Kumar has instead been charged with rioting, attempt to murder and other offences for crimes against the Sikh community in the aftermath of the assassination of former Prime Minister Indira Gandhi.
The court further ruled that there was enough oral and documentary evidence on record to show that Kumar was part of an unlawful assembly of hundreds of persons armed with deadly weapons, which set the Gurudwara in Gulab Bagh on fire.
Special judge MK Nagpal said he was of “prima facie” view that oral and documentary evidence placed on record by the prosecution was sufficient to hold that an unlawful assembly or mob consisting of hundreds of people armed with dandas, iron rods, bricks and stones etc. had gathered near the gurdwara in Gulab Bagh in the national capital’s Nawada area on November 1, 1984 around 11 am
CBI has recently filed a fresh charge sheet in relation to the 1984 anti-Sikh riots across the country, where it has been revealed that Congress leader Jagdish Tytler played a major role.
Jagdish Tytler case: The CBI has contended in the chargesheet that "sufficient material is available on record to show that Jagdish Tytler was a part of the unlawful assembly committing rioting that had assembled near Gurudwara Pul Bangash".
