Youre in luck i have the best team in the business here to break it down. I want to take you first to nbcs garret hake live on capitol hill. Is this testimony definitely going to happen . Were hearing, yes, no, its unclear . Its going to happen but there is an open question of when and exactly who gets to listen to it. It wasnt the committee who reached out to sessions to set this up for tuesday. It was Jeff Sessions who sent a letter to the Intelligence Committee, essentially inviting himself to testify. He sent the letter on saturday, he said he would like to come on tuesday. I think we have a portion of that letter here. Its instructive. He says in light of reports regarding mr. Comeys recent testimony before the Senate Select committee on intelligence its important that i have an opportunity to address these matters in the appropriate forum. And stephanie, its that appropriate forum thats a focus of this debate here because weve heard already, from a number of democrats on that committee, who very much want to hear sessions speak in an open setting. They dont want him to speak in a classified setting and essentially be able to address all these issues away from the public eye. But regardless, were already hearing senators on both parties start to line up some of what their questions might be. Weve had a lot of unnamed sources in the media come out and make statements about Jeff Sessions. It would be very good to get it directly from him. First, did he interfere with the Russian Investigation before he recused himself . Second, what safeguards are there now so he doesnt interfere . Theres been allegations publicly of meetings that go beyond the meetings that hes already declared he had with representatives of russian government. That will come up. I want to know is it true what comey said, did you create an atmosphere there that people believed you could not fairly render judgment on the president s interactions with comey . Reporter so the senate is in session later today. We expect to get a little more clarity on this as senators start to trickle back in from their weekend. All right. I want to bring my panel in now, john than swan, a National Political reporter for axy owes, matt walsh for the libertarian magazine reason and ron insana a cnbc contributor. Jeff sessions is going to be asked, obviously about jim comey and the meetings with russian officials. Due to the nature of these issues can he really testify publicly . I mean, its going to be a spectacle . It is. One thing i would just say is, you know, when i talk to sources at the doj their working assumption whether its a closed hearing or an open hearing, its effectively going to be an open hearing because theres likely to be leaks out of that hearing, so they will be working under the assumption whatever he says will likely leak out. Now, the interaction thats in question, particularly that comey mentioned in the closed setting, was that the Mayflower Hotel at a Campaign Event and regards intercepts that Russian Ambassador kislyak sent back intercepts apparently boasting about some of his interactions one with sessions. We dont know the substance of those, so we need to treat those claims with suspicion. What sessions wanted to avoid supposed to testify before appropriations committees where these people wouldnt have been briefed on the material. He wants to bring this to a head and wants the right people in the room. Is it a hornets nest . Matt, Jeff Sessions he recused himself from the russia probe because of his potential ties or the questions around it, but if you listen to james comeys testimony last week he makes it sound like things are problematic, is Jeff Sessions taking a gamble knowing that president is watching and he parses over every word knowing how important loyalty to the president is . Lets remember the reporting in the week running up to comeys testimony was that sessions stayed within the Trump Administration [ inaudible ] weakened, right. He was weakened coming up to it and then he was one of the people who came out worst with comeys testimony. Hes also theres a question a lot of senators want to get in there, where was he in the decision tree to fire james comey . If you recuse yourself from the russia investigation because of the taint, but you are part of the decision to fire somebody, where some of the reasoning was the Russian Investigation people will want to tease that out and he will want to bring those the apprentice version of those events as well. Is he there to save his name . We heard before the International TripJeff Sessions may have offered to even resign or is he there to represent the administration . I mean, President Trump is doubling down against james comey . Its probably a little of both i would imagine. Certainly the question in front of Jeff Sessions right now is about the reported third meeting with ambassador kislyak which is as yet undisclosed by Jeff Sessions. So he also runs the risk of perjuring himself in front of congress during his confirmation hearings and other conversations. He has to do both, balance that and im sure given the reporting weve seen he may be concerned about not only his job but where the administration goes with this set of investigations from here. Many people in the administration wish the