anti-immigration policy could come through as early as next week, so, when it comes to immigration policy, michael brought this up, too how boxed in is mitt romney by high-profile members within his own party like arizona governor jan briar around the fa jan brewer and people will have a hard time walking away from thing said in the primary. >> boxed in? he is like in solitary confinement on alcatraz, i was chuckling when my friend, michael, was talk. he doesn't have a hill to climb, he has mount everest to climb. why? he gave us his policy. during the primary, add very simple policy, people not here illegally should leave. that was the policy, doesn't matter if you were young, old, self-deport, grandmother, a worker, tough leave. and now when barack obama comes out with this policy affecting 800,000 or more younger illegal immigrants, undocumented workers, they could say, he can't respond to that this is a key issue here. there is no reason to penalize those percentage out of the country, to homes that they never knew were not really their homes, there's no good policy position to do it. so, my guess is latino voters look at people who oppose the president's policy. we don't accept it. and say there is only one reason to take that poe you don't like us. you don't like our community. you're using us as fodder to appeal to your conservative base, if you can't convince people you like them, doesn't matter what you say about the economy and jobs. >> chris, the best thing that mitt romney did in response to the president's executive order on immigration is confirmed that marco rubio is being red is the for vice president? 'cause i mean that was basically the only thing he has done in response to the fact that, you know, hey, i have got nothing on this for you you yet i'm not going to talk about it, i will show up with push the naleo. >> elections are demographic puzzles, win a certain percentage of certain groups to be in a fighting chance to win. republicans have hist toerically had problems with hispanics. but george bush actually did better, junior did better with hispanics. romney has got serious problems right now he is losing 20, 30 points, depending on the poll. he loses that bad, he cannot win some of these key battlegrounds. his problem is he got boxed in the primaries. he went far, far to the right. this is a key demo graph rick. he has to figure out a way to moderate. he can't, because as he moderates, he alienates those on the right and trying to plate tap dance and actual slit worst of all worlds because then it reconfirms the sreotype of this man that he doesn't have any core convictions. it is a terrible place for governor romney. >> boxed in at the bottom of mount everest but about to show up at naleo. gentlemen are i will ask you all to stand by for us, hang in a minute. we are going to get an update about this showdown looming on the house floor as gop leadership plans a contempt of congress vote next week for attorney general eric holder. republicans pledge the vote in this house will happen unless the president, holder and the justice department stop asserting executive privilege and hand over documents related to the fast and furious gun walking investigation. >> you can't just simple is play ignore this. this is not a partisan game and the white house and the department of justice should have put this to bed about a year ago. we shouldn't be at this point at this time. >> democrats are blasting gop leadership, accusing their colleagues of a witch hunt, playing politic with us the obama administration in an election year. here's house minority leader nancy pelosi speaking just moments ago. >> what we have seen is a shameful display of abuse of power by the republicans in the house of representatives. instead of bringing job-creating legislation to the floor, the transportation bill, they are holding the attorney general of the united states in contempt of congress for doing his job. >> capitol hill correspondent kelly o'donnell joins me now from washington, d.c. kelly, the outcome of yesterday's vote along the party line there is that makes up that house committee of 23-17. so what is the next step in this timeline? >> well there is a window of space that we have now, thomas, where the attorney general, who is traveling today in europe, says there might be time to resolve this. house republican leaders say there might be time to resolve this. and that would mean some kind of agreement on releasing more documents, at least according to house republicans, who do plan to vote on this next week. because of their numbers in the house, it would be reasonable to assume, if it went to the house floor, it would likely pass. then there are some complicated next steps because the congress never held a sitting attorney general in contempt before, what typically happens is a contempt citation is referred to the u.s. attorney for the district of columbia. then it would go to a grand jury. well, those are all things related to the job eric holder actually does. so, it gets complicated, we are not sure what some of those next steps will bring. politically, what this fight has been about, you know the backstory about this originally being a concern about a program that was being running guns across the mexican