The High Court said that it was of the view that if Dileep's bail was cancelled now "it may lead to further litigations and complications which may frustrate the trial which is about to be completed and may drag the proceedings indefinitely".
The Court also ordered the District and Sessions Judge, Ernakulam to conduct a fact-finding inquiry on the allegations of unauthorised access to digital evidence in the 2017 actress assault case.
"The necessary conclusion would be that we failed to protect the victim's interest, which resulted in the violation of her fundamental constitutional right," the Court said.
The Court on Monday had appointed advocate Renjith B Marar as amicus curie to help the Court formulate guidelines to ensure the safety of electronic documents in judicial custody.
The issue came to the notice of the Court while considering a plea moved by the survivor in the 2017 actress assault case alleging foul play in the investigation in the case in which cine actor Dileep is a key accused.
