Thank you very much chair cohen we have before us the ordinance that will establish the transportation to demand management part of Sustainability Program part 3 of that and it is part a new way how to build our buildings in San Francisco that align with the new version how we measure the cars and San Francisco going from towards vehicle miles traveled from level of service were looking how to shift places where people live and work from how they view transportation towards transit walking and cyclist and Public Transportation this is a huge effort that has been going on for many years that planning is involved in and geared towards having Better Health outcomes for how we do construction to increase the quality of our air and healthy lifetimes by lowering the amount of miles that vehicles travel that lowers the emissions that has the greatest impact towards climatic change that measure i believe will take more than todays hearing to snuff out i expect im introducing a series of hearing it will happen i dont believe what ive heard from colleagues and from others departments that were not going to be able to pass this measure enemy after im out of office i believe this concept that is here before us today is a sound one but i dont believe im familiar with it towards the passage this year im saying this at the beginning of any talking points this is the temperature if colleagues today is our first chance to get into the legislative process with the discussion of transportation to demand management that will be heavy on presentation from sfmta and the transportation and planning to talk about where we at and how we get this measure and people from the public that might have additions or amendments to make as legislation i have amendments id like to make and have ready here today that i have ask the committee to accept after Public Comment but essentially recognizing there are differences between projects that are in the health and Human Services and for projects that should have a different kind of consideration in terms of so moved. Good afternoon emery rogers Planning Department staff and take a moment to announce the collaboration between the resources led to a very Forward Thinking Program and like to express my sincere appreciation to the teams San Francisco Neighborhood Services Safety Committee the Transportation Authority and our own Planning Department for their years of dedication and hard work weve made progress as an aide with the transportation Sustainability Program the cf p is invest and align and shift two of the 3 are adopted the invest and align those two programs together exchange and reduce the ceqa process for a fee towards the actual transportation improvements and now today, youll hear about shift the third component tdm seeks or the transportation to demand Management Program seeks to minimize car share in the new investment and support choices by the residents San Francisco is a national and International Leader in policies and procedures in this is a key step in growing smart with that, id like to introduce any colleague. Im carli and from sfmta and joined by corey teague from planning we are honored to represent really terrific Multi Agency Team from the Planning Department and the Transportation Authority and present to you for your consideration a proposed transportation to demand management ordinance new development San Francisco is growing and file number cant add additional capacity for more automobiles to our roadway and even if we could that would be counter to our transit first policy and health and safety and other goals what that means we need to invest and extending the transportation to demand management choices and use your support to help people to choose sustainability modes the good news that the city is already had a right at work to expand the Transportation System to entrance Transportation Management demand and plan for the next generation of transportation and the city is undertaking were asking others to approve the Transportation System and shape new trips before you today is the third component of this transportation Sustainability Program as you may know the t s p keeps people males or females and a as the city grows as ann marie said were now here with the third component shift a change in how new development shapes this to reduce the need to drive the shift component links the first two components like supporting people in transit and walking and biking and reducing the vehicle millions traveled within the component measured. Shift proposes an amendment to create a transportation to demand management ordinance focused on new investmedevelopme so development tdm is physical measures and information and resources that supports sustainable trips those are you are measures that are controlled by the Property Owner and are focused on the trips of residents tenants and visitor to the sites tdm for development is not new to San Francisco we have a number of measures in the planning code like unbundling parking for residential use requiring bike parking and things like that but to have the power of transportation to demand management we need to do better our proposal has been informed by best practices for development focused tdm across the country like having a Holistic Program that really focused on a goal our goal is about reducing virginia General Assembly vehicle miles and linking to how much parking is provided onsite there is constitutional data that has stereotyping is the most powerful denominator of how people traffic and monitoring to insure the requirement and remaining nimble and update flexible the primary goal is Transportation Mobility but additional benefits from better environmental outcomes and approved Public Health