Worcester police say as rivera held a machete which he grabbed from he threatened he would cut the other mans head off before he punched him in the face. All this taking place a block away from the high school and with riveras teen age children in his car. Before the confrontation police sayry survey and the other motorists were involved in a road rage incident. After court riveras wife and children wouldnt talk to us. His lawyer told us despite what the video shows the other driver was the real aggressor and rivera was acting in he was defending his kids and himself as best he could. Well see how it works out as far as the court goes as far as selfdefense. He was trying to protect himself and his family. Reporter riveras younger brother hector tells me the machete is used for fishing. Hector does not believe his brother was trying to hurt anyone. Its stupid what happened. Hell be fine. Right now but then you might be on the south shore and sure enough youve got heavy rain coming down in scituate as well as cohasset here. So where you have darker shades of orange and red thats where you have that very heavy downpour. The good thing about these showers is that theyre moving very fast. Theyre quick hitting but they could drop anywhere up to a tenth of an inch right now where we do have some storms develop we could see up to a quarter of an inch. But we havent seen that yet. A line of showers from hillsboro moving east southeast. Well expect to see that get closer to the coast shortly near 5 00. And now down in our area, along the mass pike in auburn we have a little shower right here. Thats going to be a quick disturbance if you are traveling along the mass pike. Also in stur badge. Even in the boston area be prepared. You may see another shower come through from 5 00 to six. Then the threat is going to push down across the southeast around 7 00 across the south shore, the cape and islands. Improvements north and west as the front has cleared the area. Jury selection in the Death Penalty retrial of convicted killer gary lee sampleson got underway today. Vanessa welsh joins us from the control room. The judge started off by explaining the case to the potential juror. Questionnaire that will help determine if they can serve on the trial. The most important question asked whether they would be willing to hand down a Death Penalty sentence to gary sampson. The only other option is life without patrol. The judge explained to dozens of potential jurors that will fill out that questionnaire tomorrow. The lawyer will review the questionnaire and toss out anyone who is not suitable to back for more in depth questioning on wednesday. Once that is complete lawyers will pick up the final panel of 12 jurors as well as the alternates. The judge believes the jury Selection Process should be wrapped up by end of next month. This is the second time a jury has been chosen to determine sampsons fate. He pleaded guilty in 2003 to carjacking and killing Phillip Mccluskey of taunton and Jonathan Rizzo of strangling Robert Whitney to death in New Hampshire. A judge tossed the sentence after he found one of the jurors lied. Massachusetts doesnt have the Death Penalty but because he was convicted of federal crimes Capital Punishment ace loud in this case. This was 27yearold Robby Mclaughlin in late june. The scar on his head visible. As fox 25 first reported in may the man was with wends at boston bar. There was an altercation. Bouncers were taking robby out when family believes someone attacked him from behind. Someone came in and was like reporter robbys brother says he next saw his brother on the ground blody and unconscious. I was basically like theres a good chance my brother is dead right now. And so, like, everything that came after that is, like, a miracle. Reporter after waking from the coma robby couldnt speak or walk but slowly motor skills returned. This is video of him involving rehab taking some of his first steps. In the last few weeks hes taken even more steps towards occasionally feeding himself and though limited he is talking again. Family says the criminal investigation into what happened to robby has stalled. They hope showing the real extent of his injuries will compel someone to come forward. Right now is our highest chance of seeing some as a cold front comes through. The chances decrease as we get past sunset right around 7 00. And then as we head through the overnight hours and tomorrow be are rain free. With showers developing were expecting to see locally heavy downpours. There is a possibility hearing some thunder, lightning possible. But also the risk of some strong wind gusts. We could see some of our trees as well as some of those branches that have been stressed from the recent drought that may creating isolated Power Outages with strong gusts of 40 to 50 miles an hour. We havent heard too much of damage reports right now. Really havent picked up too much rain as we did get one report in the boston area right at fenway park of course. Just over a tenth of an inch. We have that shower that pushed through. Water town and then pushed down through south boston and now down along the south shore. Scituate picking up just over about two tenths of an inch. That shower now off into the water. We have a few more showers out there up through New Hampshire. No lightning associated with these showers.