border. this was between 2009 and 2011. it had an intent to try to follow those guns to find cartels and traffickers but it did go wrong. ed administration acknowledged that. both parties agreed it was flawed. part of what they were trying to zero in on, initially the department of justice said that program did not happen that way. they made a denial. the months went by, they acknowledged, yes, in fact, some of those tactics were being used. what darryl issa and his community want to look at is specifically what is happening between the scenes between the denial and acknowledging this to congress? that is the narrow focus they say they want to look at. it has certainly turned into a big political fight. thomas? >> kelly o'donnell in d.c. thanks so much. we will bring back our political power panel, michael steele, david corps, chris kofinis. i want to play something that president obama said in '07. >> every time there is something a little shaky that is taking place, they want to hide behind executive privilege. i think theed a minute would be best served by coming clean on this. >> then rick santorum tweeted, transparency, yet another obama promise broken as his administration invokes executive privilege in fast and furious. do you think the president got backed into a corner, especially at this time pivotal to the campaign election? >> i don't think so. you look at it in terms of executive privilege, he has invoked it once nearly four years, an issue which from their perspective, they see this as big political football season and basically all the balls being thrown at the attorney general holder. from my perspective, the problem the republicans have they have gone way overboard in terms of making this look overtly political, doesn't serve their interest. i don't see how it has any kind of political gain for them in the long term. tend of the day, what thing ends up about getting resolved between the party bus i don't see how the republicans think they look good in this. >> michael, let's get your tank on this "washington post," the fix, said this of the holder vote "the question whether in reacting quick labor day forcefully to his provocations, republicans are playing directly into obama's strategic plan. the bottom line is this vote took some attention away from the campaign tray. "did republicans only hurt them sbifs making this look so highly as a resultson? some people looking back as far as when darrell issa got in charge of oversight to look like poor winners, as if they are going to pull congressional hearings on everything. >> right. right. i think that that set the tone for where we are now. i think it put in place the narrative that we are starting here that, you know, chris himself has just touched on about how this ultimately impacts on republicans in a negative way. i think the administration has an advantage they could play should this thing get up against the wall and there is no movement and is there a vote on the house floor next week to run against the do nothing congress. the country is hurting. they are trying to track down old files from whatever be acknowledged was a bad plan and we fixed and moved on beyond that. the problem is that there was a life lost here. there was an agent of our government serving in the field who was killed. and so that raises the bar on this a lot in terms of making sure the administration wasn't negligent in management of this program, that's what the documents should speak to in one way or the other what issa is trying to get after. my caution to the gop is just to make sure that when you're playing this thing, you play it in a way in which you down play the politics and play up the fact that there was a life lost here. >> agent terry. >> weekend we are trying to get to the truth. >> gentlemen, i want to turn quickly, david, while you i have you here, getting this hot you the note, the secretary of commerce has resigned, handing in his letter of resignation, john bryson. going to read a part of this. >> reporter: well, that's one of many reasons that jerry sandusky probably didn't testify in his own fense. we understand that his son was here at the courthouse, prepared to testify, that he had conta contacted the prosecutors after being silent throughout this entire case. he apparently witnessed something, he may have been a victim himself, we are not sure but yes, that is one reason we believe sandusky did not take the witness stand. imagine the spec trouble, sitting there, being cross-examined by prosecutors and going through each detail of the allegations of the ten now young men about what happened over those ten years of alleged abuse. clearly that would have been something that the prosecution wanted to avoid as well. right now, we are in closing arguments, the doselves going first you can the prosecution will follow, we expected the jury should have this case some time after lunch and then the deliberations begin. the jury will be sequestered, them set their own schedule, so, anybody's guess as to how long this could all take but this trial has moved along at lightning pace so we expect that to perhaps continue as we go through closing arguments and into the deliberations beginning this afternoon. thomas? >> nbc's ron allen in bellefonte, pennsylvania. ron, thanks