department r Public Health and transportation to demand management measures get integrated into frontages from the beginning with transparency in a consistent manner instead of more ad hoc ways we have today but tdm ordinance that is part of the board outreach that has been done for the overall transportation Sustainability Program and for the weve done targeted outreach and the input weve received from the commission and shareholders and developers and others has been reflective and informed our proposal so im going to im going to turn it over to corey teague from planning to walk you through the details of the ordinance. Corey teague with the Planning Department great to be here were also excited about this program working hard together on it im going to talk about how it will work how individual projects will be subject to and used in the tdm program the first is the structure of program it is unique in the sense the item before you is an ordinance that amended the planning code to create the tdm program and the requirements and create that structure within the code, however, there are 3 odd Important Documents that are very important to the program the first are the tdm standards which are adopted by the Planning Commission 2, 3, 4 august of this year the appendix is includes the tdm measures in details they may use in the tomato plan and a tdm clarification documents as carli mentioned a data driven program so we wanted to have a document that really put in writing all the data we use and these methodology that we use to develop the system she mentioned that tdm is a very dynamic field we using proven measures to the tdm standards are able to be updated more nimbly to reflect the Current Research from the projects within our own city or the nation at large so the ordinance would specifically state the tdm projects creates more dwelling units an inclusion for one hundred Affordable Housing and the new construction of nonresidential and Office Buildings or retail for example, changes of use within the existing buildings that will be a higher bar that will apply to projects that are more than 25 thousand square feet in size and changing between the categories weve established in the program so i think a theme we want this program to be something that Developers Think about early on they think about how to incorporate many projects and theyll be required to submit a tdm application that will be reviewed announce with the application the overall application as part of a code compliant like any other code compliant the Planning Commission then theyll be a tdm requirement needed. So how specifically will the program work for projects well in principle each project receives a number of points to achieve and have a memo of options to achieve that number of points but specifically the starting point is determining the to death and it is intensifying based how much parking the project proposed the more parking the higher the target then how to meet the target the standards the listing of all the measures in the memo some of the measures for example, bike parking level a the amount and scales up there additional points if you count scaling of certain measures in total 56 measures for a project to select all of those measures are based on research and data in the field and they are assigned point values bans in their value for example, things they chuch one point and showers and lockers and other additional bike things they may achieve 2, 3, 4 or points and more specific like transit subsidies and reduced parking overall those receive higher point values. And going to the parking issue the amount parking determines the to death but, achieve the points by parking at or below the neighborhood rate the map you see here is the city broken down into the transportation analysis zone somewhat like we use those zones for transportation analysis in the city we have a model that use certain amounts of real data well touch on later to talk about the neighborhood parking in each the zones for residential and nonresidential uses again, if you park at our neighborhood rate you achieve a rate and 10 percent reduction you get an additional point so Something Else that is existing about the program for a long time we were be talking about that at one point we had an x sell tool that was functional but not pretty people can use thats on our website but developed a user Friendly Online tool it is in data not for the public but using it with the stakeholder meetings to help people to understand how to use the program and how that works for the project i was going to show that stool to give you anguish idea unfortunately, because it is data and sometimes our technology dont align it didnt appear to look quite as nice and a as we see it ill not show you the tool today but another time were proud of it and it is incredibly user friendly and point and click with a measure and point and click all kinds of information and the measures you may be selecting. So once the project determines its the fact of the matter and selects a measure that wants to use to achieve the target score and the project is approved another part were excited about is a vigorous implementation strategy most of requirements in the planning code dont have a proactive monitoring and recording were a complaint based department when it comes to that, however, the city has approved budgeted staff in the department to work on the monitoring and the reporting requirements for the program so essentially before the certificate of occupancy for a project Planning Department staff will do a site visit to make sure the physical measures are in place whether the correct number of Parking Spaces, etc. Make sure that p is in line he and ones the certificate of