police arrest an anne arundel county man... who they say was planning a mass shooting like the one in colorado. colorado.neil prescott was arrested friday... but as of this morning no charges have been filed. filed.tom rodgers is here with more on the reason why police have yet to charge prescott... along with today's other top stories. right now... prescott is hospitalized... undergoing psychiatric observation... and could be there for a week. police do not plan to charge him while he is being treated. treated.the 28-year-old was taken into custody early friday.investigators say he was on the brink of being fired... when he threatened to kill his boss and former co- workers at pitney bowes in prince george's county.they say he was planning to do a mass shooting... similar to the one in colorado. colonel 00:59 during a field interview with their officers... the individual was wearing a t-shirt that said 'guns don't kill people... i do.'" said 'guns don't kill was wearing a t-shirt that officers... the individual field interview with their officers... the individual was wearing a t-shirt that said 'guns don't kill people... i do.'" chief 00:15 in fact he said i'm a joker, and i'm gonna load my guns and blow everyone up 20 police say prescott had the means to carry out his threats. they found more than 20 guns... including assault rifles and handgunss.. and thousands of rounds of ammunition inside prescott's apartment. 3 in just about two hours... the man accused of killing 12 people at a colorado movie theater.. will be formally charged.this after new information is released on his mental state ábeforeá the shoot. shooting.a court document released friday showed james holmes was a patient of psychiatrist lynne fenton. the information was revealed in a request from the 24-year-old suspect that investigators hand over a package he sent to doctor fenton on grounds it was a protected communication. the paakage was seized during a search last week. a former denver prosecutor agrees with holmes' request saying it does fall under doctor-patient confidentiality... but a psychologist disagrees. ((when a patient states a clear and imminent danger to a specific person, then we have an obligation to either warn that person, warn family members, and also the authorities. )) ))a judge will also hear arguments over holmes' request today.there will be no cameras allowed in the courtroom.as for the survivors of the massacre... ten remained hospitalized sunday ... including four in critical condition. more funeral and memorial services were held this weekend for the victims of the colorado movie theater shooting. among them... alex tevee friends and family members gathered at a phoenix church saturday to remember the 24-year-old.he had just graduated last month with a master's degree in counseling psychology from the university of denver.a memorial service was also held in springfield ohio for matt mcquinn.the 27 year old died shielding his girlfriend from the gunfire. construction begins downtown today for the grand prix of baltimore. a forklift will place the track's ceremonial jersey barrier at mckeldin square at 11 o'clock today. indycar series driver josef newgarren will also be on hand to talk about what it's like to race through charm city at 175 miles per hour.the grand prix of baltimore races into town labor day weekend. a 20-foot sinkhole on monument street... east of patterson park avenue... is continuing to cause big problems for busin. businesses.several businesses have been forced to shut down... while crews work on repairing the road.the city department of public works thinks the hole was caused by damage to a brick storm drainage tunnel... that runs under the street and carries rainwater to the inner harbor. monument street between wolfe street and patterson park avenue will remain closed for at least part of the next month. an eight- year- old boy is recovering this morning... after his nearly lifeless body was pulled from a maryland swimming pool over the weekend. weekend.things were back to normal sunday at the waugh chapel swim club in gambrills... where just the day before the eight year old boy was rescued áunconsciousá from the bottom of the pool. it could have been a different ending... if not for a fast- acting lifeguard and some new legislation requiring a defibrillator be on site at all of anne arundel county's 2- hundred-75 public pools. amy davis, witness: 1.38.25 "i was glad there were other people around, because it was just a very scary moment, and i'm was that glad they had the aed to help save his life." life."the defibrillator at waugh chapel was donated by the connor cares foundation.a family friend says the little boy is already back to laughing and talking and playing video games. 3 3 forget all those people lining up for a shot at fame on american idol... one talent dogs. hundreds of dogs lined up in san diego sunday for a shot at fame.it was all part of an open casting call for "dog-tv." the new television network launched in san diego in february. and now they're casting three talented pooches to be featured on the channel.so what does it take to be a contender for the job? mos says: "it's great it you can get a dog who can at least focus...it's hard if they are distracted by other dogs...or (covered with video)...if they want to work in the tv...movie or photography business...if they can stay focused it's always really help" helpful." the three winners will be notified today. a baby boom on the highway. highway.two boys are born on the road... how it happened átwiceá in one day. day.plus... a tropical feel right here in baltimore... but this band is doing much more than just playing music.meet the incredible kids behind the drums next in our hometown hotspot. you're watching fox 45 good day baltimore.
