A family in mourning tonight outraged over the death of a brother who was killed when he was hit by an nypd van. Yeah, for the first time we are seeing video of the accident. Eyewitness News Reporter rob nelson has the details. Rob. Reporter good afternoon, liz. Three years ago at this intersection behind me a 61 yearold man was fatally struck by an nypd police van. Well, three years later what this has turned into is the city saying it did nothing wrong and the family saying they simply will continue to fight for some justice. Its this video that shows the moment 61yearold felix coss was simply crossing the street near broadway and hooper street in williamsburg back in july 2013 when he was struck and killed by a Police Officer driving this nypd van. Of way and was well within the crosswalk. Felixs still grieving brother spoke to Eyewitness News today from cleveland. My poor brother still had good years in front of him and, you know, thats gone. Thats gone. Reporter whats made matters worse is that nearly three years after the deadly accident the family is still wrapped in a legal battle with the city which has cleared the vans driver of any wrongdoing. In fact, according to legal papers, the city puts the blame on the victim, saying, quote, plaintiff failed to use all required proper appropriate and reasonable Safety Devices and or equipment and failed to take all proper, appropriate and reasonable steps to assure his or her or their safety, end quote. According to the city of new york, if youre crossing in a crosswalk with a walk light in your favor, that you are assuming the risk of being hit by a car and if you are hit by a car, you are at fault for its almost like, you know, okay, theres a dead dog in the street. Lets push him over, lets let the trash people pick him up and throw him in the dump and lets move on. Reporter the familys lawyer says there are eyewitness accounts that the officer was using her cell phone at the time of the accident. Levine says the citys lack of action flies in the face of mayor de blasios Vision Zero Initiative to improve pedestrian safety. The police got a free pass here when they killed the man, not even so much as a violation was issued, yet mayor de blasio is on tv talking about vision zero every day, how hes an advocate for pedestrian safety. Reporter meantime, ivan coss continues to mourn the loss of his brother, who was a beloved spanish teacher. He was a good citizen. He was a good man and they are treating us like dirt. Reporter now, the city, meantime, though, is arguing there was some piece of equipment in that van that blocked the officers view and thats what caused her not to they also say she was not actively using a cell phone at the time. Cherry blossoms around the tidal basins in washington, d. C. Are close to peak bloom. It happens when 70 of the blossoms are open. 3000 cherry trees were given as a gift to the u. S. From japan back in 1912. The annual festival celebrating the trees begins saturday. Had to kick that off early. Is that right . Yeah, yeah. Im not surprised. It is supposed to be april 30th. Im already seeing some blooms coming up now. So im wondering what they are going to do with that and then Branch Brook Park in new jersey one of the largest displays, april 9th. We will see if it waits until then. Thats probably better timing. So beautiful. Thank you, mother nature. I know. How long will this warm weather last this evening . You have today. I think a lot of people are expecting it to be warm tomorrow. You will need the coat again tomorrow and bounce back a little on friday, back into the mid and upper 60s and the weekend looks great. Outside we go right now, beautiful sunshine, a nice mild air mass and looks great out there and even some of the trees, if you look at the tree tops you can almost see the buds starting to swell just a little bit. So you can walk slowly, no stiff, cold wind, dont need a heavy coat this afternoon, going to feel great, spring jacket tonight, 69 degrees, mostly sunny skies right now and westerly wind at seven. I dont see any more snow threats through the remainder of march. Early april can still get cold the suit of many el nio winters are lighter snowfall although 1998 a little bit above average for march. Look back and four out of the last six march snowfalls have been below norm. Last year incredible with over 18 1 2 inches of snow and this year couldnt break an inch in march. Numbers are comfortable. Catskills cooler and on the east end. Right now our temperatures are generally in the upper 60s and lower 70s but if you look here albany at 44, the winds shift to northeast. Back door cool front trying to settle down the Hudson Valley right now. The evening looks great. The cooler air isnt happening until later tonight. When that does happen our numbers will fall. Start out tomorrow morning and still mild for a march morning but with the easterly wind all day long and limited sun, low clouds may come in and be tough to break and may brighten up at times. I think we are only going to reach the middle 50s in new york city, even lower north and east of new york city and maybe we can get into the 60s to around even 70 across interior so a huge range tomorrow. Heres what it looks like on the futurecast. Not too bad early on tomorrow morning. Might be sun. Overall the low clouds are spreading in from the northeast. They really come in and only be a place like a somerville or fleming ton, cranberry, these are the areas here over central and southern new jersey that can go 65 to 70. Otherwise most of us stuck in the 50s, even some upper 40s on the east end in connecticut because of the cooler wind. We will remain dry but it will be cloudy and noticeably cooler. Air quality is going to be moderate tomorrow. The uv index goes down to a moderate four, could even be less. Pollen count not so high. Look at friday and the numbers coming back. The only concern on friday is we are confident that the day starts damp but there is a trend here where the showers are really sluggish to move offshore. At the very least i think clouds will linger into the early afternoon. Im hoping for some late day brightening and drying so the best part of the day would be late but have your umbrella at least for the first part of the day. The weekend looking awesome. High up and Easter Sunday looks dry just clouds mixing in and temperatures will be in the upper 50s, i think rain is waiting until early next week. That could be a decent rainstorm on monday, fall by windy conditions on tuesday. Thats the way its shaping up right now. Step back, coats are back tomorrow and it will be milder again on friday. Thank you, lee. To heres whats trending on this wednesday, and demonstrations of support for the victims of the belgium terrorist attacks continue to trend.