occupancy is issued that department is to submit a report the Planning Department to document how their meeting the requirement for the tdm plan that reporting is annual for 5 years and if they have no cliensz issues for 5 years this moves from annual to every 5 years the key weve be much more proactive to make sure those measures stay in place for the life of the project additionally this will allow us to do some of our own do not collection and research so help to determine how effective measures are in San Francisco that different projects are selected. And so thats an important element to keep in mind is that not only do we plan to monitor the projects for 0 staying within compliance of the team plan we also want to make sure that the program itself is staying updated so we do plan to update the standards over time tom reflect new research and Information Available that is a primary research in San Francisco and also research that is done around the country that may indicate new measures that are proven to be effective or determine that some of the measures have the wrong point value up and down and clarify some of the language and for the measures to be clear we want to make sure that the program is effective so overall goal here additionally every 4 years we will be doing an analysis and report of the program that is timeline is in line with the county wide transportation timeline as carli mentioned we did a lot of outreach and one by one with individuals and individual groups one thing we can say almost every single group or person was supportive of the Program Overall and the policies, of course, some people have ordinances about some of the specifics and weve been working with them on that issue by and large we received a huge amount of support for that project and all of the commissioners recommended approval unanimously and we have a long list of groups here and others too that are supportive but as mentioned one of the wanted the program to go further. So what were some of the stakeholders input we received we heard they dont want to be disproportionateal and maybe ride shares should be permitted as tdm measures can there be exemptions for more than Affordable Housing we took all of those in and looked at it specifically the planning case report if august 4th we gave detailed responses to many of those issues through some weve worked on and to that point we passed out a memo that outlined some of the central changes that occur to the program the first one is Parking Spaces is not on the memo we addressed that at Planning Commission in august there was concern that poem would parking garages we feel want to acknowledge that issue we changed the standards to acquire some or all the Parking Spaces to be counted towards the issued and 09 issues were working hard since the Planning Commission and outlined in the memo that we gave you that memo specifically for the facing plan to go to the end the memo reflects a plan that is under consideration that we worked on with the Mayors Office and talked to different supervisors about supervisor avalos with his legislation has a date feasibility method but the phasing plan will allow the Development Application by september 4th of this year that is when the board of supervisors received the Planning Commission recommendation they only have to meet 50 percent of their to death and projects that file between september 4th of this year and the end of new year 2015 will meet only 20 percent and filed in january and on theyll be subject to the full one hundred to death we mentioned we want this program to be something that developers consider early on and factor into their performa and recognize the projects some difficulty there to be part of the racial behind this plan and heard that there would be adjustment made to make sure that wasnt disproportionately bad for Small Projects and found that we capped the the fact of the matter minimum of 13 points that distanced the smaller projects like 10 to 20 or thirty units to reduce the parking more we we have proposing to amend the project to allow for lower the fact of the matter for low amounts of parking and talked about the original raised and the maps that was adopted by the Planning Commission used a fiscal analysis as i mentioned since then weve been conducting a more data driven approach using the zoning data from dbi to determine how many Parking Spaces on the sites we have a sample size if this is not complete we feel comfortable to use that increased the parking rate and most in not all the transportation thats an overview how the Program Works that concludes my presentation. Good afternoon tilly chang director the county Transportation Authority i want to echo and join with the Planning Department and the public to urge your consideration the legislation has accommodation of many years of collaboration between the agencies that benefits the Planning Department one of the things in recognizing director graham now sarah jones and others as you may know for folks watching from home that is the final 3 car Sustainability Program designed to better link Land Use Committee u land use and shaping San Francisco as low impact for traffic and carbon by pga this legislation the city will effectively reduce the impact of development on the Transportation System but more importantly sdooishgs of the project and does so by providing sponsors a choice of features that have been shown to encourage walking and biking and sharing the benefits cannot be overstated as the interagency know weve been tracking the policies and this transportation to demand management measure is clearly most effective and Cost Effective to have reduction this far and practical and fair and approvals the citys Monitoring