Americans without Health Insurance. The pared down bill would eliminate the mandate to buy insurance. Occupies the gop wants to vote quickly without holding lengthy hearings. Senators have been giving impassioned speeches. Heres a sample from democrat cory booker. Lets send this bill in to committee. Lets do this process as this institution was designed to have it done. Lets open the doors of the capitol and invite america to come, the american medical association, the cancer association, hospital association. Lets invite the aarp. Lets have america come down here. Lets join together like our forefathers and formothers have done to expand liberty, to expand opportunity, to extend hope. We can do that. All of us collectively have that power. And we get more on this developing story from fox news joel waldman on capitol hill. Good evening. Good evening to you. It is about 1 02 a. M. Obviously on the east coast. 10 02 your time. And weve kind of reached the moment of truth here. There were two votes set for early this morning, late evening your time. The first one passed. It was a procedural vote. The second one is really the one that everyone is keeping their eyes on but weve reached what appears to be an impass. Right now Vice President mike pence is making a case to senator john mccain who actually came out here from arizona after being diagnosed with brain cancer. Hes making a case right now to john mccain to vote for this socalled skinny bill and it could be the very last opportunity for republicans to repeal and replace obamacare. They deserve better than obamacare and its skyrocketing cost. They deserve better than obamacare and its plummeting choices. Reporter Senate Majority leader Mitch Mcconnells political career may depend on it, not to mention the healthcare of tens of millions of americans. As republicans scramble in the 11th hour, still searching for gop plan to repeal and replace the Affordable Care act. Please do not throw 23 Million People off of Health Insurance without hearing from doctors, patient advocates. Reporter in fact, republicans say their last and best chance at healthcare reform is a socalled skinny bill which would strip down key obamacare mandates, including repealing the individual mandate, revealing the employer mandate for a minimum of six years, and providing greater flexibility to the states among others. But even some republicans at this late hour are calling this skinny bill a political tactic and not sound policy. The skinny bill as a replacement for obamacare is a fraud. Whats so interesting about this is you just heard from senator lindsey graham. He and senator john mccain and a few others basically want reassurance from the house that they wont pass this bill. You heard me right, that they will not pass this bill in its current form. They just want to move it forward so they can then go and negotiate with the house about how to make this better so its not every day that you hear the gop or any lom pushing for any lawmaker pushing for a bill, just gives them an opportunity to negotiate with members of the house. Well keep following this and if there is a vote in the next 90 minutes, well have it for you. Amid the debate, President Trump cheered on his gop colleagues, tweeting go, republican senators go. Get there after waiting for seven years. Give America Great healthcare. Weve posted the text of the legislation. Youll find it on our front page. New at 10 00, three new cases of arson in antioch have investigators trying to track down what could be a serial arsonist. Fire crews were called to sunset drive just off of highway 4, one block from where an arsonist hit last week on hill crest avenue. Crews today were called to two more fires near the location of seven fires that investigators say were intentionally set last week. No one was hurt in any of the fires but a few of them did come dangerously close to homes and a church. Investigators say they do have some leads on a suspect theyre following up on, but so far no arrests have been made. A barbecue grill is being blamed for sparking a wildfire in lake county. Firefighters are making progress on the fire but it has destroyed three homes and several outbuildings. Crews say they have stopped the forward progress of the fire. Its burning on foothill drive on the northeastern shore of clear lake. The fire was first reported just after 5 30 tonight. A witness told our news desk that the three homes were destroyed in the first months after the fire broke out. One of the homes was abandoned. Another 30 homes in the area had to be evacuated. Air tankers dropped fire retardant from above. One person was taken to a hospital for treatment of a minor injury. New the south bay where homeless advocates are claiming victory tonight after the city of san jose backed away from a controversial crackdown on people feeding the homeless in a downtown park. Its a story we first told you about last month. Ktvus Azenith Smith is live now at st. James park in san jose. Why did the city have a change of heart . The