Tonight the reality of this crisis appears to be sinking in for one donald trump and his white house and the search for the offramp may be under way. It was a bad day on the let them eat cake front, and this was just last night. We were on the air on this broadcast when the president agreed to hold off on the state of the union until the union was up and running again. Well, today in the senate, there were two votes on competing plans to end this shutdown. One from trump, the other from the democrats, both of them failed, but the democrats plan notably gathered more yes votes than trumps six than trumps version. Six republican senators, forgive me. Alexander collins, gardner, isaacson, murkowski and romney crossed the aisle to support the democrats proposal. That kind of thing can get the majority leaders attention and indeed the vote appears to have jump started talks between mcconnell and schumer, republicans and democrats. While those talks were going on, trump appeared on camera to signal he could be open to some kind of a deal. Are you open to this idea of a temporary spending measure to reopen the government . Well, one of the ideas suggested is they open it, they pay sort of a prorated down payment for the wall, which i think people agree that you need. You need the wall. If Mitch Mcconnell and Chuck Schumer can come to some sort of agreement, will you support the results of the agreement . Depends on what the agreement is. If they come to a reasonable agreement, i would support it, yeah. Even if it doesnt have wall money or does it have to have wall money . Look, i have other alternatives if i have to. While people scramble to figure out what a prorated down payment is. Tonight our colleagues report that senator schumer has ruled out any funding for the wall, prorated or otherwise and Speaker Pelosi called a down payment notion, quote, unreasonable. Tomorrow democrats are expected to present a new Border Security package but that isnt a sure thing. With the shutdown nearing its sixth week, the Washington Post is reporting some frustrated republicans read Vice President pence and Mitch Mcconnell the riot act during a closeddoor meeting, telling him the shutdown needs to end soon. Emotions also spilled out on to the Senate Floor Today and this was rare. Please note this exchange between republican ted cruz and Democrat Michael bennet. The democrats are fond of using the phrase hostage taking. They are quite literally holding the men and women of the coast guard hostage because they want to win a political victory against the president. Their objective here is have the president back down and have not a single mile of border wall built. These crocodile tears that the senator from texas is crying for First Responders are too hard for me to take. Theyre too hard for me to take because when you when the senator from texas shut this government down in 2013, my state was flooded it was under water people were killed peoples houses were destroyed their Small Businesses were ruined forever how ludicrous it is that this government is shut down over a promise the president of the United States couldnt keep the Trump Administration is coming under fire, not just for the shutdown but what many see as an appalling and obvious lack of empathy for the hundreds of thousands of federal workers not being paid. And a failure to understand the real world impact of being furloughed, there was this today from white house economic adviser larry kudlow. As soon as this thing goes, the switch will be turned on, payments will be made, we will go back to normal. This is just a glitch. I dont think im out of touch. Im addressing the problem. Ive met with my individual staff members. And god bless them, theyre working for free. Theyre volunteering. How are they volunteering . How are workers who have been recalled without pay volunteering . Theyre coming to theyre showing up. Thats not volunteering if youre forced to work without pay if you dont show up you lose your job, sir. Thats not volunteering. Thats not what volunteering means. That do it because of their love for the country and the office of the presidency and presumably their allegiance to President Trump, but whatever, theyre doing it. Give them some credit. Then there are the comments from wilbur ross, the commerce secretary who has been called the king of bankruptcy in the Business World because of his record of buying broke companies and because of his great personal wealth. Ross was in the news not long ago for a pair of 600 velvet slippers he apparently customized, as one does, with the logo of the commerce department. Here is what wilbur ross said on Live Television on cnbc this morning. I feel sorry for the individuals that have hardship cases. 800,000 workers, if they never got their pay, which is not the case, they will eventually get it. Mr. Secretary there are some reports that some federal workers are going to homeless shelters to get food. Well, i know they are and i really dont quite understand why. Because as i mentioned before, the obligations that they would undertake, say borrowing from a bank or a credit union are in effect federally guaranteed. So the 30 days of pay that some people will be out, theres no real reason why they shouldnt be able to get a loan against it. This afternoon, the president was asked about his commerce secretarys remark and offered up this explanation. I havent heard the statement, but i do understand that perhaps he should have said it differently. Local people know who they are, where they go for groceries and everything else, and i think what wilbur was probably sighing to say is they will work along. They know the people. Theyve been dealing with them for years. They work along. The grocery store. I think thats probably