And well begin this morning with a move that was widely expected in the federal election interference case against former president donald trump. In a filing yesterday lawyers for trump officially asked the judge overseeing the trial, tanya shut kn, to recuse herself. They wrote this, judge chutkan has in connection with other cases suggested former President Trump should be prosecuted inimprisoned. Such statements made before this case began and without due process are inherently disqualifying. Although judge chutkan may intend to give trump a fair trial and may believe she can do so her public statements taint these proceedings. Judge chutkan has a reputation for handing down the toughest penalties on the january 6th rioters. The past statements referenced by trumps lawyers came during Sentencing Hearings for two of those insurrectionists. At one hearing she said this, quote, the people who mobbed the capitol were there in fealty to one man. Its a Blind Loyalty to one person who, by the way, remains free to this day. At the other she told a convicted rioter the people who exhorted you and encouraged you to fight have not been charged. Now the former president has repeatedly accused chutkan of being a, quote, trump hating judge. His attorneys are asking that the court clerk randomly assign the case to another judge. Although judge chutkan herself was randomly assigned to it just last month. In response to trump teams filing she is giving prosecutors three days to file any opposition. Ultimately judge chutkan herself is the only person who will rule on the motion for recusal. And in another court filing yesterday trumps attorneys asked a judge to throw out many of the criminal charges against him in that sprawling Georgia Election interference case. Trumps lawyers filed several motions that Piggyback Off of arguments already put forth by some of his 18 codefendants. This push to dismiss trumps Fulton County charges come as the former president s legal team has indicated that he might try to move the case to Federal Court. Now, his former chief of staff, mark meadows, filed an Emergency Motion asking a judge to pause an order denying his attempt to remove his criminal case to Federal Court. Its a lot to keep track of. This comes just days after the judge rejected his bid to move the Georgia Election interference case to Federal Court, concluding that meadows, the former white house chief of staff, had not met his burden. Meadows claimed he was acting under the scope of his federal duties. Yesterday his lawyers raised concerns their client could be convicted and incarcerated before his appeal plays out. The judge presiding over the case gave prosecutors until noon today to respond. Meadows is one of at least five codefendants who filed motions to move the case to Federal Court. Joining us now here on set at 30 rock State Attorney for palm beach county, dave, aaronburg. Thank you for being here. Lets talk about trumps efforts first assuming the charges are not dropped. Do you think trump will go ahead with the request to move to Federal Court . And especially in light of meadows own bid being rejected, do you think trump would have a chance of success . No chance of success, jonathan. Meadows had the best chance of all of them because he was chief of staff trying to setup meetings, which could be grounds Interest Removal but he went too far. He was acting for the campaign not as chief of staff for the white house. Trump had no business making those calls. The president of the United States has no Business Dealing in State Election matters, so he has a zero percent chance of getting his case removed. And the fact meadows didnt get removed means all the other defendants just just stop trying. So judge chutkan is being asked to recuse herself in the federal case by trumps legal team. Give us your honest assessment here, taking into account her previous statements of which we just read, do the trump team have a point she should think about recusing herself . Do you think she will . No, theres a high burden to overcome to get a judge to recuse herself. Thats why jack smith is not getting judge cannon to recuse herself. Its really hard to do. You can tell by the first sentence of the motion where they refer to trump as president donald j. Trump, and throughout the motion they continue to refer to himself as president. So i think its a bit of a vanity play here. But the standard is high. I dont think he reaches that. Youve got to be able to have a reasonable question of impartiality of the judge. The fact she made statements about other defendants on january 6th isnt enough. In fact, she didnt mention on those statements. It was trumps lawyers who says shes referring to trump when she says he tried to intigate the election. With Friends Thalike that who needs inmaams . And theres a statement there about him remaining free. Thats factually correct. Correct. Tell us whats next here as you look at all these legal cases swirling around the former president. What are some of the sort of next key markers in the cases youll be looking for in the weeks ahead . I think the best case against trump from a prosecutors standpoint is the maralago Documents Case, but that one has been a slow rolling bit with judge cannon. Im waiting to see what happens with the garcia hearings. Those are hearings that determine whether conflict exists for the lawyers for the defendants. Remember trumps paid lawyers are defending multiple codefendants. One of them, taveras, the it director, went and left to a public defender and then he flipped because of that. If that were available to the other codefendants like nauta and deolive are