Program and location of the program bringing research and performance to the work and keeping you and the public regularly informed by the effectiveness i urge youre supporting and like to thank supervisor avalos for your leadership and all of you for your support over the years thank you. Teague if you can explain when is a project didnt meet the tdm standard whats the option to get kick in at this point and if there is a real abstinence but to insure the compliance. As proposed the meeting our tdm planned requirement is simply a requirement to have it approved as drafted we dont have you know an option for exceptions or variances but the menu is diverse and it gives project sponsors especially incorporating that and thinking it early in their project a lot of opportunity to mix and match measures to meet the requirements so of the requirements are measures you know physical capita envelopes reducing parking or providing for biking parking or car share some have no impact other than the space to the project and are simply cost for measures that provide for example, subsidies for transit passes or car share memberships or bike share memberships we feel flexibility to work with the tools and the Program Early on to find a tdm plan that is achieveable. Now having a project sponsor that is signed off on a tdm plan and go out theyre not living up to the plan what happens. At this point it is a standard compliance and enforcement issue like any for the planning code if we go out and inspection for example, before the certificate of occupancy and theres some component physical component of the tdm plan not correct that needs to be corrected brother theyll get in their certificate of occupancy if you go longer in year two or three and theyre not providing some type of incentive or measure theyre required to do theyll have an opportunity to correct that and if they dont then well go through a standard violation enforcement process which will be a notice of violation opportunity for a an appeal as well as one thing to add is in our current most of our planning code is complaint based and we will be actively monitoring and have standardized recording forms and so not happen to find out theyre not in compliances it is more proactive totally proactive while were youre going relying on the standard enforcement to process found o found outing. If i may through the chair youll sustain this regiment with would ongoing source of revenue. Were we budgeted staff there are application fees associated with the Development Thought and approval for the tdm plan on the front when you submit your annual reports there are a fee with the application as well additionally, there are many projects from the past that have been required to reduce the tdm planning and there are conditions of approval that needs to be monitored so we have look at it and dedicated those applications fees and staff time and requirement will, in the code to conduct the monitoring. So the fees that accompany the annual submission of reports are sufficient enough to actively may for the number of ftes you need. Thats my understanding. How large with the fees. The annual fee as proposed now right now is one thousand dollars. And thats in the future presumably born by the homeowners association. Were the owners of the property and that will be part of covenants and restrictions that theyll be required to put in their cc rs. I cant speak to what theyre to put in their cc rs but a notice of special restrictions recorded on the site indicated thats the adopted tdm plan and theyre to provide the tdm measures for the life of the project. Good afternoon, supervisors my name is kathy im the project sponsor at walk sf for the laced year livable city has been working with the city and thank you to the staff for step forward in the congestion reduction we specialist the preach of the tdm but seeking 4 amendments we think are crucial to make the ordinance month effective and robust to that we have 4 amendments and with those amendments the ordinance will have the full support of walk sf and the livable city first all parking with nonaccessory should be subject to the systematically we know the parking generates other trips and second the tdm goals should be linked to neighborhood transportation goals it adds new projects to manage but this means that congested neighborhood will be unacceptablely accepted trip reductions must be based on the goals rather than a rate derived if past projects and third walk sf buildings the options should encourage the walking and have more points currently only would the memo item that encourages pedestrian amenity and worst one point an unacceptable amendment to encourage the developers to encourage walking and finally, the ordinance should eliminate the minimum parking requirements if parking adds trips why do we have it and have an ordinance that as developers we should let the developers not have the parking in the first place we hope youll consider on the job amendments. A followup question what will you see as options that encourage greater walking. So weve given items to staff so more the research now for walking okay. Let me start over the research that tdm team used to determine what logo into the menu not a lot of research that walking amenity to vehicle reduction and vehicle miles traveled it theres a lot of research that shows what stops people from walking so it is sort of a lot of research that shows what we could put in place that encourages walking we like to see the menu include those items we have that and can share that. Im interested in examples. I want to see what that will be certainly our staff fee funds amenity for supporting walking and generally across the city but now a project within the project