what wilbur ross meant. Harkening back to the day of the corner grocery. Lets bridge in our leadoff pam. Tamara, White House Correspondent for npr. Tim obrien, executive editor of Bloomberg Opinion and author of trump nation the art of being the donald and nancy cook, White House Reporter for politico. So tamera, tell us about the effect of these test votes today. As we said earlier, there is nothing like walk watching figuratively republicans walk across the aisle to join democrats to get the attention of the majority leader, ergo the west wing as well. Right. These test votes were test votes they knew would fail, but the president had worked really hard to keep republicans in line. He had this meeting at the white house on wednesday with conservative leaders conservative Movement Types and had really pressed on them to get their people to call their senators to make sure that people stayed in lines, that senators stayed, you know, supported the president s position that they didnt stray. But then you get six republican senators voting for the democratic bill. What that says is not just that they voted to reopen the government, but they also voted to reopen the government without funding the wall. And that sent a big signal. The president tried to downplay in his remarks to reporters, but you cant downplay the fact that six members of his own party walked across the line. Nancy cook, i read your stuff. I know you have the best words. Can you put into words the pressure on donald trump right about now . Well, there is just a tremendous amount of pressure. The white house is really desperate for an exit strategy at this point. Polling has consistently shown that the majority of voters in numerous polls are holding the republicans and trump responsible, and we really saw trump do an unusual thing over the last 24 hours, he has backed down. He decided that he wasnt going to try to hold the state of the union next this coming tuesday at the house of representatives, as was planned, and then even today he admitted that or he said that he would accept a shortterm funding bill, potentially, if there was some wall money if it. That is a huge concession for him on two things and something he never normally does. Tim obrien, always a good word user and enthusiast. I want to talk to you about empathy and read you a portion of the Washington Post reporting. The words we just saw from secretary ross and larry kudlow today. The twin appearances underscored a tone deafness that has become more pronounced in the Trump Administration as the plight of approximately 800,000 federal workers worsens. Trump has made no appearances at area food banks or other gathering places for furloughed workers, nor has he used the bully pulpit of his office to highlight their basic struggles. What are we learning and seeing about donald trump that you learned and saw long ago in his reporting . Hes an affluent man born into wealth and he doesnt have an authentic connection to the struggles and needs of ordinary people. We awe that with puerto rico. It took the president a long time to get to a war zone. He didnt get out to california when the wildfires were burning and now hes shut down the government and the people who work for him are struggling and he doesnt have any real understanding or empathy with what that struggle involves. Its not just ross and kudlow, its members of his own family, lara trump, his daughterinlaw, just two nights ago said that this is just a little bit of a pain for the people who are going through this. Yes, they cant pay their rent. Yes, theyre struggling with their mortgages, but they have to understand that the president s trying. But all three of these individuals dont really have to work for a living. They have income coming in from things besides their jobs and they dont know what its like to suddenly be cut off from a job. And i think that beyond the lack of empathy, theres also a lack of strategic sophistication here. They have lost the messaging. Symbolically now, not only has trump said, as famously as he did in december, im willing to own the shutdown, hes also being painted publicly as somebody who doesnt care about the impact, human impact of the shutdown as well and thats going to live with him, i think, for a long time. Tamra, then there is the kind of ball game score keeping of all of this. Victory pelosi last night when donald trump agreed to hold off on the state of the union until after the union was up and running again. He commented on that today. Well run this and talk about it on the other side. Well, its really her choice. I mean, i would have done it in a different location, but i think that would be redisrespectful to the state of the union to pick some other place. I could have done it. I could have gone to a big auditorium and got 25,000 people in one day. What she said i thought was actually reasonable, well have the state of the union when the shutdown is over. When do you think thats going to be . That i cant tell you. Tamara, if you were a betting woman, who knows, you may be, do you think well be covering a state of the union next tuesday night . I dont think well be covering it tuesday night. At this point it would be really hard to get all those gears moving and in place even if they somehow find a way to reopen the government this weekend. Its sort of remarkable to see the president saying, well, you know, its Nancy Pelosis prerogative, just hours after he said im coming, you know, and tried to call her bluff and he said, no, youre not coming, and then he was like, oh, okay. But the reality is is he says that the that the state of the union, if youre delivering it in an arena somewhere is not going to be covered the same way as the state of the union if hes speaking from the well