so much. joining me here in studio is criminal defense attorney, former federal prosecutor, jay fahey. great to have you here. as ron was pointing out and we were talking about in break this seems like it has gone by at a lightning pace they have been able to get this far and the fact the jury could be handed this case by lunch time. the judge though throwing out two of the counts relating to a i kaiser around victim number four, saying the charges did not bear out. is that a sign that part of the prosecution's case was weak or that out of these 52 charges, they may have overreached in trying to get them all to stick? >> it is more the overreaching. prosecutor of the-put everything they can into an indictment t has to be sustainable at least from the grand jury because the grand jury vote on the indictment. but prosecutor tries to load up everything he can, knowing in most cases, most cases, a couple of criminal counts get thrown out, if there are over 20 counts in the indictment. this is very common. this suspect something a big surprise or would upset the prosecutor. >> the revelation that has everybody's ears perked up, matt sandusky contacted prosecutors after this trial began and was prepared to provide potentially damaging testimony against his father if jerry sandusky had taken the stand. why didn't prosecutors just bring matt sandusky to the stand anyway? why utilize him as a rebuttal witness and not just as a witness in general? >> well, his son, matt, had been a huge supporter of him, gone to almost all of the hearings and then spoke about how good a man his father was. what i suspect happened, as time went by and as matt sandusky saw what the evidence was, he started maybe to rethink things that had occurred in the past and he reached out for the prosecut prosecutor's office, we understand urkt past week or so so that couldn't be brought by the prosecutors now because they had brought -- assuming there was something criminal involved in his son that would have to have been a new indictment and put everything back many, many weeks and the jury has been selected in this case, this case had to proceed. >> at the rate of speed that we have seen this in terms of what's taking place in court, do you think that the jury is going to be returning just as fast? >> my guess is that since the jury is sequestered and staying overnight, think we will see a verdict between five and 12 hours, i would expect a verdict by late friday at the latest and may deliberate into the evening. that is going to be completely up to them v dinner tonight. >> set their own work hours? ♪ we are back now with more on the breaking news about secretary john bryson resigning as the commerce secretary. this coming after nearly two weeks after some strange hit and run accidents that happened in california. nbc white house correspondent mike viqueira joins me now with the latest on this. mike, the president accepted this last night? >> that's right. the president in a statement revealed that he had accepted john bryce's -- john bryson's resignation last night and it comes less that two weeks, it was june 9th, john bryson, the commerce secretary informs california. he had just concluded a couple of commencement addresses. he got in some traffic accidents while behind the wheel two separate incidents, as we understand it was found unconscious in his car. took a medical leave of absence just after that at that time. it was not disclosed, still not disclosed, what his precise medical condition is and how it played role in those accident bus now we learn he has gone ahead and resigned. he was only in office since october. he took over from gary locke. you remember gary locke, the commerce secretary sent to china where he is now the ambassador. the department of commerce in charge of promoting american business, mostly around the world. in his statement you can the president praised mr. bryson, secretary bryson, for his work in promoting exports, renewable energy this san individual who comes from some of america's most famous companies, he has been a director at bowing, a director at disney, he was ceoo and president of edison international. rebecca blank, who is now the acting secretary ever since that medical leave went into effect some two weeks ago now becomes -- continues as acting secretary. this is a position, of course that would have to be confirmed by the senate. no indication from the president of who he will ultimately nominate to succeed bryson. >> mike viqueira at the white house. thank you. developing right now, want to show you live pictures from orlando, florida, where in 30 minutes, will speak to the national association of latino elected and appointed officials, also known as nah lay -- naleo. voters been waiting for mitt romney, an executive order giving if immigrants the opportunity to legally enterhe workforce. this could be one of the candidate's final opportunities make gains within a pivotal part of thing elechter rat. telemundo's jose diaz-balart and maria theresa kumar join us now the immigration question, it certainly dogged mitt romney for months now, one of the more conservative stances he took during the primaries to shred that moderate label drawn fire his what i can we say in the next hour to try to allay any fears