First, Senate Republicans are preparing to invoke the socalled Nuclear Option as the confirmation of president Trumps Supreme Court nominee neil gorsuch heads toward a dramatic final vote. Yesterday the Senate Judiciary Committee Approved gorsuchs nomination in an 119 vote. It went along party lines. That vote essentially served as a preview of what will likely be a seismic contentious vote by the full senate. At some point today Mitch Mcconnell will file the proceeding to end debate on gorsuchs nomination with hopes of a final vote by friday, but 42 democrats have publicly announced their opposition to the nomination and support for a fill buster. In response, senator mcconnell has left open the option of changing the senate rules so that gorsuch, and potentially future Supreme Court nominees k pass the senate with a simple majority instead of a 60vote threshold. Those likely to fundamentally reshape the way the senate does business, senators took time to express their grief. I dont think were ready to stop the debate on the floor. Frankly, i dont think we have a clear miment yet from the Republican Party they wont change the rules. They wont change the rules on this nominee or the next nominee. As you heard from many of my colleagues and from myself, we are still very angry over what happened to judge garland. So, mr. President , we can go back and forth and blame each other. Brut in the recent history of the vacancy caused by Justice Scalias death. We both lost. We lost judge garland, and republicans will lose on judge gorsuch because were doing something that we think is reasonable in asking he be able to earn 60 votes as so many others have. We think the two are equivalent. In either case, we both lost. Is this the beginning of the end of the senate as we know it . Yes. Because its a slippery slope. Next will be the legislative 60 votes. Why is that why is it . Its because its a slippery slope. Means theres no reason for us to be bicameral. Why not have one body of both rules apply to both. Save taxpayers a lot of money. It certainly is the end of bipartisanship on judges. Well have a partisan vote on every federal judge, at least at the circuit Supreme Court level, which across the aisle will be a thing that passed. It makes every open senate seat a referendum. Thats what happens when you do it within one party. The political fight over filling the late justice antonin scalias seat has left lawmakers pointing fingers at one another. Republican members criticized their democratic counterparts over their planned filibuster over neil gorsuch, including senator ted cruz. Take a listen. What we saw today was the position of the modern Democratic Party as they are opposed to donald trump appointing anyone to the Supreme Court. If they will filibuster neil gorsuch, they will filibuster any nominee from a republican president. That obviously is not a tenable standard for advice and consent, and that is the reason why if democrats persist in this foolish filibuster, the Senate Majority will have no choice but return to the standard that has prevailed for over two centuries which is confirming Supreme Court justices by majority votes. That was the same senator ted cruz who just this past october during the president ial campaign suggested republicans could seek to block Hillary Clinton from filling Justice Scalias vacancy indefinitely had she won. Cruz told reporters at the time, quote, theres certainly long historical precedent for Supreme Court with fewer justices. I would note just recently Justice Stephen breyer the vacancy is not impacting the ability of the court to do its job. Senator tim kaine suggested that democrats would use the very Nuclear Option republicans are now considering to push through neil gorsuch to get President Trumps pick merritt garland confirmed. These guys think theyre going to stonewall the filling of that vacancy or other vacancies, i democratic majority will say, were not going to let you thwart the law. Well uphold the law so the court will be ninemember. So pryoure predicting hell change the law. Im predicting if the if they stonewall. Then i think that will happen. We call that segment in their own words there. Joining us now, reporter for politico and coauthor of playbook, daniel lippman. It seems they will have to go nuclear to get neil gorsuch confirmed. Talk to us about the ramifications of that. Will this fundamentally change how the senate functions going forward. I think this may be all overplayed by both sides trying to create drama and justice their extreme measures in both parties. It does seem like in the next couple weeks after gorsuch is approved, the senate may go back to its normal way of business. This may just be a huge storm that wont have actual legislative effects because the senate does not want to devolve into aitter partisan battle every day. Wait minute. You think with all this bad blood between both parties theyre going to go back to normal business . You really think senate and members there will put aside their differences and find Common Ground and Work Together after all this . I never said theyll find Common Ground on everything. The senate was already kind of had broke as an institution. But i dont think that this move this week is as seismic as everyone thinks because both parties and both senators in the senate, they feel like they cant go further down the path of kind of destroying the institution. So i think that on real legislation, theyre not going to abolish the legislative filibuster. And so im kind of taking a counterintuitive take, but thats just how i see it. Because it doesnt seem like the senate will be the blood bath every day the world is not going to end because of well, listen, its hopeful listening to you, but i have to say listening to john mccain it was like yes, yes even Lindsey Graham himself suggested that. Mccain is always negative on, you know, every move they make in the senate. We appreciate optimism, lets say that. Thank you for that. Meantime, at least 14 people are dead, dozens more injured following an explosion in the subway in st. Petersburg, russia. The train was between two stations when that blast occurred. Russian Authorities Say a second explosive device that did not detonate was found at another station in the city. One russian official said it was filled with ball bearing screws and pieces of metal. Persons in intelligence reports that related to trump transition activities. Sources tell bloomberg this is the reason devin nunes viewed the documents at a white house secured facility and not a capitol hill one. Quote, it now appears nunes needed to view Computer Systems within the National Security council that would include the logs of rices requests to unmask u. S. Persons. Bloomberg cites a u. S. Official familiar with the report who said, the logs contain valuable political information on the trump transition such as whom the trump team was meeting, the views of Trump Associates on Foreign Policy matters and plans for the incoming administration. Now, on friday, chairman nunes again said they have nothing to do with russia. The reports i was able to review immediately gave me gave me very serious concerns about what i call incidental collection. Maybe legal but im not sure its right. When you add on top of that the unmasking of an americans name, then thatas the end. I mean, and it had nhing to do with russia at all. Ive said that over and over again. Rice was National Security adviser at the time of the apparent requests and the report suggests her calls for unmasking were allowed under law. Susan rice who served as president obamas u. N. Ambassador and then National Security adviser for almost all of his second term has not publicly commented since the reports emerged but two weeks ago when chairman nunes made his claim that the president elect and his team were at least monitored, rice said this to pbs. I know nothing about this. I was surprised to see reports from chairman nunes on that count today. I really dont know to what chairman nunes was referring, but he said that whatever he was referring to was a legal, lawful surveillance. And that it was potentially incidental collection on american citizens. Well, yesterday senator rand paul told nbc news that ambassador rice should be subpoenaed to testify before congress. Meantime, the Baltimore Police department had agreed to undergo a serious overhaul in the wake of the death of freddie gray. Now the Justice Department has asked a federal judge for a 90day pause to review the agreement. Joining us now, reporter for politico and coauthor of politicos playbook, daniel lippman. Walk us through what attorney general sessions ordered. He ordered the Justice Department to look at all those dozens of agreements they had between jtice and local Police Departments order and reform he ask them to basically see if the reforms were in line with Trump Administration priorities, like not blaming entire department based on one officer. I think the point i would make is that this is more for pr than actually changing these agreements because Police Departments who you might think would be welcome to listen to sessions, they want these agreements in place because it keeps these cities safer than they would otherwise be without them.
