The door was smashed in half half the door is on one side the other half by the entrance bricks are all over the dining roomg kitchen, the couch is covered with glass and bricks. Reporter relatives tell me this truck parked in the driveway likely saved the lives of several family members in the home in Prince Georges County. Thank god. Reporter police say the man behind the wheel of the van hit a taxi cab a few blocks away kept going, hit two parked cars and then the house. They say he had been drinking and hes facing several charges. There would be hitandrun charges, related traffic violations as well as the drunk driving. Im pat lawson muse. D. C. s new pot law. Thats where we begin this morning. Now that you can possess and grow small amounts of marijuana in your home theres celebration and a lot of reading of the fine print concerning the law, the regulations. D. C. Defied congress and enacted this law which was passed overwhelmingly by d. C. Voters last year. Does d. C. Get the final word on this . Dave mcconnell, was congress outmaneuvered in some ways by the district . I dont think they saw this coming. I thought when they passed the bill you cut off the funding for a process or a project, you cant move on it. Thats usually it. Youre deadlocked. They found a way to do something. Were not quite sure what as we look at it. So theyre now angrily responding to the fact that they found Something Congress didnt think of and thinking they might be violating anti deficiency act. The republicans against weed in the city are saying the city must show them and have a report to them in a few weeks from now if theyre spending any money on the implementation of what theyre doing on this law. The city claims they dont have to spend any money. Well see. There are fines and penalties, jail terms even if you violate the anti deficiency act as its called. Is this a breakthrough moment as the advocates are claiming it is . For the district i would say. Nationwide and what the district represents i would say no. Theyre really behind these other states who passed these marijuana laws which are more open where you can sell it smoke it out in public. We know you cant do that in the district. They really are fairly restrictive. I think theyre moving slowly. I think the mayor and council are doing the right thing. Theyve talked to attorney general racine and they know or believe that the law is on their side. I think also publicly miriam bowser said she doesnt want to be bullied. She doesnt think congress should be bullying her. I think the issue is going to be folks trying to figure out in d. C. Exactly what they can do. And this involves the police who will be handling cards sort of informing them of what they can do and shouldnt do in terms of the law. Its going take some getting used to. The law says you can only use it in the privacy of your home. There apparently is still confusion about it because legally its not the law on federal land. Thats right. Its going to be people think the system could be chaotic for a while, certainly confusing as people get used to what they can and cant do. Essentially they really can do what they kind of could do before before this law passed the city as i understand it. Its restricted highly restricted. You cant do this on federal property. So the big breakthrough hasnt come that the proponents wish. But theyve gained a food hold. Well have to see how it plays out. How do you think the mayor looked . How did city officials look stand gz up against congress . I think she looked how she needed to look in terms of saying if youre going to threaten to send me to jail if you do that i think ive got a lot more important things to dothan going to jail. I think it was a threat that congress wouldnt follow through on and it would backfire because i think the district and mayor bowser could use it to show this is how the federal government is controlling the District Of Columbia to the point that they would put their representatives in jail for enforcing a law that was passed and supported by the d. C. Voters. Final lirks dave does the city really get the final word on this . Congress always has the ability to add language and make changes to law. Thats why this isnt the final word. We still dont know what somebody in Congress Might be thinking to further restrict the city. It looks like their options are pretty well completed, and more to the point, there are two other issues. You hit on one of them. What kind of control should the congress have over the city . What kind of role should they really be playing . Ive talked to a number of members who say we have Better Things to dothan worry about fraud in d. C. We have the nunding crisis with possible shutdowns, isis to worry about. Why are we worried about the District Of Columbia . In Virginia GovernorTerry Mcauliffe signed a bill for cannabis. If you look at the last couple national elections, its trending blue. I dont know if its trending that much to get that law changed in virginia. Metro radio failures. There are still areas in metro stations and tunnels where firefighters dont have clear radio communications. The fire chief says recent testing found several failures persisting in the communications around the city although the director of unified communications refused to say exactly where those failures were. Bremante sounds like theyre still working on this. Sounds like its a story and an issue that just wont go away even though metro wants it to go away. It would seem to me at some point all the heads would get together and decide this is what were going to do and this is how were going to move in a uniform fashion. I dont think this is good for metro. I dont think this is good for d. C. That they cant get this settled. It would seem to me its not a very complicated issue, decide which way you want to go how you want to implement these radios get them fixed or decide were going to go in a different direction. I think as the story continues to go on it becomes a distraction for the district distraction for metro. It would seem to me its not that difficult of an issue to come to some kind of agreement on. This is an issue thats been out there since 9 11 this connectedness. The fact for the delays and the reasons given for the delay, members of congress are losing patience. They are getting tighter and tighter