city says they want to focus more on educating the homeless here at this park on how to get help and also educating the public on concerns with feeding the homeless before enforcing this ordinance. How you doing . Hows your day so far reporter its a random act of kindness for brandon. He decided to feed those less fortunate at the park in san jose. Because i understand, living out here in san jose is very difficult. Its very hard. Very expensive. And the quality of life for everybody is not equal. Reporter its food 57yearold Lavelle Moore relies on, but it stirred up controversy. Last month the sutd of san jose driven by residents complaining about litter and trash considered issuing citations in early august, enforcing a 2005 ordinance as stated on this sign, prohibiting food distribution. That plan drew outrage. On wednesday homeless advocates say the city told them theyre now backing down. Right now its off the table. Anyone who comes to feed can continue to feed and be free of fear that they might get cited. A spokesperson for the city of san jose points to eight soup kitchens downtown, four within walking distance of st. James park. She says the city is focusing on education rather than enforcement at this time. Were not here to Issue Citations unnecessarily. Were here to get the community to work together. I appreciate the city is willing to be reasonable. Were reaffirming their dignity and humanity and the churchs right to take care of the poor. Reporter advocates point to strong opposition from Church Groups and hardship from disabled Homeless Individuals to get the soup kitchen. Gilbert works downtown and has mixed emotions. A little disappointed the city is backing down given a few families are ever at the park. They have to put a stop to it. I know its hard for them but they do have to stop it because they are giving them like free rein. In the distance you can see Homeless Individuals are staying in tents here at this park and its 10 00 right now. Homeless advocates are pushing for a piece of land or property where they can get a permit and serve food. In the meantime, advocates are also starting a program, they want to start a program where they can clean up trash at this park. Azenith smith in san jose. Thank you. Lawyers for google were in federal court in oakland today defending the company against accusations of enabling terrorists. As ktvus tom vacar reports, a lawsuit was brought by the family of the cal state long beach student who was killed in a terror attack in paris. Reporter lawyers for the parents of nohemi gonzalez, slain in the paris terror attacks are suing youtube and Parent Company google. They charge youtube was complicit in the attack and deaths because youtube repeatedly allowed isis and its supporters to post many videos, sometimes with paid ads. U. S. Magistrate questioned both sides, but frequently challenged the parents lawyers claims. She was hard on us. She obviously read all the materials. I think she is going to very carefully consider everything. She asked us the tough questions and i think we answered them as best we can and shes going to ultimately make a decision. Reporter google is relying on the 21yearold Communications Decency act, a law passed long before most social media even existed. That law says that internet social sites cannot be held liable for things said and shown that was provided by others. The things were seeing in terms of the way that the internet is being used were not even imagined by the people who created that Communications Decency act. Reporter the lawyers argue in the world of worldwide internet, youtube should be responsible for providing isis and its supporters a platform they repeatedly use to practice and encourage terror attacks. Google maintains its immune from that as well and that the gonzalez case should be outright dismissed. After two solid hours of questioning and hearing the lawyers, magistrate ryu took the hearing for advancement that could be weeks or months away. That big book of cases in front of her, shes looked at this very carefully and shes going to look at it very carefully and i expect shell take as much time as she needs to write a scholarly, careful decision. Reporter googles lawyers refused comment before or after the hearing. Anything less than the outright dismissal would encourage more and more mega lawsuits. Congress also needs to reexamine the act if it feels it should make changes not contemplated when it was first written five years before 9 11. Tom vacar, ktvu fox 2 news. I am tracking the heat around here. Got hot today. Its going to be hot again tomorrow. Not as hot but it stays up there in the mid 90s. Well talk about that and the weekend. And blue green algae. Its blooming again and creating a toxic risk at some north bay beaches. The warnings going in to the weekend. Warnings are back up about toxic algae in the russian river. Sonoma county beaches will be open this weekend but visitors may want to leave their dogs at home. Debora villalon is live in heelsburg after talking