The kids were playing upstairs and next thing she she found her baby lying on the floor like that and ran outside. Reporter she ran into a Health Clinic across the street to get help. The nurse came and took her pulse and her heart rate and somebody get get the oxygen thing. She was gasping for air. Reporter police say the circumstances of the shooting are under investigation. They are trying to determine who was home at the time, how the gun went off, and who the gun belongs to. We have a fouryearold little girl thats dead here thats our number one priority fininfining out how this happen. After learning the news neighbor janice code dropped her head into the hands. The little girl called her the neighborhood grandma and said hello to her each morning on her way to school. No child deserves to go out like that. Not like that. No kind of way. Not like that. Fattah had said initially that he would leave office once a judge sentenced him in october. The 16 year veteran of the force elected for a bench trial leaving his fate in the hands of circuit judge Barry Williams instead of a jury. Prosecutions case hinging on the allegation gray died from what the state describes as a rough ride. It is one thing to say that he was careless and even reckless in his driving, but when we start using a term like rough ride, were talking about a deliberate intent to injuria passenger and im not sure you can derive that just from that one turn. Reporter gray was handcuffed and shackled in the back of a police van but not seat belted in according to prosecutors when his neck was broken. The 25yearold died a week later. So right now, people here asking, did the States Attorneys Office really over charge in these cases again two acquittals and one mistrial . Still three officers to go and right now the police unit here in baltimore asking the States Office to simply drop those charges for the three remaining officers because so far the community here has not seen the results if they wanted to see. Reporter the state commission of investigation borough and state Officials Say sirkin illegally brought in more than 380,000 cubic yards of material over 20,000 truck loads. That raised the site by 10 to 15 feet. Theyre one bill bulldozer that would shake my entire building. John, operates cos auto repair right next to the jersey recycling site. He remembers all those trucks. They were seven days a week around the clock. At least a hundred trucks during the working hours. Id see just coming in. Hundreds of trucks that were coming into the site from all over the south jersey, philadelphia and even into Central Jersey areas. Reporter the sci borough officials and say the environmental Officials Say the debris that was dumped at Jersey Recycling Services was accepted without the proper environmental permits. The dirt hauled here by truckers came from three sites. Including the site of the Camden CommunityCharter School on ninth street in camden when it was being built three years ago. Dirt also came from a site in new brunswick. The sci says that dirt from those two sites was contaminat contaminated. Soils that were contaminated with a known car nine so jenn. I hope it would have an effect on me and my property. Were hopeful the very toxic influx hasnt gotten into the streams and the waterways. Reporter sci also says hundreds of truck loads of dirt from the massive 400 milliondollar i95 expansion project in the philadelphia area were taken to the pell myra site. I95 project is being funded by state and federal taxpayer mon money. We spoke with the person who was reported to be the guy in charge of accepting and mulching and mixing. He toll us he never handled construction debris before. The level of contamination that has occurred here is very very disheartening. Reporter the sci and borough Officials Say when they alerted the new Jersey Department of Environmental Protection to what was going on at jersey recycling site in palmyra, the dep stepped in and issued a notice of violation. They told sirkin to make changes. Thats when the sci says, sirkin skipped town and went back to boca rah ton, florida. Should he be held responsible . Yes. And maybe some of those ill gotten gains should be used to clean up his mess. Reporter sci investigators say sirkin is a convicted racketeer who spent time in federal prison. He has they say some ties to members of the the new york and philadelphia mob. Called organized crime for a reason frankly. 380,000 cubic yards illegally dumped on property within the borough. Merlinos federal parole was revoked in 2014 because he was seen associating with sirkin and philadelphia mob captain and convicted felon john changlini in florida. Reporter as it turns out brad sirkin was subpoenaed to testify at an sci hearing a few weeks ago about the dumping here in palmyra. His attorney sent the sci a letter saying his client would assert his fifth amendment right not to incriminate himself. Sirkin did not appear at the hearing but he wasnt the only witness who refused to testify. How did you decide to allow this material to end up there. I invoke my fifth amendment right. Reporter the sci says Frank Gillette ran similar operation to the one sirkin set up in palmyra. Gillette they say sent hundreds of truck loads every construction debris to this beach at the jersey shore in Cliff Wood Beach, monmouth county. Reporter sci investigators produced this check that was sent to sirkins Company Jersey recycling Services Back in 2013. The name of the company who sent it and the person who signed it have been blocked out by the sci. Jersey recycling received 50,000 shareholder loan from a known bonanno cap poe. Reporter the mayor in palmyra officials now claim sirkin and the Property Owner fill it, ink, have left them with a big mess and potentially a big price tag to clean up the site. Now, filed suit against fill it, a trial is scheduled for octob october. The lawsuit is really to put the people who are responsible on the hot seat so to speak. I have to get cleaned up and i dont think that the taxpayers in this town should have to foot the bill for it. The little guys always get screwed. It shouldnt fall on the taxpayers. Reporter we went to fill its address in lumberton, inform, to ask some questions. All we found was some old Construction Equipment and two empty buildings. The gate was locked and the sign on the fence said no trespassi trespassing. Certain fill it ink who the company that owns the property have acted very irresponsiblely at the end of the day theyre ultimately responsible.