with their demands. We could have a real clash from Congress Talk about congress involving itself in a local matter. They would say they have justification because its a safety and National Security issue. This is the Nations Capital and they may have to take action. On the other happened the fire chief says all firefighters will have Emergency Training on the subway system within the next two months. So thats progress isnt it . Thats progress. But i think thats a waitandsee. Two months is a very short time when you have 1,700 firefighters and right now you only have 100 who have been trained. I think it will be interested to see how youll get 1600 firefighters trained in 2 1 2 months. Remember this came about when senator mikulski discovered that d. C. And all the jurisdictions are not required to have training on the citys subway system. Shes moving to make that happen but the fact remains it hasnt happened and nobody seemed to know it until she found out about it. Got to take a break. Well be right back. Stay with us. Maureen mcdonnell, virginias former first lady has been sentenced to a year and a day in prison on corruption charges. District judge James Spencer ordered two years shell remain free while the case is being repealed. Maureen mcdonnells lawyer says the Fourth Circuit has found substantial issues for appeal that could overturn the verdict. My question to you is what do you think the fallout would be the reaction if the mcdonnells win their appeal bremante . Well i dont think it would look good. I dont think it would look good for the state, for the judicial system. Now, we can the argument could be what they were doing was subjective whether or not they were influencing in terms of legislation and bringing folks in and the gifts that they received. But this trial went on for a long time. I think the argument could be mcdonnell, both of them could have much longer sentences and the judge was easy on them on the sentences that were given and to take it to the next step and they would be set free i dont think it would set a good precedent or look good for the state. It wouldnt look good for the prosecuting team. They spent all this money, all these resources, all this time and have it overturned that shows they messed up somewhere. On the other hand would it really restore anything to mr. And mrs. Mcdonnell . Thats hard to say. Everyone has seen their lives play out in this case. The gifts they took the kind of things they got into. I think most people are disturbed by the amount of gift that he took and the amount of time was spent on this guy that was selling this health stuff and also the fact that mrs. Mcdonnell seemed the governors wife seemed allegedly distracted seemed to be a hard person to work with, her character has come out, his character has come out. How can they ever restore that . They did leave the court separately. I think what was interesting, the former governor said we are innocent. These charges should not apply to us. He did use the collective here. But they did leave separately. It does sort of look a little different than the way the trial went when they said the wife was the one pushing all this and mcdonnell seemed to separate himself from the wife. We may have some sort of public imaging thing going on here as the appeal moves forward. Talking to local politicians when this thing first broke, the idea that it wasnt a great marriage surprised an awful lot of people to the extent that were they using this. Now hopefully if all could go well in another direction, i dont think anyone would object to that. The fight against heroin. Governor hogan says marylands heroin crisis is demanding an emergency response. He talked about it during the campaign. Hogan outlined last week a plan to fight the increasing number of fatal over separate task force to address the problem and put the Lieutenant Governor rutherford in charge of this. What do you think about the plan and about his approach . He did make this is a sort of major platform. He said he would call for a state of emergency on the heroin issue. They cant do that legally. They addressed that. When you look at it, it isnt that much different from governor oh mall limit he had task force he initiated in june. The money is coming from grants. I think its more just as much personal as policy. The governor had said he had a cousin who died of a heroin overdose. Thats a very personal issue. I think from a policy standpoint he says we cannot arrest our way out of this issue. It is a disease. When you say that he opens himself up to other issues in terms of other drugs, in terms of arrests and incarceration. If hes going to call this a disease and the state cant arrest himself out of it what does that mean for other drugs in terms of when you arrest folks if they say, well this is a disease, i have a cocaine habit, its a disease, should i go to jail or get treatment . Do you agree with that . I think largely i would agree with that and i would add to that the state of emergency, thats nice ringing. The question is how much money, how much staff, what kind of resources will really be applied . Yet the governor has the bully pulpit he can make appearances, see people talk to people who are experts in the field, maybe make reports and try to help find a way to deal with the issue. Hes got something going there. We just dont know where its really going to go though. Does he have a lot of support in annapolis for this and is there going to be a lot of room for dealing with it in light of the budget. I think thats the issue, that what we have to get down to you see opponents to what hes doing saying listen youve got to put money behind this. The criticism is omalley and the new budget the governor is proposing, theyve cut 23 million out of programs that would help treatment. Theres a contradiction here. You have no state money going towards it. Some could argue this is more of a public stance here. A pr thing. A pr thing, but the policy going behind it isnt very strong. The toyota obliterated the bus shelter right in front of the safeway on connecticut avenue. The minivan ended up on its side with the driver trapped inside. Two people were sitting on a bench at the time of this crash. An 18yearold girl was pinned underneath the van and broke both of her legs. I saw the car tipped over on its side with the wheels facing this way. A lady trapped right here. The driver is 63 years old. Police say he had some sort of medical emergency right before the accident. In Virginia Police are reminding drivers to move over when you see flashing lights and Police Activity on the side of the road. A Fairfax County off sur was hurt yesterday after someone slammed into the back of his cruiser. The officer was helping a disabled driver on sully road. Earlier this week two Virginia State troopers were hurt in similar accidents. Right now investigators in Prince William county are working to find out what started a townhouse fire. How much of this is really a barometer considering that the majority of people that were there are libertarian leaning. 