of the House Chamber. I think some people picture Dustin Hoffman showing up in the back of the House Chamber to try to get in. Hey, tim, what have we learned about how trump is adjusting to nancy pelosi, with whom he shares politics and a generation in america . Has he met his match that he didnt see coming . I think he has met his match. Trump has had a very interesting and strange history with women, attractive women or beautiful women so ive read. So youve read. He treats them almost like ornaments on his christmas tree. Then hes had strong minded women who have worked for him in his company or been the opposite side of the fence. They tend not to be women he is interested in romantically and he has varying levels of respect for them. I think in nancy pelosi he has authentic respect. I think we also have come to understand that he didnt didnt fully understand the full range of her powers until 15 minutes ago and has discovered the speaker of the house can prevent him coming into her house and offering a speech that she doesnt want him to give. A broad range of powers is right. Hey, nancy, when we will know that this starts to break . Well, i think that we are seeing both sides really take the heat, and for me one of the signs that people are starting to feel that heat is the fact that Mitch Mcconnell is coming off the sidelines. You know, he is starting to get a bit more involved. He put this, you know, message bill on the Senate Floor Today. He is starting to meet with schumer. He has been talking with trump and sort of back channelling with him throughout the shutdown, ive been told by my sources, but i think that many people at this point, given the lack of strategy coming out of the white house, think that the shutdown will end when a deal is cut between Mitch Mcconnell and Chuck Schumer and nancy pelosi, and thats when it will really be done. One day after backing out of testimony before a house committee, Michael Cohen was served a subpoena from the Senate Intelligence committee and its compelling him to return and clarify what lies he told during previous closeddoor testimony. Cohen had initially agreed to voluntarily testify, publicly, you may recall february 7th was the date circled in everybodys calender in front of the house committee. Just yesterday he pulled the plug on the president of the United States and his lawyer, rudolph giuliani, against his family. Heres some of what were talking about. His fatherinlaw is a very rich guy. I hear. His fatherinlaw, i thought, was the guy that was the primary focus. Well, what did he do . Did he make a deal to keep his fatherinlaw out . Did he make a deal to keep his wife, who supposedly maybe im wrong, but you can check it. Did he make a deal to keep his wife out of trouble. We are so distorting the system of justice just to get donald trump. So its okay to go after the fatherinlaw . Of course it is. If the fatherinlaw is a criminal. Cohens Legal Adviser is calling those comments criminal. This is classic mob technique to send a signal to the individual who mr. Trump has called a rat for telling the truth. Now, that word rat comes directly out of organized crime. Its also a signal to other inmates. But the family of Michael Cohen has been called out by donald trump. Once again he ducks or lies about what he knows hes done, which is to attack a fatherinlaw and a wife as a way of getting to mr. Cohen, and that is called witness tampering, obstruction of justice. Lanny davis did say that cohen will comply with the subpoena. Meanwhile, the president s former Campaign Manager due back in federal Court Tomorrow. A judge demanded Paul Manafort attend a hearing to address charges that he lied to the special counsel. Prosecutors will lay out exactly how manafort violated his plea deal. In a court filing yesterday, manaforts lawyers pushed back against the notion their client lied, insisting he had difficulty requiring the details of what occurred. Also developing tonight, and this is new, exclusive reporting about the president s soninlaw and concerns over foreign contacts he made during the campaign. Nbc news has learned, quote, Jared Kushners application for a top secret cleaner was rejected by two career White House Security specialists after an fbi background check raised concerns about potential foreign influence on him, but their supervisor overruled the recommendation and approved the clearance, two sources familiar with the matter told nbc news. According to this same report, kushner was one of at least 30 cases in which this executive kline overruled career Security Experts and approved a top secret clearance for Incoming Trump officials despite unfavorable information, the two sources said. Why would you back out of house temperatustimony knowing e dangling of a subpoena is always a threat to you . Well, i think what we have to take mike the cohen at his word, which is that he felt intimidated, right . That he felt that there was a threat to his family, and there is certainly a Public Record that, you know, creates a very Straight Line between what hes saying and how hes feeling. I want to distinguish that from the law. What i mean here is he obviously always had the ability to sort of say to the house, i really would prefer not to testify, and obviously mueller would prefer he not testify. Any prosecutor does not want their witness testifying before a different tribunal or a different venue because you dont want the creation of any potential, you know, ways in which that either signals what youre investigating. The house proceeding would have been very public. Yeah. Unlike the senate and the subpoena were seeing from the senate, which at least would be behind closed doors, but i think there is this overarching question of is how serious is this that