Vivid and troubling picture of the cost of the ongoing shutdown. When was the last discussion about this trump tower deal . Because rudy got everybody really confused, i have to say. He goes on meet the press and says could have been through the election. Then he said he was talking in hypothetical terms. The reality is, it wasnt a deal. We dont know the developer. We dont know the site. We dont know the anything about it. Ultimately with Michael Cohen essentially trying to get a deal done, he was there for a long time, wasnt a deal guy. Didnt bring too many to the table. I dont think anyone took it all that seriously. So much to get to this hour. Right now, two big developments in the standoff that has shut down the federal government. Reports this hour that President Trump plans to give the state of the Union Address as scheduled, even though he was disinvited by Speaker Nancy Pelosi, citing, in part, security concerns related to the shutdown. That comes on the heals of a troubling new report just released which claims the shutdown is putting National Security in jeopardy. Well have those disturbing details in just a minute. First, lets go to the white house for more on the president and what appears to be an escalating battle with nancy pelosi. Geoff bennett is there. I understand you have some new reporting on this. What do we know about the president s plans . A Senior Administration official tell us President Trump is expected to deliver that state of the Union Address at the u. S. Capitol on tuesday, january 29. As you mentioned this entire thing was up in the air after House Speaker nancy pelosi wrote the president a letter requesting that he delay the delivery of the speech until after the shutdown ends or she said he could submit it in writing. That was a bit of a power play on pelosis part. In the letter, she cited security concerns, given that the secret service and the department of Homeland Security are currently unfunded as a result of this shutdown. Dhs and secret service said there was no security concern. A white house official says the secret service was able to protect President Trump when he made that unannounced visit to iraq after the holidays. Certainly they can keep him safe while delivering a speech at the capitol. The speech writers are preparing a speech that has different passages. Some of those passages lend themselves to the president delivering a speech in a different venue. Maybe not the capitol, maybe at a rally. Working to report that out, but the top wait, wait, wait, wait. He might give the state of Union Address at a rally . Well, it has to do with the white house always being prepared. Theyre preparing for a backup in case he is not able to, for whatever reason, deliver the speech at the capitol. But theyre operating with the expectation he will deliver the speech next tuesday at the u. S. Capitol as was previously scheduled. Okay, geoff bennett. I know youre continuing to work this story. I know youll get back to us if theres anything new. That move by the white house coming shortly after the release of a new report detailing fbi agents firsthand accounts of how the Government Shutdown impacts fbi operations. The Fbi Agents Association says, quote, the lack of funding caused by the Government Shutdown is undermining criminal counterterrorism and counterintelligence operations, delaying and complicating trafficking and exploitation investigations, harming cooperation with local law enforcement. Reducing informant cooperation and hindering a wide range of other efforts. The association adds the report shows agents basic operations needs are being compromised as a result of prohibitions against buying prepaid phone cards, booking air travel and even using official fbi vehicles because theres no funding for gas. The shut you is not only affecting agents work but providing, quote, examples of the personal hardships suffered by agents families as agents continue to work without pay. The fbis mission is, quote, to protect the American People and uphold the constitution of the United States. Agents do this by tackling these he lea heruclean priorities. And battling public corruption. You guys really didnt spare any words with this. What do agents in a nutshell want the American People to know about how this shutdown and obviously the lack of funding is affecting our National Security . Thanks for having me this afternoon. The membership of the Fbi Agents Association wants the public and our elected officials to know that we want the fbi to be fully funded so that our operations will continue at the pace they were before this shutdown and we want to have fbi employees, fbi agents and professional support employees compensated for their work. We cant do the job to our fullest extent if the government is not funding the fbi and our operations and the stress it puts on families is not helpful in any way for operations and families of fbi employees going forward. Lets talk about some realworld examples here. Just last week the fbi arrested a man who they say was plotting to use an antitank robert to storm the white house. Agents had been on this investigation since march. If youre doing that kind of investigation, if youre doing any kind of investigation, and you dont have the money, if you dont have a prepaid phone card if you cant use federal money to put gas in your car what does that mean . The fbi is an investigative body, obviously. Investigations take funds to fulfill all the necessary tools in that investigation. The fbi headquarters has done a difficult task for determining what amount of money is going to be used on what investigations. Its very difficult because they have one pot of money and nothings coming into it. But every day, our investigations cost money to opera operate. So as we move forward and we said this on january 10th. As we