president would stop talking about james comey, after all, it is Work Development week and the president doesnt seem to be talking about work force development. He continues to press about james comey. He didnt say anything during the testimony, though i would like to think those don jr. Tweet mace have been channeling the president , but hes had a lot to say since then. Peter alexander live at the white house to weigh in, what else has the president been saying . Stephanie, remember just a couple weeks ago sean spicer said the white house wasnt going to make comments about the russian probe. They would all be handled by the president s personal attorney. That may be true for white house aides but certainly the president himself has decided that hes going to say what he likes. The latest lashing out an outburst over the weekend back on twitter where he went after james comey. Throw that tweet and read along with me, believe that james comey leaks will be far more prevalent than anyone ever thought, totally illegal . Very cou cardly. Focusing on what comey testified last week telling as he described it telling the president back when the two of them spoke he would see what he could do regarding the effort by the president to ask if he could drop the flynn investigation. Of course the president denies that ever took place. Nonetheless republicans in washington have become increasingly frustrated. Lindsey graham among others saying to the president , you are your own worst enemy. Democrats have been pouncing on this, some of his critics suggesting there is significant sufficient evidence right now to try to open an obstruction of justice case. And speaking of obstruction of justice one way it put a lot of these to rest would be the release of the tapes that the president suggested may exist, secret recordings from here at the white house. The president said he will do it some time in the near future. Republicans, among others, are demanding he come clean. Heres susan collins. He should give a straight yes or no to the answer to the question of whether or not the tapes exist and he should voluntarily turn them over. The president and his attorneys, cory lewandowski, aggressively going after james comey the leaker. Didnt the white house leak to devin nunes . I think the white house is a very leaky environment and it goes right to the top, so i would put that there in that corner. One thing i would say to your point there is that its really only the most slavishly loyal surrogates and i would put Corey Lewandowski in that category who will go publicly and accuse james comey of perjury. A bigger problem for donald trump is high profiled republicans even when defending donald trump lending credence to comeys version of events an the excuse theyre putting out, paul ryan and chris christie, donald trump isnt very experienced in government. So you have a credibility problem there. Is that not an extraordinary offer from the president saying hes going to testify under oath. The last time we saw him do that he lied Something Like 32 times, matt. If he testifies under oath what he said at the press conference on friday he has a real chance of committing perjury. Its a flat denial that trump did and his son did a flat admission of that. If he testifies to that its comey against trump and as much as you might want to throw brick at james comey for whatever reason, i dont think many fairminded people will look at those two and say i think trump is the more honest of the two. And polls have shown that. Americans two to one believe the former fbi director comey is more trustworthy than President Trump and with respect to what he has said the president also said, even if i did do it, it wouldnt have been wrong and his son echoed something along those lines. Thats not true. If you direct an underling to end an investigation that becomes extremely problematic for a president as we know from past history, so theres a lot and the president as you said when suing tim obrien who wrote a book about him, unauthorized biography was caught in some 30 lies in the testimony that he shared. So this is a problematic area for a president who not only has gone through this, but is himself as we though, anybody who has worked in the Business News world knows that the president himself has leaked stories to many of us over time as a source close to donald trump says he being the source. Some of us have personal experience with this. The fact that hes calling out james comey as a leaker of nonclassified information, which is not a crime by the way, is at least at the very least ironic. I want to talk palace intrigue and the president stepping on his own narrative. Ron mentioned fairminded people. There are fairminded people inside the white house saying not again. Last week was infrastructure week. The president mentioned it, it seemed like not until thursday. Here we are Workforce Development week, his own daughter ivanka trump trying to talk about this morning and the president continues to press on this james comey issue and now its possibly out there that Reince Priebus job is in play if he doesnt clean the house up. What is the president doing . Whats the response inside the white house . Especially from those who are trying to focus on things like infrastructure and