with a dog owner who discovered the danger firsthand. These signs are posted along the Russian Reserve at the beaches advising about the blue green algae which weve seen elsewhere in the bay area. One pet owner warns where you see these signs, take them seriously. We were only in the river for a couple hours before she passed. Reporter its still pain frequently for brook to talk about posy, her 2yearold golden retriever who died on a float trip down the Russian Reserve. A trip brook and her husband had taken posy on before. I didnt see her drink any of the water. She was jumping in and out of the boat swimming beside us. Reporter they had no idea posy had contact with blue green algae which mixes with other river scum but produces a lethal toxic. Since dogs will play and swallow water and small children may put their hands in their mouth, for them its especially hazardous. Warmer water is more susceptible. And across california, lakes and rivers are seeing toxic algae bloom. We test 10 beaches along the russian river, the 10 most populated and frequently used beaches. Reporter Sonoma County found trace amounts at three beaches on its second week of tests. When we get up to the warning level, thats where we start saying perhaps people shouldnt be swimming in the water. Reporter its one of the spots with elevated levels. Like the other beaches, open but use caution. Theres the potential that the toxins are in the water so we want to encourage people to take precautions to protect themselves and particularly their animals. But other than that they should go and enjoy the river. So the weekend will be the tell i think, the proof. Reporter some who live near del rio beach wonder if the threat is well understood. Im aware of it but i dont know that everybody is. And i think people are just like, well, weve always swam in the river. Our dogs have always swam in the river so im not going to change anything. I think about her every day. Theres not a moment where shes not in my mind. Reporter brooke wishes shed gotten a warning. But summer before last, the threat was just emerging. Posy, who started the river trip a healthy dog, began convulsing and died in the canoe. She was shaking. It looked like she was cold so i was holding her because shes my baby and i love her. Reporter rudas insists no algae risk is worth it. You dont need to go in the water now. Just wait. Wait for the water levels to rise. Wait for warnings and other things to go away. Its not worth the risk. Since Sonoma County started monitoring, its never had to ban swimming or close beaches like some lakes have, but the river benefits by being a moving body of water so its always flowing and its not stagnant. Still, were headed in to the hottest months now, and thats when this algae blooms the most. You feel for that woman who lost her dog. And one thing i did learn today that people with pets should be aware, dogs are actually attracted to this algae. They seek it out. They want to play with it, chew on it. So its something theyll go toward which makes it even more risky. With her dog, it seems like it took very quickly. The dog died in the boat . Very quickly. Organ failure, respiratory failure. No recovery. No real antidote. It happens so fast. Pay attention to those signs. A sewage spill in to monterey bay has forced the closure of mackby beach. The beach closed Tuesday Morning and will remain closed until samples indicate the water there is safe for people to enter. Officials warn contact with water, contaminated by sewage, may cause severe stomach problems and other waterborne illnesses. Were tracking the heat around here. Temperatures really came up today. There we are on thursday. You can see the numbers, not the numbers but the trend has been way up there. Then on friday and saturday, tomorrow and saturday, temperatures will come down just a little bit. Its still pretty darn warm out there. These are the highs from today. We did see tripal digit heat in the valley. Highs tomorrow similar around the bay. I think it will drop one or two degrees. Going to be very minimal. The changes are very subtle. Outside we do have fog at the coast. We have fog trying to work its way in to the city. Across the bay. But its not going to have a big push. So you wake up and concord tomorrow, youre not going to have fog. Youre not going to have in richmond. Might have a little fog in berkeley and oakland. Burns off quick tomorrow and temperatures warm up. Thats sort of the plan for tomorrow. Let me jump ahead to the model. These are some of the temperatures. The winds are blowing basically in a lot of different directions. The microclimates tomorrow. In the bay youll be lots of 70s. Then low 80s and as soon as you get over the hill, temperatures roam rapidly tomorrow especially in the inland bay valley. Not upper 90s but mid 90s in the hotspots. 