Speaking to reporters yesterday, the president appeared to walk back the idea of the election, but continued his attack on mailin voting and tried to sow doubt about the validity of novembers results. You know, for so many years ive been watching elections, and they say the projected winner of the election, i dont want to see that take place a week after november 3rd or a month, or, fwrankly, with litigation or anything else that can happen years, years, or you never even know who won the election. I want to have the result of the election. I dont want to be waiting around for weeks and months and literally potentially if you really did it right years because youll never know. These ballots are missing. I dont want a delay. I want to have the election. I also dont want to wait three months and find out that the boll lots are all missing and the election isnt happening. You go in, whats your name, i sign in, ive been doing it for years. I dont want to see a crooked election. Well, many Top Republicans are breaking with the president to blumtly reject the idea of the upcoming election. Heres what some of them told reporters yesterday. Never in the history of the country through wars, depressions, and the civil war have we ever not had a federally scheduled election on time, and well find a way to do it again this november 3rd. Never have we ever not held an election, and we should go forward with our election. Were not going to delay the election, stuart, and were going to have it completed by election day. I dont think the federal government i dont know. I think its constitutionally set. The election is going to happen in november, period. Well, there you have it. Several trump advisers tell the Washington Post there are no internal discussions under way in the white house about moving the election. We should note though under the constitution, only Congress Holds the authority to change the date of the election. Secretary of state mike pompeo responded cautiously when asked about the president s tweet suggesting a delay over the election in november. You are one of the most highly trained and accomplished lawyers who are part of this administration can a president delay a president ial election . The department, trust us, will make that legal determination. We want i know you do, too, senator kaine, want an election everyone is confident in. Well, the coronavirus pandemics toll became clearer yesterday over the most devastating collapse on record. The virus has wiped away nearly five years of the nations Economic Growth as the Economic Growth fell a staggering 9. 5 in the Second Quarter of this year. The sharp drop is the equivalent of a 32. 9 annual rate as consumers have cut back spending, businesses have cut back investments, and global trade practically dried up. The rapid decline is nearly twice as large as the Great Depression and happened in a fraction of the time. The gdp has not seen these staggering numbers since the election. Pompeo was a little iffy about it. He wasnt as firm. But what was your read. Well, pompeo, that tweet came while he was in a hearing, so he hadnt seen what everybody else was saying about the tweet yet. So but the pushback from congressional republicans, i mean, delaying the election would be unprecedent. Weve had elections through civil wars, world wars, and it would also be very costly to try to reschedule everything. Its sort of something thats so offbase its never going to happen. One of the things about this is in April Joe Biden floated the idea that trump might try to delay the election, and a lot of republicans brushed it off as a conspiracy theory. Trump and his team were very forceful saying, no, its going to happen on november 3rd. So his new tweet, a lot of his republican colleagues in a very awkward position because they had just defended him against this kind of sentiment a few months ago. Emily, let me apologize. I know its the Washington Examiner and i havent had enough coffee. Ill work on that. The election policy, how does that affect the reelection hopes . Of course the president has been running on the economy since he started in office, so its devastating that were in such a downturn right now. So his team put out a statement yesterday that they were sort of having to have an awkward statement. They were trying to push back against that 32. 9 annualized figure you were mentioning and pointing out the instead actual threemonth gdp drop of 9. 