the president of the United States, that the attorney representing the president of the United States, himself a former u. S. Attorney, are making statements about whether or not prosecutors should be paying attention to the fatherinlaw or the wife of Michael Cohen. And legally, legally thats a much harder case to prove witness tampering because you have because of the intent that you have to show. Anything that is obstruction of justice is hard. But its the president of the United States who himself has said essentially, im the prosecutor in chief. I am also going to nominate people to be attorney general who believe that my power is so plenary that i direct criminal prosecution. So we have the Legal Standard but we also have the politics and the what i would consider something that comes up to the line of abuse of power that has to be taken into account by congress. If Michael Cohen has lied previously to congressional committees or a committee, why tell the truth now . Look, theres nothing uncommon, unfortunately, about people who have done wrong figuring out that it serves them better to do right. So you may lie in the first instance and then figure out, oh, that is not a good idea. I will be better off if i start telling the truth. Thats essentially what Michael Cohen has said. Yes, i lied. I lied for reasons. Now i wish i hadnt lied. Now im going to tell the truth. Its absolutely legitimate and common in our system for those on the other side of that to say, but why believe that person . In this instance, the people saying dont believe Michael Cohen are also people themselves, donald trump in particular, who has a long list of statements he has made that are misrepresentations or factually inaccurate. Finally, what might we learn from or about Paul Manafort tomorrow that we dont already know . I dont know that were going to learn that much. Okay. I think that honestly this is important that what the federal judge is saying in this case is i want to see you. These are very serious allegations. Youre going to appear with your attorney he got permission i dont mean to cut you off. He got permission to wear a suit to Court Tomorrow even though there will be no pictures because its federal court, just sketches. Thats interesting. Interesting. But i think the reality is its a hearing. I dont know what we will learn. I think its impossible not to take very seriously what a special counsel in this case, robert mueller, said back in december, which is that they have evidence, evidence of conversations between manafort and the administration directly and indirectly after their plea agreement with him. I mean, after their plea agreement and Cooperation Agreement with Paul Manafort. Those are serious allegations. And if you put those together with allegations about what this administration has been doing around the mueller investigation, in totality, in totality there is the possibility that one day we might see a legitimate obstruction of justice fact pattern. Republican senators clashed with one another and confronted Vice President pence during a private luncheon on thursday as anger hit a boiling point over the longest Government Shutdown in history. This is your fault senator ron johnson told majority leader Mitch Mcconnell according to two republicans who attended the luncheon and are you suggesting im enjoying this . Spokesman for senator johnson said the senator was expresses frustration with the days proceedings in the senate, i. E. , two failed test votes. Were happy to have bill kristol, director of defending democracy together and editor at large of the bulwark. Thank you for coming in. Ill share our homework. We were talking about the pall over our country. I think depressing in two days. One, just the people suffering and hurting, the workers, the contractors. Three ways maybe. Secondly, a lot of people depend on just dealing with the federal government to get on with their businesses and their lives. If youre selling soy beans, you need agriculture inspector to show up to that theyre okay to be shipped abroad. You may not like the epa but you need the epa certificate before you can get it going. Lots of people are being at best inconvenienced, but really damaged by this. Even people that arent directly affected, just the sense this is ridiculous. 35 days without a quarter or a third of our government because of a fight over a totally phony fight about the ball. And the democrats, whatever you think of them, theyve passed legislation reopening the government and saying lets have this fight about the border. And trump is saying no. And amazingly, this is the core of it, i think, Mitch Mcconnell and the Senate Republicans for 35 days have stuck with donald trump. Not a single one of them deep down believes this is reasonable. They controlled congress for two years. They could have legislated it on one of those bills that takes only 51 votes not 60 votes. The Trump Administration chose not to make it a priority compared to tax cuts. Now theyre having a fight over phony issues. And i do think its about to snap for the Senate Republicans. I want to show you something along with our audience. This is a retired rear admiral in the coast guard. Said this today about how tightly stretched resources are. We got a call from a ship yesterday. They do very, very difficult laborintensive work, very, very physically demanding, and they were needing money to help replace their uniforms. I think the last time the military didnt have enough money for uniforms was probably in the civil war. As they say, the whole world is watching. Our coast guard cant get new uniforms. Their families are going to food banks. What are people to think . I was talking to somebody and happened to see a foreign diplomat in washington