97 in discovery bay. New at 10 00, police are asking for the publics help identifying a man carrying out three murders. The man is described as black, 58 to 6 feet tall, weighing between 180 and 200 pounds. Police say hes from his late teens to 30 years old. Investigators say hes a person of interest in the killings of Lee Weathersby iii lamar brusard and derek harris. Weathersby was shot and killed on new years eve of 2013. Three weeks later, his 19yearold brother and childhood friend were both shot and killed as they sat in a car near their home in east oakland. Witnesses reported seeing a suspect leave the scene, possibly in a silver dodge durango. A 30,000 reward is being offered for information leading to arrest in these cases. A napa county mother and her boyfriend were sentenced today to life in prison without parole for the torture and killing of her 3yearold daughter. Caleigh was found dead at her home in february of 2014. An autopsy showed she had died from Blunt Force Trauma from being stomped and punched. the girls mother, 27yearold Sarah Lynn Krueger and her boyfriend, 29yearold Ryan Scott Warner were both tried together, but before separate juries for her murder. A judge today ordered a former contra costa sheriffs deputy to stand trial on charges he had sex with the woman at the center of the Bay Area Police scandal. Ktvus henry lee was in court in dublin today and has our report. Ricardo perez had nothing to say as he arrived at court for his preliminary hearing. He resigned after being accused of having sex with this woman, jasmine abuslin, who previously described herself as a sex worker. Cameras were not allowed in court as abuslin took the stand and testified against perez who must now stand trial on charges of engaging in a sex act with a minor and lewd conduct in public. In graphic detail she testified how he and perez met on facebook in 2015. She said at first the two exchanged nude pictures. She said the two later had sex at least six times while in the back seat of the car, parked in a scenic lookout in the oakland hills. She said she was only 17 at the time. She testified after she told him she was underage, his reaction was whatever, and that he didnt seem to be shocked at all. She said he continued to send her racy texts in both english and spanish. Burriss is abuslins attorney. Engaging in this type of conduct is clearly a person who took advantage of a very young woman and the sexual activities that he sort of enjoyed for himself was very exploitive. Reporter perez attorney joemata said in court his client didnt know abuslin was underage and she had told perez she was married with four kids. The defense attorney also said the pictures shed sent were provocative and adultlike not childlike. At one point the defense attorney asked abuslin if the former deputy did anything wrong to you. Abuslin said, quote, yes, what does the law call it . Statutory rape. For him, it was a very good thing for him. It was free and he enjoyed taking advantage of this. All this was unbecoming of an officer and very, very unprofessional and lacking in moral fortitude. Perezs attorney tried to argue that no one was around when they had sex in the back of the car with tinted windows. Thats the same argument that the former contra costa d. A. Used in declining to charge officers facing similar conduct. The judge disagreed with the defense so perez must stand trial. In dublin, henry lee, ktvu fox 2 news. Where the u. S. Senate right now is voting on the socalled skinny reform bill which would repeal key parts of obamacare. The key vote tonight is from senator john mccain. The vote is expected to be very close. Lets listen in. Mr. Sullivan. Aye. Mr. Taster. Mr. Tillis. Aye. Mr. Toomey. Aye. Mr. Udal. No. Mr. Van hollen. No. Mr. Warner. No. Ms. Warren. No. Mr. Whitehouse. No. Mr. Wicker. Aye. Mr. Wyden. No. Mr. Young. Aye. Weve just learned that senator john mccain from arizona has voted no on this effort to get this skinny repeal of obamacare. We had also heard Vice President mike pence is there at the capitol ready to cast the tiebreaking vote if need be. Its going to come down to the wire for Senate Republicans if they can get this bill passed here in the Senate Chambers. This could be a last ditch effort for republicans in the senate to repeal obamacare. Senators voting in the affirmative. Alexander, veraso. Weve heard if they are having trouble, they could hold the vote open for a while, possibly to try to twist arms. It could go until dawn. Its really good theater. The votes are coming now in rapid succession. The Senate Healthcare freedom act is essentially the Senate Republicans last dutch attempt to repeal obamacare and Senate Republicans here have framed this bill as a vehicle to simply move the healthcare process toward further negotiations with the house. Live roll call right here in the Senate Chambers. The republicans can only lose three votes. They have a very slim majority in the senate. If the vote is 50 50, then Vice President mike pence would cast the tiebreaking vote. Again, all this we think hinges on senator john mccain. He has voted no. They kept delaying the vote tonight, presumably to try to get john mccains vote but when push came to shove, senator mccain