itself. Ill tell you in general lighting and landscaping and other heavy hiters calling those out specifically and more points was an example of something weve suggested earlier. Im sam duke kind of an activist for the thirty years ive lived in the city ive with the paratransit corporation with the we were not concerned but happy to see that Going Forward there was mentioned about Public Transportation the buildings that theyve put up on market have eliminated bus stops and eliminated sidewalks and have eliminated all kinds of things im hoping that the program were putting forward will see to that that the Developers Take into consideration the drop off spaces in for taxis vans that deliver food to seniors they should be take into consideration in doing sidewalks and streets in front of all the buildings the Third Mission project to say the museum and the eventual Millennium Tower Builders Building going up they were had legal suits brought against them they especially\eventually have any consideration for those kinds of things that are so vital we need vans and things to get to places they should be made more available to us thank you. Good afternoon, supervisors dementia with the San Francisco Human Services network outreaching im here to echo the introductory comments around the exemption for Human Services nonprofits and those are city fund disadvantaged populations this will be complimentary to the ordinance more Affordable Housing tdm will impose onerous new requirements that dont generate vehicle miles traveled that is minimal benefits to the community we are once again seem to be dragged into a program that where were not the problem Human Services nonprofits in San Francisco by and large are neighborhood based and serve clients that live in the neighborhood and we have data that shows that clients are 3r5u789 low income and the department of transportation has studies showing that households in poverty are lower in their vehicle usage and vehicle ownership and also have higher rates of alternative months of transportation walking and carpool, etc. So were not generating traveling at the same time the program will impose transit fees on charitable organizations and a that serves the poor this is inappropriate and this body rejected a year ago fees on nonprofits in the k s p that imposes annual monitoring fees an nonprofits often with grants to reduce the burden on the citys burden to disadvantaged cries and didnt make sense at all one way or another give grants to organizations to serve people that are low income and on the other hand, take the ongoing funds for fees that means that you need more money to the city to provide overseeing services and many nonprofits just dont fit this office space model within the to the call of the chair Framework Part of nonprofits are city funded to provide services that require them to have Parking Spaces for Service Related vehicles if you provide par trait and any shutters for people with disabilities or delivering food for people sick or low income those are the kinds of programs you may have a significant amount of vehicles you need to provide Parking Spaces those Parking Spaces should not be included in any of the things under tdm we believe that nonprofit Human Services nonprofits so be exempted from this program and particularly those that are at most some kind of there should be a clay on implementing it for those types of organizations take a look at the data and develop more flexible requirement more appropriate and require bike racks and things like that but not imposing vehicles with significant miles. I have a couple of questions you raised a distinct ideas what the number of organizations that were talking about or the number of Development Companies that are out there get into the specific inch i cant think of one to my mind can you help me out. I dont know exactly which programs i know there is a development down on van ness for health rates the goodwill has a development maybe programs it may be a small number which is great because that means that the city wont be giving up significant benefits by not impose it on the benefits but at the same time, we have a situation we have a huge problem with the nonprofits and the Mayors Office has alternatives and have prop x that requires replacement space so more nonprofit. It is not for all nonprofits but specific nonprofits in a specific inch market Human Services; right . Right. How many nonprofit in the city that kind of do the work you do. We dont know there hundreds but i believe somewhere around three hundred that are city fund. Will any have the capacity to take on the large projects. Theres been. Theres been im trying to understand a little bit better. Thats why the health right project on van ness is very large. Theyre a unique organization larger and robust not in jeopardy. Theyre not that big of a barrier ive seen in the last couple of years 75 hundred square feet plus but seeing that under the replacement we hope the replacements so that may happen more with the nonprofit displacement money coming out of the Mayors Office there are studies happening how we can do that more of building ownership rather than rentals that gives more stability to the program. Actively want to say that we agree with walk sf about trying to bump up the emphasis over Pedestrian Safety i mean things ultimately the most preliminary and primal way to get around by walking and Pedestrian Safety should be stronger nuftsd whatever point and agree and support Human Services network in their argument exemption maybe for city housing their targeting populations that are quite clearly nonpartisan attended and the staff as well as that is a good question supervisor cowen about the call of that exemption