in the latino community, to know that he does have a plan and that he does feel that they belong under his tent, under the gop? >> i think what he should do is basically have a bill clinton soul moment. embrace what barack obama did fallen shortly, only a temporary fix. if you like the me as president, i will work very closely with congress to ensure that we do have a permanent immigration fix and then go ahead and dive into the economy and jobs, exactly what latinos need to hear. the likelihood of him doing that turn off the republican base i likely that would help him. when you look at the polls, when president obama did extend this executive order for dreamers, what happens what happened is that independent voters overwhelmingly supported him, not just latinos but american voters did overall. so i think it would give him an opportunity to break that shell saying president obama, what he did was a good first step but if you elect me, i will go so much further. >> jose, florida has been one of the more friendly states with the strong hispanic population for mitt romney but trailing among the voters in florida. new quinnipiac poll showing this. if a slumping economy is truly his only ticket there, is it smart for him to remain mum now almost a week after the the president came out with his executived or and the fact he has not deliver third type of response, rebuttal or specific plan? >> thomas, a few answers to the questions, i think you have to remember that the economy may be getting better in some part bus the hispanic community, remains officially at 11%. if you look at the unemployment among hispanics in places like nevada, in florida and california and texas it is even higher. so, that is a very important issue, the economy, the lack of jobs, the crisis in the home mortgage situation, for example, is a big issue. but i agree that he has the opportunity now, mr. romney to say -- maybe not say he agrees with president obama's decision announced last week but maybe he could say, you know what obama didn't go far enough on the important things, i'm going to go with what marco rubio has been working on, which is esense lay dream act light. a dream act light that would give these pple that are here, illegally, brought her illegally through no fault of their own with their parents, been here before they were 16 years of age and give them the opportunity to study and then work afterwards and essentially go for their residency. marco rubio has laid out a game plan that the republicans could take up as their standard bear around not be obama's, you know, agree with obama and yet have some proposal. so far, they really haven't had a very serious one. >> jose, didn't the announcement of president obama and the executive order basically take out any of the thunder or potential thunder that marco rubio could have had and delivered to the gop? >> yeah not so i thisty took out all the thunder that marco rubio had been preparing for. let me give you, if i could, something we don't often talk about in english. i love maria theresa's thoughts on this what the administration is saying in a goodwill form is saying, kids that have not been arrested, detained, they aren't on anybody's radar screen, the next 60 days, they can come out from under the shadows, say i am qualified to fall under the parameters set by the administration and they won't be deported but their parents could be deported and what essential think would do is rister the kids as being undeportable for two years but their parents that can be deport ready essentially going to be on the radar screen. i think those are little issues that politically could play in the latino community. but first, first, mitt romney has to say what he believes as far as immigration reform, which he hasn't really done. >> maria, has this made your job easier with voter latino to get people registered? >> people realize it takes technology to stop the bad guys. we identify security features inside of credentials and we incorporate that into our technology. what changes there is no longer going to be a bouncer at the bar door looking at your i.d. we operate over 100 military installations so we know what the security features are that are built in there the bad guys getting close, better, the ones out of china is really good p the reality is without technology, you are going to get fooled. >> when we talk about technology, technology is pretty much the advent that is probably putting more of this in all of our lives because people with get this so easily on the internet? and this is good advice for not only people in security circle bus parents out there thinking about their kid? >> exactly. so the issues you have is the technology was always there. i can make it better on a printer at home, buy them for $100 from china, the reality is there are security feature built into the document that we are not using to validate the credential. s the you mentioned earlier, they simply read that i.d. card, the barcode exmagnetic stripe it would have found it easily and quickly, we see it all the time. we have thousands of arrest. we have 60,000. do about 6 million scans a day at our military bases. we note security features. the security features are there, but if you are doing visual identification, you