you, they could flip as well. Then there are issues on protective orders. Theres not been a hearing on the Documents Case since midjuly, so i think that needs to get moving. I think a case that has a chance going to trial before the election is the d. C. Case with judge chutkan. That case is built for speed. So i think that one is going first. And the atlanta case is really good case against the 19 defendants, but its a complex rico case, and i think that one could get bogged down because of the sheer number of defendants and all the different counts. The case im watching, the d. C. Case, the new york case, but the strongest two cases, the Documents Case and the atlanta Fulton County case i think will probably go after the election. And with the federal election interference case built for speed that explains some of the stalling tactics trumps team is doing with tanya chutkan. Thank you for joining us this morning. Reporter over the weekend the Illusive Cavalcante somehow escaped that park, sneaking past 400 members of Law Enforcement, stealing this van, abandoning it, and vanishing once again. Authorities now say cavalcantes sister has been detained by Immigration Officials but would not say if shes helped her brother. She has failed to cooperate, and so there was no value in Law Enforcement keeping her here at this point. Reporter police are warning against anyone assisting him. We will prosecute you fully for those actions. Reporter franco rosa used to live with cavalcante. What was he like as a roommate . Super quiet guy, very shy. Wouldnt talk much. The House Of Representatives is set to return to capitol hill today with a very busy todo list. Congress only has 11 working days left to agree on a bill to fund the government and avoid a fullfledged shutdown. House speaker Kevin Mccarthy is now opposing a socalled plan b bill that would push the government funding deadline down the road saying hed rather, quote, get the work done. However, that selfimposed deadline puts mccarthy on a dangerous tightrope as he balances demands on the far right of his conference while trying to get a bill through that could pass the democratic controlled senate. Wont be easy. Some members of the House Freedom caucus are demanding that any bill includes language that restarts construction of a southern border wall as well as launches an Impeachment Inquiry into President Biden. You can imagine how that will go over in the upper chamber. Joining us now cofounder of Punch Bowl News, anna palmer. She is an msnbc contributor. Anna, lets start with the shutdown before we get to some breaking news from your outlet. Theres just 11 working days left here before the end of the month, and tall hills to climb to avoid a Government Shutdown. What do you see as the most likely path . People who youre take talking to on both sides of the aisle, do they think theyre going to be able to keep the lights on . Yeah, i think everybody weve talked to and weve been signaling this for quite a few weeks a shutdown is more likely than not at this point. When you look at the dynamics with the white house and the democratically controlled senate really on the same page with a lot of republicans in the senate Crossing Over to support the Funding Request when it comes to ukraine and other issues that are really nonstarters in the house, its a really hard to see exactly how theyre going to find their way out of it particularly now as you noted that mccarthy is saying that, you know, maybe we dont need the stop gap funding bill. Were not going to push this off until the middle of november. Lets figure it out. 11 days is a very short turn around. I mind expect some pingpong between the two chambers, certainly some messaging wars happening right now, but its going to be very tricky for mccarthy to figure out a way to fund the government that is something the white house and sept will back. And as we just mentioned this effort to fund the government has become very linked to this idea of opening up an Impeachment Inquiry into President Biden. And your colleagues at Punch Bowl News a few moments ago reported mccarthy plans to tell House Republicans in a closed door meeting this week that he would support watching an Impeachment Inquiry, that it would be, quote, The Next Step in a republican probe. Tell us why did mccarthy get to that decision . I think two things are really important on this story we broke this morning, one being that this is something that conservatives have been wanting to move forward on and i think a lot people its actually long overdue they actually start this official proceedings. The second thing is mccarthy is they want to get some of these bank records and other documents. They feel if they start an official inquiry this is something they can move forward with. The big problem here for mccarthy is just because it appeases certainly conservatives like a matt gaetz whos been pressing him for this, theres going to be some moderates in his conference who have said its not time yet or are going to be very concerned about doing an Impeachment Inquiry into an Election Year because lets just be really honest here, its not just going to be an inquiry. If they officially move forward on this, it is more likely than not the house will move to impeach president joe biden. Certainly the democrats and the white house dont want that, but they also feel like it could be a political winner for them in some ways, pointing out to other president s have seen their poll numbers go up when impeached, they think this could backfire on republicans. Anna, lets talk about the votes. Where does that stand . You rightly raise the idea republicans who won