that is probably the kind of information that gives us an idea on Affordable Housing but organizations that are actually building stability or doing a significant rehab and not get caught that is is a logic and two other amendments were suggesting one specifically around Affordable Housing onsite there is data we can work with staff that shows the keeper the affordability the lower the overflow room and miles traveled our suggestion to have a findings that talks about those sort of deepening benefit by affordability and recommended to that within the program have the points reflect that more nuance and onsite people the more points and the second thing the process he letting the developers selection entirely the neighborhoods to have the knowing not the most benefit we think that should be built into the ordinance as a step of the requirement. Next speaker and and good afternoon, supervisors shawn id like to thank the staff weve met two or three times and agree with the spirit what theyre trying to accomplish and subject a more tailored approach rather than something that is a onesizefitsall approach our concern that smaller sites require a larger percentage of the footprint for the healthy whether 37 or 200 feet wide it generally has to stairs and two one lobby a transform room and accelerator that amount of space is a percentage on the smaller sites than larger sites the smaller sites have the room to play with how many 10 to 24 unit in our neighborhood over Valet Parking and car share and gymnasium. Most of those are out of reach for the smaurld sites our hoa board is a punishment not something we need to do but instead this adds a burden a member that sold the building tried to add a locker to the garage they couldnt in short we would like to participate but need a menu of options for the i offered in the 10 to 24 unit buildings this list is out of reach for our members thank you. Specifically the last comment. The last comment after that you can address whatever. I have questions after that walk sf proposed amendments great okay. Just to prior comment yeah, we looked at this for market value sites and recognized that you know really Small Projects are different than midrise and large projects ill say that i wouldnt describe this project as onesizefitsall i kind of see that as the opposite we can be as flexible and possible and include the measures that have evidence that work and some takes up space but a lot of items dont take space whether transit subsidies or whether it is you know bike share or car share membership and certain measures measures you can do like realtime transit display not a lot of Square Footage on the ground that is flexibility when you look at the flexibility of the measures and the fact that Small Projects have a low the fact of the matter to beginning www a lower amount of parking theyre providing and especially, when we the proposal we commute today to reduce the this gives for incentive for the projects san jose reduce 12 Parking Spaces to achieve a lower the fact of the matter and opens up space for additional bike space it is flexible enough to accommodate the smaller projects as well as large projects if you want to ask around the nonrestricted accessory parking brought up by walk sf that included this as with the tdm an exemption for projects that are not seriousy parking. It is important to separate this into two separate issues just for the jargon when we say accessory parking under the code to be dedicated to a specific lowell high scho; right . This is a parking space the tdm program doesnt apply to the stand alone parking garages this is the sole purpose of the use you know if someone was proposing to build a parking garages who will they give the subsidies to why put a realtime display. Did you have a conversation with walk sf. We had the conversation with stakeholders over time this is one situation that in happen often the other issue weve acknowledged when you have a project being built like a highrise and have a certain amount of parking and request additional parking not accessory and technical it is supposed to function as a parking garage but when in the real world are they using it as a de facto and would this perhaps something to achieve a lower the fact of the matter we felt was an land use and enforcement issue we acknowledged if you have a project that is you you know mixed use project theyre proposing to build a parking garage into this project that we would require any of the parking garages spaces up to the amount that is permitted for accessory parking to count taurd our the fact of the matter again, we dont feel this is a tdm issue as much as land use issue but wanted to aid that loophole and trying to discourage people from using that. And a discussion about traffic reduction goals question neighborhood and this legislation addresses that a huge differences in congestion and different parts of the city and are we drafting how do we account how we not to have a certain approach in a place of highlevel of congestion. Ill let any colleague at the department. Thats an interesting approach and a total different methodology this would you know we certainly can consider in the future it would potentially take at least another year or two years to develop all the data and work that through it is just not the approach we pursued and we wanted to build something that was enabled us to act now using the data we have now and the best practices and we can certainly consider that in the future but not we can act on in the near timeframe. The goal to be able to reduce vehicle miles traveled across town. Kroidz across the city. So last question is related to the health and Human Services exceptions that was talked about heres a couple