Prosecutors are expected to call current and former students to testify about secret at one of the countrys most selective schools. This morning, Opening Statements in a case thats raising questions about the culture of sex at an elite boarding school. Any comments as your trial gets under way . Reporter then 18yearold owen labrie is accused of raping a 15yearold freshman on the roof of a School Building last year, the prestigious st. Pauls in New Hampshire where tuition tops 50,000 a year. Its alumni include secretary of state john kerry, former fbi director robert muller, actors, bankers and members of congress. According to a search warrant one of the counselors at the school said there is a horrible tradition at the School Called the senior salute in which a senior emails a younger student regarding a conquest before they graduate. In an interview with a detective labrie described sexual score boards in which other boys tallied conquests on a dorm wall and on inloo. He denied that senior salute had anything to do with the rooftop encounter with the girl. Labrie planned to studilele theology at harvard and said they kissed but he experienced a moment of divine inspiration and stopped himself from going further. A friend says labrie comes from a modest background, was beloved by crass mates who raised money for his defense. St. Pauls says current allegations about the culture are not emblematic of the school or our values. It would be great if the senior girls and guys could stand up and say these rights and traditions arent things i want my sisters and others to engage in so we need to stop it. Reporter labrie pleaded not guilty to multiple charges of sexual assault. Its traumatic for any citizen to be put on trial for any offense, never mind a serious offense. Thats the case with owen. This young man publically denied having sex with this girl but it is alleged he told another student they did have sex and he knew she was under aged. He went to the police without a lawyer and spoke to them. Is that admissible . It may be adadmissible. They will debate what he said and some of what he said to the police and his friends goes to what was more truthful than what he may want to deny now that hes facing trial. There is a piece of physical evidence here, a laceration that, according to some, is consistent with sexual assault. Might this entire case hinge on that . It will be the biggest piece of nontestimonial evidence. He said she said and then this physical evidence the prosecution believes goes to her point that this physical act occurred. Hes saying it stopped well short of intercourse. Now the attorney in this county was heard in court yesterday in an unguarded moment saying that the senior salute, which is what the conquest is apparently called on campus, will play a prominent role in this case. Is that a good strategy for the prosecution to put the school on trial at the same time you put this young man on trial . It may be. Heres why. What the prosecution needs to argue is not that this was highjinks or consensual relations between two individuals that got out of hand or was misunderstood but rather this defendant had a plan to go in and do this with or without consent to someone he knew to be young under New Hampshire law too young. And the senior salute, this set of traditions goes to his mental state in the prosecutions view. If it was a well known horrible tradition at this school, couldnt that be a doubleedged sword . If you are the defense dont you say this young lady might have known about it and never should have been in that situation in that remote location . Thats typically considered a good defense for adults when everything turns on consent. Here there are three charges related to consent and rape, three more just about her youth. Critics charge delta is shaming customers into paying more. Airlines are trying to upsell you on things pay for your bag, for extra leg room on your seat and the way to do it is to shame you to then pay more for anything extra. But consumer advocates say the transparency only goes so far since airlines dont disclose additional fees up front. Where delta says they will be transparent about what we are not going to get, they are not transparent about how much it will cost us.