41 of the straw poll participants believe marijuana should be legalized for recreational use. I wouldnt say that is a slice of the conservative electorate of the republican party. Its clear rand paul once again successfully organized, bused more people in than everyone else. When you look at the top four of the straw poll results, all of them are conservatives. Rand Paul Scott Walker ben carson ted cruz. Fifth was jeb bush the establishment candidate. I do think what it does show is there is a lot of energy on the right and theres going to be a very fierce battle to be the conservative alternative to jeb. Thats what to me you should take away from cpac. On the flip side Homeland Security funding. We came down to the wire. This is only funded for another week, right . Now we have to worry about it again. It is. You do think House Republican leaders are tail between their legs on this one. I think they desperately hope they get the Court Decision that maybe the president s executive actions, he wont get a stay and be able to start implementing it. If they find that out this week very quietly it will be very easy for bain tore put the rest of the year funding through the house. It will get done. A lot of this had to do with the immigration battle. If that doesnt happen and were still unknown there, i dont know how we get something through. He can get something passed because democrats will support a full year of funding. The problem for boehner, do conservatives end upcoming after him if he does Something Like that . Im going to tell you im so depressed about that. There was so much hope that the white house and the House Republicans would be able to fix this dysfunctional relationship. Senate republicans versus House Republicans. Before House Republicans would sit there and Say Senate Democrats were making their life miserable. Thats why they couldnt get anything done. Around our viewing area around this morning, some places could pick up two inches of snow or less. Two inches i think is probably the highest amount. Reporter theres one thing all the neighbors can agree on. On this strech of 14th street near maryland avenue in northeast d. C. Its a good conversation topic with neighbors because everyone is like oh the potholes. Reporter angie says it was the first thing she noticed when she moved into her home. We had the moving truck day, they almost got stuck in it. Reporter she calls it a natural speed bump because everyone slams on their brakes when they see it. Sometimes i make this turn because i dont want to go that way. Reporter its just one of nearly 40,000 potholes d. C. s department of transportation says lit need to fix this coming year. Well do the 295, 395, 695 first and then well look at new york avenue massachusetts avenue and then start going into the side streets. Reporter ddot says the same men who plow your snow and repave your streets also fill your potholes. He says potholes form when water finds a way to get under the pavement and into the soil. When it freezes, it pushes the soil up at a weak spot and leaves an air pocket that creates a pothole when you drive over it. Ddot meets the 72hour goal about 70 of the time. Only 3 from southwest. But we found some potholes can linger unfixed for weeks or even months like these two on quebec place in northwest which records show went 272 days before getting patched last summer only to break back open a few months later. Theyre like vampires they never die, unless you put a stake in their heart. Reporter John Thompson with aaa mid atlantic says potholes can cause thousands in damage from broken rims to bad accidents. They try to swerve to avoid the pothole or hit the pothole and brake to try to avoid more damage and someone will rear end them. Reporter which is why ddot is trying something new, as they patch the holes with the oldfashioned a side by side comparison to see how well it holds up. Reporter his crews are marking the new blend with white paint so they can watch how well it weathers over the next few months because it costs three times as much as the old stuff. Even though its more expensive, if we dont have to come back out and maintain that thats a way for us reporter he says the reality is so cracked and marked only repaving them will get rid of the groundwater and permanently fix the problem. This treatment is more of a bandaid. Reporter which brings us back to that pothole on 14th street in northeast. Records show neighbors have waited at least 315 days to get it patched. Ddot told the iteam it waited so long because it determined it required more extensive road resurfaceing meaning the pothole that never goes away could be a sign of a smoother ride headed your way. Sometimes the dry air can eat up accumulation. Outside temperatures are all below freezing a possibility of one to maybe three inches of snow for northern most maryland and into the panhandle of West Virginia where the cold air will stay the longest. A coating to maybe an inch or so of snow down from washington metro south into parts of southern maryland. These are where the reports of sleet are coming in from now. Fredricksburg and stafford these light snow reaching the ground. Northern maryland reports from frederick where the snow is reaching the ground. Sleet pellets reported in the central parts of the shenandoah valley. Looks like our atmosphere is moistening up to the point where we can get all the precipitation down to the ground. Two people are hurt after a minivan lost control and plowed into a bus stop in kensington. Take a look here. The toyota obliterated the bus shelter in front of a safeway.