of points i have is how prevalent with the exemptions need to be made and how can such exemptions be formulated. Thank you i mean this is a challenge that our department and other agencies in the city are working in terms of how to help a lot of our smaller nonprofits Services Agencies stay in the city and be able to operate i know were working on that on Different Levels its challenging within a metric that used land use we dont regulate land use based on ownership for profit or certain types of nonprofits in the city that is difficult to do that the southern here is that an exemption for nonprofit that will essentially be a forever if we consider a nonprofit this type of exemption for an office use therapy in their space for 5 years and had to leave no trigger to require that office space for the tdm use no change of use that is a concern not only for the program but other Planning Departments planning code controls how they may or may not impact the nonprofits we feel this structure by and large will rarely have impacts on the use because most of those services exactly for the reasons mentioned they dont have the capital or the funding to do new construction it is going into an existing space an existing building as proposed the change of use trigger for the tdm requirements anothers 25 thousand square feet and thats very large for those types of uses and if the use is that large theyll be having impact on the city and those types of uses the tdm measures are focusing on the employees if not more than the visitors and their trips to and from more 10 thousand square feet. Has there been an analysis avenue you know sounds like not been in terms of nonprofit and vehicle miles traveled and how much employees and nonprofits actually commute by cars. I dont know if we have done it by nonprofit but specific types of use when it comes to matters of land use and transportation where nonprofit are for profit it functions as a land use we researched the data k59 how a service use differs from for profit. And you mentioned is there a way for you know hearing from the Human Services nonprofits in the Community One of the hardships is the fee if theyre a change of use from a nonprofit to lets say a business that has more revenue to add additional cost is there an opt in for a way for an exemption to be created for i know the ongoing fee you said a thousand dollars a year. Thats the monitoring fee i understand you want to know a process as long as a nonprofit certain types of nonprofit they can apply and be eligible more than a fee reduction. Exactly. That would be constructed and anytime our fees are based the analysis of the staff time to do the work and anytime we reduce the fee we have to look at simplifier else. But on the end of your tdm plan one of the menu options and more importantly to provide transit benefits for workers and residents that is something that nonprofits actually, the Human Services and nonprofits dont get money for and every year we go through this budget process that talks about the cost doing business increasing every year but the actual grants that Human Services and nonprofits get is never large enough to meet with the cost of business is and other additional costs way beyond or a menu item i think Human Services and nonprofits wanted to be able to you know check off and do but not the resources for it so i think that there are constraint that you know where the menu didnt necessarily address the nonprofits have. I think the scenario youve described a description of every projects all the measures have a cost society with the them theyll been different for a variety of factors thats why we have so many miles an hour and the flexibility built in so for whatever reason our individual projects whether youre a nonprofit or Profit Service provider or a highrise developer you can take into account the constraint you have and select the measures that work best for you and those projects as mentioned they tend too often not have the parking and i understand youve not be able to measure who occupies the space there are differences dont believe are captured in this ordinance youve seen the hardship on more businesses or nonprofits that serve low income communities that dont have a larger profit for a menu of options with the greatest impact of reducing the miles traveled it doesnt have to be resolved yet but look forward in terms of modifying in the future to address this issue we have to have the greatest impact to have a greatest menu of options. I have an amendment as a whole i want to request the compete accept and one of them includes grandfathering in of listing project im open to a different level one that is im open to what the Planning Department has put forwards in terms of grandfather in. Thats good to hear whats a thats what i was going to propose as i ask you accept the amendment as a whole ill explain in a second and later you can amend it. Heres the amendment i have first on page 6 lines adding a word for vehicle miles traveled that demonstrates how the tdm more Affordable Housing is excellent on the level of affordability later we can look at those finding can be addressed how we can have a different approach for you know tenant opted out buildings that dont have a lot of office and the next one on package 9 the clues the tdm draft be presented any fee required for developers we have a chance for the public to a chance to weigh in on what is put forward for the measure the next allow the Planning Department to establish a phase in schedule for the tdm projects that have submitted the Development Applications before december 6th before the language provided by the Planning Department the fourth is page 12 addressing a clerical issue an amendment that shows