, your honor. so could you submit your brief on the aggravating factors? how much time do you need on that? two weeks, your honor. okay. and the defense would need okay. mr. cramer, could you tell them
count in his case, however, prosecutors over the past few weeks, as i ve said they would on this and other programs, have other aggravating factors they want to use that would support the increase of the actually sentence chauvin will receive, and judge cahill has, in fact, said he finds those factors mitigating. those factors being number one, it was a slow and calculating way he did this, the slow death of mr. floyd by derek chauvin contributed to that, in addition to the fact there were a number of minors around, the youngest being 9, the oldest being 17. the judge talked about that. ultimately i think what we re looking at is a higher sentence, not necessarily the maximum. we won t see what the prosecution asked for, 30 years. i think it s safe to assume
cahill ruled on a number of factors, what s called aggravating factors that could boost that number up towards the statutory maximum of 40 years. now, some of those factors, as you begin to read them off, are that he abused a position of trust and authority, chauvin did. that chauvin acted with cruelty. he acted with three others who participated in the crime, and that he committed the offenses in the presence of children. again, all factors that could boost that sentence. and we look at judge peter cahill s history. he truly has hit the full range of this. in the past 13 years he sentenced six people for second degree murder convictions, hitting all from that 12 1/2 years all the way up to the statutory maximum of 40. but even beyond today, even though this is the close of one chapter that has brought this city across the united states so much of the course of the past 13 months, we are still far from the end of this story and all of