energy or Workforce Development . I actually think not a huge amount has changed inside the white house. My sense actually of the stuff internally is things are frozen in place, at least for the time being. There might be some incremental changes but doesnt seem to be appetite for a huge overhaul and the russia crisis has to some extent galvanized some people internally or at least given them other things to worry about. As for Donald Trumps tweeting this is something that theyre never going to be able to change. Theres a resignation that this is this sort of reality and its really linked to telesion, frankly. Like you talked about the testimony, donald trump sat in the dining room next to the oval office watching comey and was sort of, according to people who observed him, giving effectively Live Commentary as the testimony went on. Thats just the way he consumes information. Its from the television to his brain to his phone. And it seems to be that this little sequence is not something that anyone, whether its a family, relative, or someone who works for him, can break. David, i want to start with you. You are a donald trump supporter. Do you think its wise for him to testify under oath . It is probably not wise. Any kind of testimony under oath always presents a possibility of a perjury charge. From a legal perspective its not wise. From a political perspective it may be necessary. Its a tough call. Does it give you any doubt to stand behind the president , seeing that the president of the United States who you support, youre saying, hey, man, maybe its not a great idea to testify under oath . I would guess the American People would think that president they elected tells the truth . Its not a question of truth. Let me point out, theres been a lot of discussion about whos telling the truth about encounters between comey and the president. Human memory, human perceptions being what they are, it is entirely possible that neither is doing anything but true. People have different assessments of what has transpired in a meeting. All im saying as a lawyer, every time youre testifying under oath if this is a wide ranging testimony covering many things there are always the possibility of inconsistencies. This president has been under attack. Were talking about a difficult situation. Paul, could special Counsel Robert Mueller compel the president to talk to him as part of the investigation . He could. We have precedent for that in the clinton investigation. Initially president clinton resisted a grand jury subpoena from independent counsel star and lost that bat until the District Court here. The subpoena was withdrawn and the president permitted to testify voluntarily, an accommodation to the notoriety and significance of his office. But i suspect strongly that if mueller were to insist upon his testimony the president would not be able to lawfully resist and refuse to testify. How about does he need to release these tapes if they exist . David, take the media enthusiasm out of this. President trump refused to say whether hes got recordings of those conversations with james comey. And the House Intelligence Committee has given them a deadline of june 23rd to hand them over. Do you think hell comply . I believe he will comply if recordings exist, they will be produced. Again, even if they exist i dont think that theyre going to contain any smoking gun. As far as the factual narrative that mr. Comey put forward, i happen to believe that he was largely accurate. The question is, what other inferences you draw from this . Everybody is obsessing about obstruction of justice. In my view from a statutory perspective and constitutional perspective this is absurd. The president exercises the totality of Law Enforcement powers under our constitution. Order any investigation to be started and order any investigation to be ended. Authority of the attorney general or fbi exercises derives from that of a president. I agree with professor dershowitz it can never be an obstruction of justice. The facts are almost irrelevant. Do you agree . Over the weekend don jr. Says when my dad says hope hes not asking you a question, hes telling you what to do. Im not sure i know how to characterize what the president did and whether its obstruction of justice or not. Thats a factual question about his intent that hasnt been answered. As a legal matter, though, i dont agree with david or professor dershowitz and neither does the u. S. Supreme court that exact argument was made in the morrison versus olson case the original case that tested whether or not the independent counsel law was lawful and it was rejected. Now it may be that thats no longer good law ins terms of where weve come since that time, but for my money existing Supreme Court president has an existing strong ground on which to stand. The question will come down to whether or not the president had what they called a corrupt intent in firing comey and, you know, theres at least an argument that he didnt. He was ignorant of washington ways. Youve heard that from speaker ryan, for example. Theres evidence to the contrary. So its going to be a contested issue and thats all leaving aside a different open question which is whether or not sitting president s can be indicted at all. Paul, before we go, you