that future reports on the tdm program are present to the board and how theyre done so these are amendments to the whole i want to request. Thank you very much i dont know colleagues if there is any discussion id like to go forward and give a couple of remarks first of all, xhoimentsdz to the Planning Department and others based on the presentation it is clear and quantify a lot of work and thought into making this policy thoughtful and inclusive i know that is not hes a difficult job my compliments to you members here in the chamber and in the office not here on the presentation teem i know a lot of people made this possible and recognize the folks that came in for pub the comments i heard were thoughtful and hope theyll continue to be part of this discussion and we hammer out the tweaks for this important populate that includes the developers that are stand to be impacted by the some of the proposals so a couple of things first, i want to supervisor avalos has we have a little bit of a difference the grandfathering clause and i think he indicated ill be amenable to what ill suggest my suggestion is from the Planning Department in a memo for ill read into the record lets see table for Development Projects that the Development Application on or before september 4, 2016, should be subject to 50 percent of the teetering for developments applications on or after september 57 and green befo201r the Development Application on or after 2018 should be subject to 100 percent of the the fact of the matter and 3 with a Development Application on or before september 4, 2016, should be subject to 50 percent of the the fact of the matter for development with a Development Application or other than after september 5, 2015, and before 2018 should be subject to 75 percent of the the fact of the matter and after january 2018 should be subject to 100 percthf the matter. You want to read that. I want to read into the record well be r be making amendment to the small section of what scombhoolz is proposing and if we can take that without objection colleagues without objection that item passes thank you, thank you this is a substantial and more and dense discussion weve had here today and id like to take a week to continue to work on this and continue to do our Due Diligence with the stakeholders is if we could madam clerk what in one weeks time whats the date for invocation. So i grew up on a farm in air force base we picked the foods open the trees and share with other families and as i drive around San Francisco i see any trees with apples or mrumdz and lemon trees i can see the food going to waste and brought that idea back to the Department Many of the trees where the fruit would go to waste we origin or crop and pick other fruits and delivery this to food banks or shelters to people who need them. Well, we could is a generalic satisfaction but something about giving food away its giving something i brought that in and sort it and gave it to you its primitive to be able to give something some basically to someone else. We have the capability of producing this food and in San Francisco you can grow food all year round so the idea were capable of prougdz food in our own backyards were here to demonstrate an bans of food and i think that giving it away for free we show individuals it in have to be a comedy. We build time together and its the strength of any ideas of the connections well turn that connection and the more connections you make no mistake about it the more you can have a stronger power and not have to rely on money thats the people power. We are definitely honored and humbled and thank you to be here this is a humbling experience we never thought that would be a huge impact weve had the shop for 5 years with the challenges it was accepted with focus on the latter obviously but what made us strong number one finding the local brands and supporting the local brands in San Francisco or the bayview the jacket im wearing the bow tie and i shirt are available at the shop the other things we have a lot of the products that is quality creativity manship and affordable prides in addition one thing we want to focus on yes. The business transaction makes us keep the lights on and the inventories but the human transaction that kept us going we wanted to make sure we know emily murase whether our name or if youre vooifrt we found that important to getting to know our customers and b know about that point of view and a couple of things being at the shop for 5 years has propelled us in the neighborhood but have involved in the community i along with others helps with the fillmore association and like to help to build the community and bring history and richness a son and daughter of filipino emigrates we are involved in the corridor in the soma we want to use this as a platform to continue to bring good products but to make an impact within the community you know we are an anchor on the block and want to be pill oversees in other neighbors in San Francisco and lastly you know seeing everybody here coming together is just the beginning and keeping the vision of the shop and dine in the 49 is the progress and working together will be the success so lets definitely make the shop and dine in the 49 shop out and small and support local and thank you to the vendors helping us out the fillmore Merchants Association, the designers and the peter from blue featured artists we are showcasing and brianna and other delicious that are loma have stuff here and other shops will be opening next to us we have lob i didnt launch and not only in the neighborhood we like to spread our wings in the sunset is donating their coffee you can make everything work within range and within reason with that, thank you for being here.