voted against this. This would repeal key portions of obamacare. It would then go over to the house where they would have essentially a Conference Committee trying to work out differences. A lot of people are saying if this doesnt pass here, this could be the last dutch effort last ditch effort in the u. S. Senate to overturn obamacare, something republicans have been promising to do for seven years. Push has really come to shove and so far at least theyve not been able to repeal and replace obamacare. Were waiting, hopefully well get a tally of the vote momentarily and find out whats going to happen with this skinny repeal. Theyre reading the no vote. Some of the provisions under the socalled skinny bill, repeals individual and employer mandates, provides flexibility to states, increases hsa contributions, repeals medical device tax, and funds Community Health centers. Give America Great healthcare. Lets listen here. Were hoping to get a tally momentarily. Youre watching with us live right now from the Senate Chambers in the Nations Capital here as u. S. Senators are underway. The roll call is underway right now on the socalled skinny repeal of obamacare. Mr. Cruz, aye. Sometimes there are a lot of different formalities and whatnot they go through with the u. S. Senate but the vote has happened. Theyre counting up the votes. And hopefully well get the results momentarily. Again, as we mentioned, the republicans need 51 votes. They can only lose two votes. Mr. Heller, aye. The key vote tonight, as we mentioned, was senator john mccain. Kind of a linchpin here. And he voted against this socalled skinny repeal bill. If it comes down to a tie vote, Vice President mike pence is in the house if you will, ready to break that tie. The bill would mean 16 million more people would be uninsured by 2026 than under obamacare. This is about as dramatic as it gets, waiting for this vote. Mr. Sasse, aye. Im not sure if this is the voting still underway. The vote is still open. We heard earlier they could hold the vote open if they were having trouble, possibly to give some of the leaders there time to try to twist some arms as this vote could go on in to the Early Morning hours. Well continue to watch this and monitor this in the meantime, and if anything happens well of course bring it to you. We want to get to some other news right now. The vote is now in on that socalled skinny reform bill and it has not passed. Again, well, lets listen to senator Mitch Mcconnell. For the endless amount of time that they spent trying to achieve a consensus to go forward. I also want to thank the president and the Vice President who couldnt have been more involved and more helpful. So yes, this is a disappointment. Disappointment indeed. Final vote here, 5149. The house, we thank them as well. I regret our efforts were simply not enough this time. Imagine many of our colleagues on the other side are celebrating. Probably pretty happy about all this. But the American People are hurting, and they need relief. Our friends on the other side decided early on they didnt want to engage with us and in a serious way, in a serious way to help those suffering under obamacare. They did everything they could to prevent the senate from providing a better way forward including such lengths as reading amendments for endless umths of time. Such things as holding up nominations for key positions in the administration because they were unhappy that we were trying to find a way to Something Better than obamacare. So i expect theyre pretty satisfied tonight. I regret to say they succeeded in that effort. So now i think its appropriate to ask what are their ideas . It will be interesting to see. The weather headline besides being summer, but the weather headline is going to be hot inland for the next five days so when i say hot inland, well see upper 90s, mid 90s, really right through the next five or six days so thats going to ratchet up the fire danger in places like livermore valley, stockton, sacramento, davis, fairfield. Around the bay at the coast, well stay where we are, warm to very warm in some areas. But bearable. No heat advisories or anything like that. Inland the heat stays on. High builds out of the east and its going to continue to pop the temperatures inland so really tomorrow over the next day, by the time we get to wednesday or thursday of next week, were still going to see big numbers in the central valley. Sacramento, multiple days of upper 90s and low 100s. So thats a big fire danger concern obviously because youre just drying everything out. Well watch it. Im just pointing out something youre noticing. These purples are going to hang out deep in the valley, but really for the next four or five days. But around here well have mild around the bay as youll expect. Get your heat inland, walnut creek, pittsburgh, 96 in antioch. In the santa clara valley, upper 80s. Air quality will start to take a little bit of a hit too as things start to gunk up. But well have our sea breeze. Our sea breeze should kind of keep going