move forward, those investigations, theyre going to have to make some difficult decisions on what is funded and what cant be funded. Now here we are on the 22nd of january. Were saying that that has only gotten worse and will continue to get worse going forward. We want the fbi to be fully funded so we can do our operations to our fullest possible extent. The fbi agents become fbi agents and employees of the fbi join the fbi to protect the American People from enemies, both foreign and domestic, and that equates to thousands of investigations that fbi agents are doing across the United States on a daily basis. Its getting harder and harder to do those investigations because the money is not being replenished. I want to talk to you about morale. This is already a president who has repeatedly showed his disdain for many of the institutions that we have all come to depend on, including the fbi. Im not suggesting that any fbi agent would do anything to undermine our National Security. But can everyone do his or her job after the agency has been under attack and now they arent getting paid . I mean, just as human beings, whats it like now to be part of the fbi . The fbi and the Fbi Agents Association, were not involved in the politics of anything to do with this shutdown. We want our elected officials to come together and fund the fbi so we can do our operations and our employees, fbi agents, our members, can get compensated for the 50 hoursplus a week that theyre working. You mentioned investigations that are ongoing. Fbi agents were working investigations before the shutdown. We have been working these investigations during the shutdown. We will continue to best of our ability. As the funs get less and less, its going to be harder and harder to work these investigations. We want to fund the fbi so we can do our jobs and to the best of our ability, protect the American People. We will do that, funded or not, but we need to be funded. Theres the personal cost that you mentioned. Weve certainly had a lot of stories about whats been going on around the country as churches and other organizations have been setting up food banks for federal workers. I know you had a pretty emotional story about you and your wife delivering food to your own office. My wife is also an fbi agent. Shes a member of a neighborhood book club. And she put out an email asking for people to come help our employees. And we drove, yesterday, a car full, the whole back, filled with bags of food, given by good people who see that people in need, need to be taken care of. We delivered that food to a room which is full of food brought by others to help our employees. And people are taking that food. And they should be taking that food. Our support many employees, our newer agents. Fund the fbi and pay the employees for the work were doing every day. Im guessing you never thought youd see the day when you had to have a room for folks who need food who are working for the fbi. We thank you. Well, a white house spokesman basically told nbc there is no plan b. Is there a plan in place in case the senate vote fails . Thats hypothetical. What the president wants is clear. He wants an open government and a secure border. His plan does that. We hope they vote on it today but it looks like not until thursday. Just a short time ago in washington, Speaker Nancy Pelosi visited volunteers who have been handing out food and other basic supplies like toiletries, diapers, to furloughed workers who are now on track to miss a second paycheck if congress doesnt reach an agreement by midnight tonight. So, what is next . Joining me now, nbcs hans nicols who is live on capitol hill. So lets talk about this senate bill. This is the proposal. The president , saturday afternoon, he goes on national television. He lays everything out. Immediately, we know its a nonstarter. Not just, right, on the part of democrats, but also conservative republicans. Yet, what we hear from mcconnell is going through the motions. Making sure theres something in place if the two sides do Start Talking to one another. It seems like were a long ways from that. A truism in this whole debate is whenever you hear one side accuse the other side of being divided, regardless of whether or not that claim is true, thats an indication youre not going to have a lot of progress. We just heard Mitch Mcconnell saying pelosi and House Democrats are totally divided on this. Hes saying this is the only opportunity, the president s bill, the president s suggestion, is the one thats staring him in the face, and he sees an opportunity to act on that. But theyre so far apart right now. All we can really look is say this is a vehicle, an opportunity, but theres not a lot of positive sign theyre going to put anything into this vehicle and drive it across the finish line. Lets play a little bit of what he just said on the floor. The opportunity and all this is staring us right in the face. A vote on this legislation on the senate floor this week. All that needs to happen is for our democratic friends to agree that its time to put the country ahead of politics. Take yes for an answer. And vote to put this standoff behind us. To be clear, mr. President , the proposal outlined by President Trump that well consider here in the senate is the only proposal, the only one currently before us that can be signed by the president and immediately reopen the government. So many things to talk about there. First of all, democrats would argue, well what was staring you right in the face last week was for the senate to take up the bills that have passed the house. Having said that, theres also a new twist in this. It came from the Supreme Court. One of the things the president was offering, offering in this deal that he said he wanted to make to open the government involved daca and now the Supreme Court