are not going to see them. >> how are the security features trying to stay a step ahead of what the formers and the sophisticated fakes that people trying to provide those, because it is big business? how is the security industry trying to stay ahead of that? >> two things. there's an associationed the association of motor vehicle administrators that group is formaled to help states stay ahead of the bad guys, have the security features embedded. we are the lab for that organization. before a state issues a credential, they send it to our laboratory, we grade that, about a 15-page document, not sample license, not 15 states, 4500 different credentials out there today. i don't ever reveal or disclose that library because that's the wholly grail that's where you can find the security features. >> steve williams, thanks for your time. really interesting. appreciate it. >> thank you. so he might be -- excuse me, might not be president of the united states, but he is still a president. time now for the policy sidebar. indiana governor and now former possible veep con tender mitch daniels is the new president of purdue university. daniels served as a budget director under president george w. bush and considering a run for the white house this year but decided against it because of family concerns. i'm gonna take first lady michelle obama, $100 please, alex. >> campaigning in 2008, i learned about problems of military families from jobs in education to wellness. later, gain the joining forces initiative to highlight the issues along with this woman, whose son is in the delaware army national guard. >> who is biden? [ yawning sound ] more than 50 times a day? so brighten your smile a healthy way with listerine® whitening plus restoring rinse. it's the only rinse that makes your teeth two shades whiter and two times stronger. ♪ listerine® whitening... power to your mouth. so as you've already heard both sides of the aisle have millions of dollars in superpac support this election year. there's one group out there with a unique message, incumbents beware. the campaign for primary accountability doesn't discriminate. lawmakers with an easy path to re-election are put on notice. one outside group is putting big money into disrupting the political system. leo linbeck is creator of the anti-incumbent superpac and joins me now. leo, good to have you here. really interesting, saying we know we've been tallying up from both sides about what they know about the superpac money out there. you've given $1 million of your own money and until recently hadn't voted in a primary election. why was this appealing to you? why did you want to get involved and do this? >> thomas, the root of the problem in congress is the cycle of incumbency. there's nothing wrong with incumbents or incumbency per se. congressmen should have to compete for their seat every time. the only place you can have that competition in 85% of the districts is in the primary. so we focus on creating competition in the primary and it's both parties. right? both parties have been responsible for this massive centralization of power in washington. so we're taking on both. >> so let's give an example of this. the campaign for primary accountability is against, as you talk about, this political entrenchment. it's not against experience. >> right. >> one example we have is sylvester rayes, democratic congressman in your state, lost his primary hurt in part by ads shown from the superpac. did you expect that kind of impact so soon? because of that, as an example, do you expect to see more of your effort working across the nation? >> well, we've always viewed this as a long-term project, right? this is not something where we can suddenly break the cycle of incumbency in one cycle. we've really tried to go in and figure out how do we take on really entrenched folks like sylvester reyes and show the voters they can get rid of these folks? he had a credible challenger, he was not popular in his district. normally he would have just won because he had money, name idea advantages. we came in to equalize the playing field and give voters a choice. >> leo, how do you want to frame your timeline, then, moving ahead, as you look ahead to get this movement to have more attention for the foundational message of what you want to do to bring back, you know, new voices, competitive voices, to the hill? what's the timetable for you? >> well, we think the really big opportunity is in 2014. we're continuing to work in 2012. we're continuing to learn, build our organization, our capability, but 2014 is the big opportunity. right now, everyone is focused on the presidential election. right? it's -- but we're not a monar y monarchy, right? we're a democratic republic. and what's going to happen is, whoever's elected, whoever goes to the white house, congress is still going to be broken. so in 2014, this is going to be really clear, and we think we'll be able to come in with two more years of preppreparation, come really big and have a dramatic impact on way congress functions. >> leo linbeck, thanks for being on. thank you for your time. that's going to wrap things up for me. see you back here tomorrow at 11:00 a.m. eastern time. until then follow me on twitter @thomasa.wallace. don't go anywhere.