and we should have fog at the coast. Areas around the bay as typical for this time of year. Well have refreshment. But you get up there to stockton, fresno, its going to be an extended heat period for them and thats going to cause problems for cal fire without a question. So well be tracking that. None of this is exceptional. Its the duration that becomes a problem. Already been some really serious fires so far. Were just getting in to it. Tomorrow is a big day for tesla motors. This one says share a smile. Aww. Thats pretty cute. I imagine theres a rock out there that says javale mcgee is going to stay with the warriors. Obviously they still have to play the games but you could make a strong argument that the warriors 15man roster, all signed, sealed, and delivered possibly the greatest ever assembled in the history of the nba. Top to bottom theyve got major talent, welcome back javale mcgee. That was javales message to the fans today, smile on his face for wherever he was vacationing. 7footer who turned in to a big time fan favorite signs a oneyear deal around 2. 5 million. Thats the veteran minimum. And 15 signed contracts, welcome back indeed javale mcgee. Meantime, the globetrotting of steph curry continues. This time he involves his wife ayesha as they make it to south korea on their underarmor tour. Pretty nice alleyoop from ayesha to husband stephen curry. That was a first try right there. Stephen curry getting the dunk down in south korea. Meantime, ill tell you what, this has been a devastating, heartbreaking road trip for the as. One after another. You thought last night was bad . Check out what happened to them today in their finale in toronto. First of all, 30 lead. The jays seemed to get pumped up after john gibbons, their manager, gets ejected. But it gets even worse from there. Marcus stroman on the mound, throws a pitch thats called ball 4. Stroman says something to the umpire. Then the catcher Russell Martin says something. One pitch, two ejections, three total. The blue jays look in disarray but they do come back. Justin smoak didnt hit it hard, hit it in the right spot. Thats an rbi single. It ties things up. However, things take a turn for the as. Marcus semien starting to swing the bat again. 34. The rbi single here scores jacob brugman. The as will take a 43 lead in to the bottom of the 9th inning. No santiago garcia. Kendrys morales who hit the walkoff last night in toronto for the jays ties it with a blast to deep center. Bottom of the 10th, it gets even worse against liam hendricks. Steve pierce with a shot down the left field line, bases loaded. Yeah. This time its a walkoff grand slam and the as wind up losing 67. Its fair, buddy. Circle the bases. And the as do lose a heartbreaker in a game that was much closer than an 84 final would reveal. Pretty good time now to change the suspect to football, which a lot of baseball fans around here are looking forward to now. Training camp opening for the raiders tomorrow. Today the 49ers show up. Big joe on the offensive line ready to go with lots of others hoping to make the team and help this Team Turn Things around when youre talking about the San Francisco 49ers, the subject of quarterback always comes up. Brian hoyer as of now is the man, although these rumors of kirk cousins continue to persist but this guy is happy to be the number one quarterback at least for the meantime. For this hopefully resergeant organization. For me, like i said, to be able to go in to training camp, not have to worry about a quote unquote competition. One of the reasons i came was to be with kyle. Now being around him as a head coach for a full season going in to training camp, i think everybody is really excited. I know for me personally this is probably the most excited ive been going in to a training camp. Weve arrived at that point in the evening where we must check this out. This is the first pitch in philly tonight. Harlem globetrotter style. Ace jackson, watch that spin in the basketball, throw in the baseball. Shes from philly and im sure they loved her performance tonight. We take you to st. Louis where they appreciate good baseball even when its done by the opposition. Jake lamb in to the stands with the beautiful catch. The ump says yep. In the stands he hung on to it as you check out the replay among two little kids who also wanted to make the play. The big leaguer did it. Thats how you do it. Heres how you dont. In san diego tonight, a fan a little overzealous going after the ball, but hes tenacious. He comes up with it. The lengths fans will go to to come away with a souvenir. Here we go to yankee stadium. Brett gardner. Walkoff home run to win it for the yankees. He comes to the plate. Aaron judge, the big hero. As they celebrate, he gets hit by gardners helmet and out flies his front tooth. You can see it circle there. He loses a tooth. The yankees trainer said that was the only injury he sustained but he leaves the celebration holding his mouth. Got to be careful on those postgame sometimes overzealous celebrations.