has arguably taken away whatever little leverage the president thought he might have had. Explain. Well, its still winding its way through the courts. What the Supreme Court did today is they declined to take and make a sort of quick decision on this. The threat of these daca kids not having their protections and being deported, thats still out there. But its much more theoretical now. A lot of the energy on this issue has dissipated since its been tied up in the court. As these cases continue to wend their way through the courts, yes, those daca kids would like some sort of clarity and finality. What this did is buy them more time. So trumps urgency on this, throwing the daca number at a threeyear reprieve out there, doesnt have a lot of valance now it has less, i should say because of what the Supreme Court did. A new report in the New York Times suggest what the administration sold as tough sanctions against the Russian Oligarch tied to both Vladimir Putin and President Trumps convicted former Campaign Chairman ordinarily so harsh after all, in fact, according to confidence documents, they freed Oleg Deripaska from hundreds of millions of dollars in debt. Lets look at Oleg Deripaska, once listed as the ninth richest man in the world. And the sanctions deal that the Treasury Department made with him. In the early 2010s, deripaska entered a business relationship with Paul Manafort who was working as a political operative in ukraine at the time. Four years later, the oligarch accused manafort of disappearing with almost 19 million. That was meant for investments. Manafort resurfaced in 2016, offering deripaska private briefings on the u. S. President ial campaign, according to the washington post, asking a former business associate how to use his new position as trump Campaign Chairman to settle up with the russian businessman. Last april, deripaska was one of seven oligarchs slapped with sanctions for, quote, malign activity around the globe. Part of fallout from a nerve agent attack in england. Three of his companies were also sanctioned. But the penalties were delayed by the Treasury Department. Treasury secretary steve ma nuchen conveyed a willingness to lift the sanctions if deripaskas ownership stake dropped below 50 . But according to documents, deripaska plans to transfer millions of shares in one of his companies to vtb. Thats a russian Stateowned Bank worth just shy of 800 million at the moscow exchanges close today. The shares would wipe away debt that the oligarch owed that bank. Joining me now, New York Times political reporter ken vogel. Did i get that right . At the heart of this, it seems, is what the administration laid out publicly is different than what they put in privately. The documents that you were able to see. Yes, thats right, chris, and to take a step back here, the motivation for the sanctions you laid out were to penalize deripaska but they were also part of an effort to clamp down on russia and Vladimir Putin and make things difficult for Vladimir Putin whose government is funded in large part by these oligarchs and who has close relationships, the kremlin does with many of these oligarchs who were sanctioned, including d deripas deripaska. The Treasury Department said they thought the sanctions were hurting, having sort of economic ripple effects, that were hurting companies in the United States as well as other companies that depended on aluminum, the main product of deripaskas companies. So they were seeking to minimize damage on these companies. While still having some penalties against deripaska and, to an extend, against russia. And the deal they worked out, they said publicly would accomplish those goals by forcing deripaska to reduce his ownership stake in the companies and to step away from the management of the companies. And they said deripaska wont derive any benefit from this because the shares hell be getting rid of, any proceed will go into a blocked account he cannot being an ses. What we found out in this document was some of the shares he was getting rid of went to entities with which he had close tied, not just vtb, but a foundation he shared and owned. Others ended up, already are, with family members, his exwife and her father. When you add up the amount of shares deripaska has which the treasury says is rightfully less than 50 , with the shares his family and allies have, its above 50 , its at 57 , and then you consider other shares are going to these close allies of kremlin, including vtb bank, and that leads to the conclusion that maybe its not quite so hard, this deal wasnt quite so hard on either deripaska or russia. Lets call it the friends and Family Discount or something. I dont know. House democrats obviously they thought this is not a good thing. They moved to block the sanctions relief. Got quite a bit widespread republican support. So whats the holdup here . Its on the senate side, right . The senate, even in the senate, democrats got 11 republican senators to come on board with them. They had a total of 57 votes for blocking treasurys move to lift these sanctions. Which if they had gotten 60 votes, which is the requirement under the provisions and the act under which these sanctions were levied, they would have blocked votes. You see, theres a majority in the u. S. Senate, an overwhelming majority in the house thatprobl. It is in some ways illustrative of the disconnect between the Trump Administration and the president in particular and his approach to russia, which has been much warmer, less confrontational, than the traditional u. S. Foreign policy approach. Even more so, the traditional republican work on dealing with russia which has been to take a hard line and to levy sanctions for things like the invasion, it is anexation of crimea and the election interference, which is a major factor. As you suggested