Police say multiple employees were shot at excel, a lawn care company. The gunman was also an employee there. But he started his deadly rampage in other areas in other counties. Reports of gunshot victims came in one after the other until he finally made his way to his Law Enforcement confronted the shooter, gun fire was exchanged between Law Enforcement and the shooter. Reporter police say they killed the manman but not before he terrorized everyone in the surrounding area. All these people were just running in our yard and then i just hear gunshots, pow, pow, pow, so i went in, told the kids, you know, stay inside, stay away from the windows. My daughter worked second shift along with her boyfriend and my niece, they all work here immediately we grabbed everything that we had just to hurry up and get here and i called the rest of my family and theyre here just waiting, wondering what if everybodys okay. Again, police are now confirming for us tonight that four people have been killed including the gunman. An additional 14 were shot. Five of them are in Critical Condition. Investigators are in the process of trying to enter the gunmans a person there who will not let them in. The situation in kansas still developing at this hour. And breaking news here at home. Exclusive information just learned by news 4. Former Suffolk County police chief james burke is expected to plead guilty in Court Tomorrow to federal criminal charges. Chief investigator reporter is here now to break the story for us. Reporter were told james burke the former police chief expected to plead guilty to two counts tomorrow in federal court. Those counts, were told, a civil Rights Violations and obstruction of justice. All this relates to his arrest by fbi agents in connection with his alleged beating of a thief who was accused of breaking into stealing a duffel bag. A duffel bag that had sex toys, pornography and cigars inside and later while that suspect was in custody he was allegedly beaten and abused by the chief. The 51yearold former chief, again, apparently agreeing to a deal according to sources. Its a deal that could carry anywhere from 41 to 51 months behind bars. Thats about four years in prison. We are told as part of this deal he is not cooperating in the investigation against any possible other targets. Again, the nvestigators do want to know about burkes ties with several other officers inside the Suffolk County Police Department as well as any possible ties in the inside the d. A. s office. That investigation, we are told, ongoing, but so far no one else has been charged. A spokesman for the u. S. Attorneys office, the fbi, as well as burkes lawyer all declined to comment this evening. The office of Emergency Management says a crew was checking on a sewer line break on wood side avenue when the road collapsed. The crew got out of the truck safely. The sink hole is 20 feet long by 30 feet wide. Sewage is now pouring into the street. Luckily though, its a dead end road so traffic is not affected. Crews are working to stop the leak and repair the hole. And new tonight a parking garage brawl in harlem ended in gun fire. Several men were arguing inside the garage.