5 . Thats still really bad. Its hard to try to promise things are going to get better. Joe biden is definitely using this to his advantage, and the contract between the two, its hard for the Trump Campaign to say its going to get better when its hard to show any numbers that that is definitely going to happen by the election. So, emily, if you stack up both the economy, the malaise, and the economy that happened overnight, is there anything that the president can hang onto that the public can say, yeah, well reelect you . One of the arguments that the Trump Campaign is focusing on is what will the alternative be if joe biden is elected. Joe biden probably has the most progressive policy platform of any president ial democratic nominee so far, so that has implications for a lot of industries for things like energy, for the health care industry, and so the implications of what that could be, it could be a motivating force for voters, but right now this is a coronavirus election. Ghislaine maxwell filed an emergency motion to block the release of depositions in a civil suit about her sex life. She asked the Second Circuit court of appeals to halt what they say would put her in jeopardy. They said maxwell had been promised confidentiality before being forced to answer many personal, sensitive, and allegedly criminaltory things. She is charged with perjury in lying about her involvement in sex trafficking. She awaits trial in a brooklyn jail. The legal battle against Michael Flynn will continue. The Appeals Court has thrown out the split decision by its threeperson pam that directed the District Court to close the case. The court will hear new arguments over whether judge Emmett Sullivan is required to grant the motion to drop the charges against flynn or if his decision to hear friend of the Court Arguments opposing the dismissal and decide on his own is indeed within his power. Flynn pled guilty on three occasions before two different judges to lying the fbi in its investigation of the russian interference. Appellate Court Arguments are set for august 11th. Joining me now msnbc legal analyst danny kve cevallos. If they end up not dismissing the charges, what happens next . Technically the flynn team could appeal again. This has gotten procedurally confusing very quickly because this isnt about a bad decision flynn got by judge sullivan. Instead flynn asked the court of appeals to take the case completely away from sullivan to divest him of any choice in the matter. So the panel and this is what happens. Often a threejudge panel at the Supreme Court hears it, not the full court. This panel was divided 21, and the full appeal court is going to hear the case en banc, which is not the way they hear it. So what theyre deciding is not whether or not judge sullivan made a bad call. Theyre deciding whether he gets to decide the case at all. So if they do send it down to judge sullivan, he can decide in favor of flynn or against flynn and this whole process can start over in Appeals Court. Had there been eun nameunani among the judges, would this have been happening . Its 21 split at a Panel Hearing that will get you normally to an en banc hearing. Sometimes the court will hear it without even dealing with the panel in the first instance. Why that didnt happen in the flynn case, im not sure. Yeah. Ghislaine maxwell, does she have a solid legal basis for keeping the deposition under wraps . She might because in addition to agreeing to sit for a deposition, there was apparently an agreement to keep the deposition information confidential. Now, on the other hand, courts really do not like sealing documents. The whole idea behind courts is theyre available to the public and we all can theoretically go into the courthouse and look at documents and watch proceedings. Thats not always the case, but thats the idea behind it. But in this case, maxwell argued she never would have sat through the deposition and be honest and forthcoming if she knew the confidentiality agreement and order was not going to be honored, and shes arguing that the government obtained inunfairly, claiming it was to be confidential, and now theyre using it against her. This came up in cases like cosby. If you sit there and give answers under oath, whether you perjure yourself, whether its confidential, sealed, or whatever, you still are subject to prosecution. You can see the latest track. It starts to really rev up as it sit in that warm ocean. By tomorrow we expect the sustained winds to be picking up to 100 miles an hour. You can see from the latest track, its not going to be potential landfall for miami. Its about 60 miles away, so that could possibly wobble here, and then, you know, things will change in the next 12 to 24 hours, but right now it looks to stay well offshore, but were still going to see that high surf and damaged winds all along the florida coastline. This makes its way all the way into South Carolina still as a cat 1. And right now theyre saying a potential land fall for monday into virginia. Look at this, alex. Lets talk about what we were suggesting at the top of the block where the president offered a very positive outlook on the coronavirus despite the rise in cases among several states. Whats your interpretation of that . Well, i think the president is looking toward the president ial election and trying to paint a positive picture despite the coronavirus. Despite the rise in cases, i think hi argument is its not as bad as it could have been, and hes hoping voters will look at the pandemic as something that is not necessarily his fault. Of coursings you have joe biden on the other hand arguing that there were steps the president could have taken to severely limit the impact of the coronavirus and things that were not done that ended up making pandemic a lot worse. So while the president is hoping voters will be forgiving in this sense and trying to point toward a few positive numbers that he can point out, you know, he definitely has an uphill battle to go. The