in the intro, he is a bit player in the mueller investigation. So investigators are saying whats the rush to get rid of this, at least while the guy is a subject of interest in the investigation hanging over the Trump Administration . Why cant we wait to see what mueller comes back with . How or if it implicated deripaska or manna frts dealings with him in any way . You lay out pretty clearly critics see one of two things at play. Either the Trump Administration willingly let deripaska off easily or they were outmaneuvered. Could an argument be made for either . Yes, an argument could be made for either. In fact, theres also a third possibility which kind of plays into the question of whether they calved. Which is treasury may have inadvertently backed itself into a corner by announcing these sanctions before doing all the Due Diligence on what types of economic ripple effects we might see from these sanctions on u. S. Allies and on u. S. Companies. And once they realize after the sanctions were announced, hey, this was going to be a big deal, it would really roil global aluminum markets. They started to figure out, what can we do to get out of this pickle without looking really bad . Thats why you see without look like were caving to russia. Thats why you see this very complicated deal that they tried to pitch one way but which these documents show is a lot more complex and allows for a lot more ammunition for the argument that it wasnt quite so tough as they let on. Teachers in the nations second largest district are demanding smaller class sizes and better salaries. And here we are at a familiar place. Rudy giuliani walking back what he told the New York Times, that until the day trump won the election, he was still negotiating over a trump tower skyscraper in moscow, then making a bizarre reference to tapes. That is in an interview with the new yorker. Giulianis point was to push back on buzzfeeds reporting that trump directed former fixer cohen to lie to congress. Saying, quote, i have been through all the tapes. I have been through all the texts. I have been through all the emails. And i knew nonexisted. Showing an order from the president to lie. Wait, tapes . Big red flag for the interviewer, who then of course asked about those tapes. Well, giuliani responded, i shouldnt have said tapes. No tapes. Well, i have listened to tapes, but none of them concern this. Just a short time ago, a Senior Administration official told nbc news that giulianis comments are, quote, not helping. Saying, quote, if nothing good can come of it, dont do it. The president s son went on fox news, saying he has no idea. I dont talk about things i dont know about. Unfortunately, that sometimes happens. No different than anyone else. The reality is this wasnt a deal we dont know the developer. We dont know the site. We dont know anything about it. It wasnt a deal . Lets fact check that. Because then businessman trump tweeted about a potential project in 2013. Trump signed a letter of intent to pursue the deal in 2015, a letter obtained by cnn. And met with a developer for the project according to the wall street journal. Joining me now, federal prosecutor, former federal prosecutor Elliott Williams and nbc news legal analyst danny cevallos. Lets start with Rudy Giuliani. First he told chuck todd on meet the press that the trump tower talks went up until 2016. Then he said it was hypothetical. How does Something Like that fly with federal prosecutors . Not very well because its coin fli conflicting evidence and conflicting stories. New york magazine, not the new yorker, did an article today, raising the question of, is Rudy Giuliani a genius or idiot . Using those words, not mine. Is this a deliberate strategy to throw people off the scent of the investigation or is he just confused . Its almost shakespearean where like in king lear, the character of the fool is the genius in the whole play. And maybe he is. Who knows. But, you know, back to your question, how do federal prosecutors deal with this . Again this is an individual presenting himself as the lawyer for the president of the United States. Making conflicting statements. And not doing his client any good. Even if hes joking, as the new yorker article says at one point he is, lawyers know that words matter. And even jokes that are out there in the ether can come back to bite the president and bite the client. So he is not doing the president a Great Service here. Yes, either way, danny, it would seem to me, whether hes a genius or maybe one of the worst lawyers ever to go on television, neither way is he seeming to be helping his client. Thats right. And if there is a strategy, that is exactly the problem. The more rudy talks, the more he potentially reveals strategy, Attorney Client communications. Even work product. His mental impressions. Things he has come up with. That is information that he is only privy too. The problem is that Rudy Giuliani is a defense attorney, occupies a very unique position. Its not like being a mayor. When you speak for the people of the city. Its not like being a prosecutor when you speak for the government. Defense attorneys speak for their client. Often theyre the only voice for their client. And they combine their client, which is why generally speaking, Defense Attorneys should speak to the press sparingly. This is a case study in what happens when a defense attorney rambles on and rambles on what he was hired to do, apparently, he was hired to put the thats correct. Essentially hired to do pr, not to do law. Thats right, and thats the challenge, if hes serving that dual role as pr and defense attorney. He is speaking directly for his client. And potentially binding him. And when people do that, as anyone in pr would tell you, you must have a command of the facts. You should never rely solely on your client