wrote over the weekend, in your law fair blog the title was the worst thing that happened to donald trump this week and you were not talking about james comey. You said it was that special Counsel Robert Mueller appointed deputy solicit general michael dreedsen to help with the investigation. Why is this bad news for the president . Its bad news for anybody when the people on the other side get really good tall tonight work for them. Talent to work for them. Michael dreedsen is perhaps the best criminal appellate lawyer in america, at least on the governments side. Hes been doing it for more than 20 years. Hes argued more than 100 cases in front of the Supreme Court. He has what i would characterize as an ensigh clo pedic knowledge of criminal law and precedent. He is one of the most persuasive oral advocates ive ever seen in the Supreme Court. So its definitely a good step for mueller to bring somebody like that on board. This is the latest in now whats a group of lawsuits claiming that the president s business dealings violated a term of the constitution called the emol lieuments clause which says president s cant accept money in return for doing their jobs or gifts or favors from foreign governments and what the lawsuit says and things is the latest lawsuit to make this aelgs filed by these two states, they say that by continuing to own the trump hotel here in washington, the trump hotel gets business that is potentially taken away from either taxpayer owned or taxpayer subsidized Convention Centers that might get business if it were not for the president s ownership of the trump hotel. Thats how they get around the possibility they dont have a dog in this fight. Thats the first question that will come up. They say that in order to fully understand the president s business dealings, they may need copies of his tax returns. So well see where this goes. These are tricky lawsuits to bring. There isnt a lot of history with these because, frankly, in the past, president s havent given much of a test to the clause. So there are questions about the abilities of the states to sue, how strong their legal case is. There are many legal scholars that believe that the president s business dealings, despite setting up a trust do create this problem. Those tax returns might be a problem. I want to get my panel to weigh in, matt and ron. Matt, to you first, you can talk to eric, don jr. And they say all smiles our father has absolutely no conflicts of interest and never will. But will me . At the very least this is a problematic distraction . He does have conflicts of interest. Thats the fact of it. They range wider than weve seen any president in our lifetime and potentially in history. Something like this is going to be challenged. Whether its going to be this lawsuit or something in the future, but at some point theres going to be a microscope put on this and for good reason. We need to see this. Its the discovery that will prove to be the most interesting and perhaps impactful on what happens to the presidency. We knew that though. The president was going to get challenged right, left and center. Now weve heard from the state of maryland, or were going to, and washington, d. C. What happens if its more widespread than that . Beyond these two states . Well, i think it should be. As matt suggests should, would, could . When does it matter . Well, i dont know how you get definitive proof hes vees lating the clause violating the clause when it seems on its face its obvious. Getting money into his hotels from foreign officials who come and stay there and spend a fair amount of money which generally enriches him, being the sole beneficiary of a trust that is supposed to be blind, that is not. Being briefed on your businesses by your sons every quarter as they suggested they might do is again a violation of conflict of interest rules. You think foreign ambassadors taking selfies going best meal ever at the trump property is an issue . Theyre staying there, it seems. There are a variety of conflicts that sit obviously in front of us. The question to me and i hate to use this expression where is the outrage . This is the most conflicted president since Richard Nixon who had his own personal financial dealings that were rather exhaustively investigated and set the stage for a lot of these concerns. I think theyre legitimate and doesnt seem that at least in terms of the general public anyone is all that perturbed by it. Theres a bandwidth issue. Only so many things to Pay Attention to in this administration. From the getgo, from the First Executive order that came within hours of being sworn in there have been scandals, conflicts, headline generating activity. At some point on the legislative end when the next things fail, dont pass and obamacare, you know, tweak when they dont pass tax reform, theres going to be available bandwidth opening up and thats when people are going to be looking at potential corruption stories, to a degree that they are not currently right now. Many people have said this is the media simply going after the president , let him do his job. If he doesnt create jobs, then what . Well this weekend, a new jersey couple in bedminister had their waegds at maralago another party on friday and they did, in fact, get a photograph with the