in biden districts, theyre not going to be eager to support this it would seem. Can mccarthy get this done . That remains to be seen. Its the first step were reporting this week, hes going to support moving into going into an official Impeachment Inquiry. This is something republicans have been moving towards for the past several months. And The Next Step is going to be the question of this big hurdle. Do they have the votes . Can they convince people like republican ken buck and others who have been skeptical it is time to move in this direction, and i think you have a number of moderate republicans, again, he only has that fiveseat majority. Theres not going to be a single democrat who helps him out on this obviously, so this is going to be a republicanled effort. This is obviously the first and significant decision by mccarthy to go down this route. Well follow this story all morning long. K. , which makes the job a little more difficult, then, for the Bank Of England who may be looking to hike Interest Rates because inflation is still too high, john. Certainly a growing consensus november seems more likely for a possible hike than september. So the European Union is revising its forecast for Economic Growth both this year and next. Whats it predicting . Yeah, so its actually just said specifically that one, europes biggest economy, germany, is about to slip into a recession this year and Consumer Demand has suffered on the back of those higher Interest Rates weve actually just been speaking about so the European Commission really forecasting a dire situation for europe. Euro zone gdp set to expand 0. 8 in 2023 and 1. 3 next year, 2024. Thats down from the 1. 1 that was anticipated for this year and the 1. 6 that was anticipated for 2024. So theres weakness in domestic demand meaning that consumers not taking in as much anymore because those Interest Rates have eaten up quite a lot of the money that was in either savings or in peoples bank accounts. So lets talk about this meeting, what it means, what it reflects about putin, but how valuable would it be for his military were they able to get their hands on north koreas weapons stockpile . Russia needs weapons badly. North korea is a supplier of fairly reliable weapons, so this would be an important way for russia as it moves towards next year i think were increasingly in the u. S. And everywhere of the expectation this war will go in 2024. Russia needs weapons, north korea is a place they can get them. In a way, john, this is a meeting of two outcast regime. The fact russia can only in a sense turn to north korea for this kind of open Weapons Support illustrates Vladimir Putins isolation. For kim jongun its another chance to be on the world stage, something he likes. Hell be the center of attention. I worry that north korea craving attention will do other provocative destabilizing things in the coming months, more Missile Tests certainly, perhaps another nuclear test to underline their partnership against the u. S. , against the west. The country that could stop this is china, north koreas neighbor. The u. S. Is leaning on china, urged china to make north korea step back from this direction of Weapons Supplier without success. I think the chinese increasingly seem to want to have it both ways. They dont want to supply russia themselves, but theyre comfortable with north korea doing this. And there are increasingly reports chinese Front Companies are allowing chips, other hitech materials that are needed for modern weapons to get into russia despite their promise to u. S. Diplomats they wont actually directly sell weapons. So were in a moment where the bottom line is think about how to have supplies of weapons to continue this war in the next year. Ukraine is doing that. Thats why the clip from Mitch Mcconnell at the beginning of the segment is important. That says there is bipartisan support for continuing our efforts to help our ally, ukraine. But thats were heading, unfortunately into another year of this terrible war. As we head into that next year, david, give us your Brief Assessment as to the state of the ukrainian Counter Offensive right now. You have slow progress a little more of late . You get halfway to the goal in each increment, but you never get there. The key, john, is whether in the next several months omgot about two left before weather makes this ground impassable. Ukraine can get far enough south it doesnt actually reach the sea or the black sea but it can get far enough south it can range with its artillery and Missile Forces the Supply Routes that allow russia to supply crimea and its forces in kherson. That would be a big deal. That would really begin to squeeze russia and give ukraine the kind of leverage that youd hope youd get from this Counter Offensive from the beginning. The Counter Offensive has been getting more ability to pressure russia into negotiations. And well have to see, but they seem to be Making Progress South towards the sea of asoff in particular, cutting that if you have in your mind a map of ukraine, cutting that land bridge that connects russian held territories in the east with those in the west. And lastly, david, lets talk President Biden just returned from asia, spent time in vietnam and before that the g20 in loom. The president himself said he wasnt looking to curb chinas growth there, although that was seen as more of a reassuring message to other asian nations who dont want to see conflict between beijing and washington. What do you think The Next Steps are in the relationships between china and the u. S. , particularly now with beijing casting doubt as to whether president xi will meet with