earlier this week. It was sort of bewilderment. Its one thing if youre in a horrible depression and you have to furlough workers and you cant pay them for two weeks or four weeks, this is an entirely selfinflicted wound. People think that donald trump isnt thinking ahead much but, again, i come back to the republican senators. I think the reports are the tip of the iceberg, the amount of unhappiness. Theyve walked down a road that goes nowhere in support of Mitch Mcconnell because hes led them down that road in support of donald trump. Maybe mcconnell felt he had to get to this vote today where they would underperform the democrats and that that would be the moment he could turn to trump and say, weve got to end this. I cant control my members anymore. Were going to reopen the government. If you veto it, mr. President , were going to override you. Is it really that courageous to say that . Its not such a big deal, right . Most of them are in for six years. Only 1 3 of them are up next time. Theyre not mostly going to lose. The fact that theyve been willing to go along with this, i actually do its ridiculous to be shocked at this point by the degree to which republicans on the hill have sort of gone on with foolish things that the president has proposed and has said and has that theyve rationalized things that the president has done. This one, they are really actively complicit in it. Its one thing not to criticize the president the way you should have after charlottesville or vote for a tax bill that is not great. Youre an antitax republican. This one, they could end it tomorrow. I do sort of agree with ron johnson when he said to Mitch Mcconnell, this is really on you, mitch. Do you think well be covering a state of the union next tuesday night . I think its not impossible. I think this really could schumer and mcconnell could come to a deal. They could get some Border Security money, not the wall, just tell the president were going to do this. Nancy pelosi can say, mr. President , if you sign this deal weve come to on monday, you can speak to the house tuesday. The president would love the idea of giving the state of the union. I think this is maybe a long shot. I think it could be coming to an end faster now than people think. Ive thought that for the last two weeks and ive been wrong. I just feel like the genuine humiliation of whats happening is i think beginning to get to republican senators who have swallowed a lot of humiliation over the last two years, but this is them. Coming up, the events set in motion after what took place in the Trump White House exactly two years ago today involving that man when we continue. Tinue. You know we love doing this. We love any item that begins with the words on this day. Well, on this day two years ago, Michael Flynn, President Trumps First National security adviser, was interviewed by the fbi. That interview precipitated what you might call a series of unfortunate events, eventually leading to the creation of the mueller investigation. So lets take a moment to look at the anatomy of an investigation. Heres what we know about why the fbi wanted to interview mike flynn in the first place. He came to our attention in the early part of january when there were statements made by the Vice President in public about interactions that flynn as the National Security adviser designee had had with the russians. The fbi had conducted the interview on the 24th. We got a readout from the fbi on the 25th. We placed a call to flynn said, hey, were sending a couple of guys over. Hope youll talk to them. He said sure. We believed that general flynn was compromised with respect to the russians. It was clear that he was lying, that he lied to two fbi agents on the 24th of january in the situation room in a conference room. We felt like it was critical that we get this information to the white house. The first thing we did was to explain to mr. Mcgahn that the underlying conduct that general flynn had engaged in was problematic in and of itself. You shared the justice departments concern about his communications with russia, his apparent dishonesty about those communications and his vulnerability to blackmail, is that correct . Thats right. And the russians also knew that general flynn had misled the Vice President and others. My white house counsel, don mcgahn, came back to me and did not sound like an emergency. This man has served for many years. Hes a general. Hes a in my opinion, a very good person. Of course Michael Flynn eventually pleaded guilty to lying to those fbi agents. He cooperated with the special counsels office. As of tonight, he continues to cooperate. He is awaiting sentencing, which has not yet been scheduled. Another break for us. Winston churchill lived to the age of 90. For those of us who love history, we are blessed to have so many great historians on this broadcast. There is something about these days were living in that has us looking to the leaders of our past and a new book has done just that. It is called churchill walking with destiny. I think most americans, even those of us who devour works of history think that at any given time he would have a measurable blood alcohol count. Its been all about trying to figure out a game plan for how to get through it. In the first week of january, i even made the backup of the backup plan of figuring out if i had to move out of my place, where would i go . I have a friend i can move in with which wouldnt be ideal because it would more than double my oneway commute when the government opens back up, but at least then i would still have a roof over my head if i had to do it. I try not to think about it too much because its completely overwhelming. My Bank Accounts empty. I mean, ive maxed out everything i can max out.