president. One could make the argument listen, this is one of the reasons people like the guy, love the guy, they voted for him because they wanted that attention or affection. But when does one say this is absurd hes promoting his own business on the American Peoples back . You said it. At a wedding the president should be divorced from these proceedings because it is in district conflict with his job as president of the United States. He is promoting a property from which he benefits and uses it as white house south it is also a concern that charges 200,000 a year for membership, charges relatively exorbitant fees for weddings and other gatherings and those go into that trust again of which he is the sole beneficiary at least for now. That is on its face a conflict of interest and yet we havent had anyone directly challenge that until today. Could he not sit down and say, cant answer, not willing to answer, unable. He volunteered to sit down but what do you think youre going to get . I think when you add up his meetings with the russians and the director of the the former director of the fbi said last week, that there were reasons they knew he was going to have to recuse and those reasons were late to his relate to his connection to kislyak the chief russian spy master in the u. S. , the attorney of the United States, i think it matters that you pull this guy out in front of the cameras and ask him what the heck is going on. According to the wall street journal, the Treasury Department will recommend new banking recalls that would water down the powers of the Consumer Protection financial bureau. That department oversees a bunch of things, including mortgages, credit cards and student loans. I want to bring my panel back. Matt, start with you. First of all the cfpb is there specifically for consumers. No one said it was perfect. Yes, that was the agency that went after wells fargo. If it wasnt for the l. A. Times im not sure they would have caught them. Theres an argument to be made that these agencies need to be better, smarter, tighter, more stream lined. But is this approach the right approach . Certainly one could make the argument that they were constrained in lending to the borrows who needed low interest loans the most and couldnt because the other regulators had tightened credit regulations after the crisis. One could say yes, that theres some good in rolling back some of the banking restrictions. More broadly speaking, theyre also talking about rolling back restrictions that were put in place post crisis that might prevent the next problem. And i dont think that that part is the one im more concerned about than what theyre doing at the cfpb right now. Weve heard from Big Bank Ceos who have said their banks are stronger since doddfrank has been put in place. Theyre the biggest guys and can afford the most amount of compliance officers. We should care about the small and mid size banks. But to the American People, those who said they distrust the Banking Industry more than any industry in the world, how do these rollbacks help the American People even as the president points to the booming stock market and the jobs numbers. None of those numbers are a direct reflection of policy put in place. Its about enthusiasm. Some of the doddfrank relief is to get the small banks out of the cross hairs of the regulations. Of course the biggest banks love regulations. They get to sort of write them, they get the benefit from them because they can afford to comply. Its much harder and this is true of all financial regulations, much harder for the little guys. On the Consumer Protection bureau, lets remember that this agency has more power as a Regulatory Agency than almost anything else. The d. C. Court of appeals last october said that the head of that the director of that agency has more power within the federal government than any Single Person beside the president. And they dont always use that power for good. Theyve monkeyed with individuals very sensitive Consumer Financial records there without asking authorization or permission. So theres a very legitimate reason to look at the structure of the cfp and roll some of that back for sure. Having said that, while james comey was testifying last thursday, the house was voting on the so called choice act to roll doddfrank back even further. Theyre defining the amounts of the securities and Exchange Commission to clamp down. Theyre looking to allow banks to get back into investment activities that were part of the problem precrisis. We have to take this piece by piece, a broader rollback of doddfrank might be less beneficial than some people think. Certainly credit worthy borrows or those that need to benefit of low Interest Rates to refinance out of trouble should have access in their community banks. But you dont want to unwind everything that was put in place post crisis and set the stage for another problem down the road. It is important to note that in the report the wall street journal pointed out in the 150page report they make many recommendations on policy goals. What we dont have is anything specifically laying out how to achieve them and that is what is so important. We need those policies across the board, whether were talking about tax reform, health care or deregulation.