as a source of those facts. The other thing that continues to strike me about all of this, and this is just one example of it, elliott what we heard from donald trump, is that he tries to say there was no deal. When, in fact, there is documentation that they were working towards a deal. Theres plenty of testimony suggesting they were working on a deal. And then he makes it sound like he is not a key figure in what is a very tiny company. So he couldnt possibly know everything. I mean, im just trying to figure out what impact these different voices have when area trying to conduct an investigation. He also i believe in that same interview distanced himself from Michael Cohen. Saying he was this bit player who never did anything for the trump organization. Which we know is factually untrue. It is just a false statement that Michael Cohen did nothing for the trump organization. But, you know or the president of the United States. How do you sign a letter of intent and say there was never anything that was a deal . How do you tweet saying, thank you, theres going to be trump tower moscow . I mean yb , you know, we role o eyes but creating this massive evidentiary record that is going to be used in Court Documents or pleadings at some point because the president is on the record, verify organize disputing facts that are out there in the public discussion. And so i dont know how he does it, given forget what mueller has. Forget whats in the emails or whatever or the tapes. Lordy, i hope there are tapes. Forget all of that. We have seen the tweets and they confirm some of this information. It is puzzling juniors out there saying the things he is. What are those tapes and whats on them . If there are globalists in the world, theyre here in davos. They believe in more trade. But they acknowledge that globalism as it stands, and capitalism as it stands, arent working for everyone. So a real big theme here has been the rise of populism and nationalism, not just in the United States but around the world. That is obviously an idea the president identifies with very much, and people here not so much. Thats exactly right. So for instance, bill gates was just interviewed not very long ago, and someone, you know, talked about critics of the current capitalist world system and how it can be adjusted. His response was, well, if people like communism, they can try that. Thats the problem. They really are clear here that theres something wrong in the world. As for john kerry, hes gone from here. Its nighttime here. Most folks are off at private dinners. We havent caught up to him. If we do, well ask that question of him. What stephanie did do is caught up with a bunch of very important ceos who operate all around the world and got their take on whats going ones in the United States. I did, and overwhelmingly, i heard this disappointment with government that government leaders arent working together, that the shutdown is impacting business. Because heres the thing, if youre a ceo, even if you dont like w must be pragmatic, you must play ball. It is so foreign to them to watch a government truly in shut down. Take a listen to what i would say a wide range of i spoke to the former ceo of dow chemical, who was an informal adviser to President Trump, still a supporter. I spoke to ceo of marriott, whose business is down in washington 20 since the shutdown began, mostly because of all the museums closed. Tourists arent coming. I spoke to the president of microsoft, whos most concerned that while all these conversations are being had around artificial intelligence, cybersecurity, and the risks around them, the United States and our delegation doesnt have a seat at the table. Take a look. Were a little less welcoming in the United States or perceived to be a little less welcoming. We should be careful about that because travel to the United States is Economic Growth in the United States. Its jobs in the United States. And its positive perspective about the United States. Do you try in whatever capacity you can to impress this idea upon our government . Absolutely, yeah. Ive used exactly these words with the president. I think the world needs American Leadership. When we are thinking about problems like cybersecurity, for example, and nation state attacks on other countries, this is a problem that begs for American Leadership. Theres no way that a company can fill in a gap thats created by a government. I hope we will see more American Leadership as we look to the future. I am concerned. I think the world of multilateralism is disappearing, and were becoming nationalists and the United States is leading the charge. The worker and the people need a voice. The administration feels they have to be that voice. To putting a priority to the American Worker is what this is about for us. All right. So those were that was some of the sentiment going on here. One of the interesting things that happens is ox fam releases a report about how much money the richest people in the world have versus the bottom half. That number of rich people is now 26. 26 people control the same wealth as the bottom half of all humanity, 3. 5 billion people. I remember a couple years ago it was 80. Its getting smaller and smaller. So when you ask where is this unrest and this uprising coming from, its numbers like that. At least for the last six, seven, eight years in davos, a huge theme has been income inequality. Now as the number grows smaller, the amount of billionaires who have accumulated all that wealth and so many at the bottom are suffering, people are saying its time to do something. Were hearing some. I mean, microsoft has announced a 500 Million Investment in housing in the seattle area. Why . Because they finally recognize School Teachers and firefighters cant afford to live there. San francisco is a canary in the coal mine.