one thing is he has seemed to realize the economy is not going to get back to the levels that he is hoping for in this campaign until he has until there is a handle, really, on the coronavirus. Thats why you see him going back to having these coronavirus briefings again. Well, with regard to the coronavirus, emily, you know the president is insisting that the u. S. Reopen schools in the fall, but given the findings of the new study, the children carrying the virus as much as adults, is that something you find most people getting on board with . I think the study is going to definitely influence how and when to reopen schools. As you mentioned, that doesnt necessarily means theres transmissibility as much transmissibility between children and adults as there is among just adults themselves, but the fact that they are carrying it at a higher rate is definitely going to make teachers more wary over returning to school. So a lot of experts reopening o school, were not going to get back to a sense of normal until we reopen schools, but until we get more of a handle on the virus and shutting down things having bars open and schools closed, maybe theres a way to reverse that, do it in small waves. But the pressure to reopen quickly is something the president and a lot of republicans are looking forward to definitely as a political implication of that as we head into the election as well because thats going to have an impact on the economy and what people feel like as normal life. The department of Homeland Security has gathered Intelligence Reports on two american journalists who published luked documents, this according to the Washington Post. Three open Intelligence Reports sent to Law Enforcement agencies and obtained by the post summarized tweets by two journalists, mike baker and editor in chief of the blog law fare both had leaked documents. Isaias is moving out of the northwest at 17 miles an hour. Thats going to help, but the flooding still is a very big issue. Weve seen that in puerto rico and hispaniola. The latest came out from if the National Hurricane center at 5 00 a. M. The storm will increase to a category 2 as it makes its way across the northwest of the bahamas. Any movement, we could see a potential impact for the bahamas. Were going to watch that closely. By sunday afternoon, youll really start to feel it from west palm all the way to georgia. I want to put myrtle beach in that. Youll notice it in ralea raleighdurham and north virginia. Youre seeing the track right now, but that could potentially change. The hold that President Trump has had over the Republican Party is starting to slip. Yesterday was a big deal never before has a republican leader of the house and senate disagreed with the president when the president said maybe we have to delay the election, they were adamant they werent going to delay the election. This makes them worry one they could lose and two it would crush them politically. This goes along with face masks, Mitch Mcconnell was saying you should wear a face mask and the president said you shouldnt. Ceos, used to be worried about talking trump, now you see them taking him on. You see them challenging a decision he made on friday. They used to be fearful of that because they thought there would be a backlash from the president. That shows they believe his power is waning, doesnt mean he definitely loses but they dont fear him the way they did three short months ago. This is going down ballot as well, right . Anybody who might be in a race that theyre up against the powerful democratic opponent or they feel their own numbers are weakening a bit, theyre likely to go against the president because of his lagging poll numbers . Youre in a bind because republican that they say like trump so they cant take him on that forcefully, i think it would be bad politics in terms of getting your base to show up. But theyre looking at the polls were looking at and saying the polls suck. They see it in their polls, national polls, white people, black people, everybody where his numbers are going down largely because of his m mismanagement of the coronavirus. The best thing that could happen for the Democratic Party is not just that joe biden wins, its that joe biden wins and he brings in a democratic senate. When you have all party rule in this town you can do massive things in a short amount of time, thats why were seeing donors move money from the president ial race to senate races. Health care companies, hospitals, pharmaceutical industry, others youre seeing their numbers rise. Retailers, grocers youre seeing their numbers rise. You look at the two groups where the public has a worse view of the groups today than the beginning of the virus, its the airline industry, not many planes flying, and then the media. The fact that at a time people are more reliant on the media than ever before to get information they could trust that people are turning more sour on us, by the way, they were sour on us to begin with. This is not a great trend line. This is a threat to democracy, people dont believe media, truth, when we all separate into our corners and make us want to believe things that are fuzzy and good, but not necessarily true, bad things can happen.