President Biden later this year . So, from the beginning of the Biden Administration, the central pillar of their Foreign Policy has been to expand the number of countries that are partners and allies. The trip to the g20 hosted by indian Prime Minister modi was an example of that. Sometimes this involves holding your nose with allies and partners who you wouldnt choose as your best friends, like saudi arabia, which was at the g20 summit. But in a machiavellian way, the Biden Administration decided, we want these countries on our side. Vietnam, which was the next trip for President Biden, next stop, is a classic example of that. Vietnam is a country with which we have this enormous history. It was an important moment, i think, for reconciliation between the two countries. Also, again, its a little bit of holding your nose. Vietnam is not a Strong Partner in terms of any definition of human rights, but it is valuable as the u. S. Seeks a series of buffers. Think of japan, south korea, the philippines, vietnam, australia. All these countries that, in a sense, can take pressure off the direct confrontation between the u. S. And china. Thats the way in which President Biden met. Were not trying to contain china, were trying to get these friends to do the containing for us. Insightful stuff, as always. House speaker Kevin Mccarthy says theyve gathered enough evidence to launch a few inquiry, which he is expected to endorse later this week. However, Ranking Member of the oversight committee, congressman jamie raskin, is describing the gopled probe as a, quote, total bust. That comment was in a 14page memo that outlines the democrats case to defend the president. Sources tell nbc news that raskin has held several Strategy Sessions with other democrats so far this year. Republicans claim biden used his power as Vice President to help further his son, hunters, foreign Business Dealings. They have yet to provide real evidence of that. Its going to be a lot of what we heard on this air, actually, if you read through raskins 14page memo. If you Pay Attention to this stuff, its stuff we hear over and over again. They feel there is no evidence after investigation after investigation that House Republicans that launched, that its a distraction from the, in their eyes, crimes of donald trump, and an attempt to muddy the waters for voters ahead of the 2024 election, right . This is something that they have been thinking and talking about for a very long time. Even before the midterms, you and i worked on stories about how democrats and the white house were going to engage in this. Because we knew from the very beginning the house, the Impeachment Inquiry and Impeachment Vote was likely going to happen on joe biden. The time will tell if that ever actually comes to fruition, but democrats are kind of, for the first time if you talk to a lot of them, trying to get ahead of the ball and play offense instead of defense here. Congressman matt gaetz, a critic of mccarthys, expected to deliver a speech in the house as they come back into session, really going after mccarthy again. Seems linked, to me, that mccarthy is looking like he wants to push forth on this impeachment, in part, to placate those on the far right who are mad at him for the spending deals. What is mccarthys plan, eugene . How is he going to be able to get the votes he needs to put this forward . He is walking a tight, tight line here, right . Because as folks remember, when he was eventually voted in as speaker of the house, theres this motion to vacate. It only takes one person to kind of get him out, try to get the ball moving to get him out of the job as house speaker. Over and over and over again, hes had to placate folks like matt gaetz for the things they want, this Impeachment Inquiry being one of them. At this point, it is unclear how he gets the votes. Youve seen over and over moderate republicans, folks who are on the front lines in some of these purple districts, purple states, concerned, outright against doing an Impeachment Inquiry. What mccarthy also said is he will only do this if he gets a full vote of the house, right . This is something nancy pelosi didnt have to do in the past. Whether or not he can actually get to 218 votes remains to be seen. Doesnt look great at this point, but he is trying to balance all of those things. I think what he really wants to do is give conservatives make conservatives feel he is hearing them and doing what they want and, oh, no, i was just stopped by the moderates. Eugene, briefly, give us a sense of how the white house is going to approach the impending Government Shutdown . It seems theyre really putting the ball in the bid ingbuilding you and saying, were not involved. But if the government shuts down, could be Economic Impact and, you know, some blame could be cast on the other side of pennsylvania avenue, too. Yeah, and its never good for anyone, right . Theres always this question about who is the winner or the loser in Government Shutdowns . Its no one, right . No one is the winner in the country, both sides of the aisle are losers. You are right, at this point, the administration and theyve done this over and over again on some of these bigger, more controversial issues, saying that it is on republicans and democrats in congress to figure out how to get this done. You heard karine jeanpierre, the press secretary, saying they have to do their constitutional duty on some of these issues. I dont think thats going to change. I think thats one of the ways they see it, as making sure theyre hands off in the blame game at the end of the day. So far, that approach has largely worked. We will stay oint.
