Good evening everyone im frank somerville. Im julie haener. The wet weather has made a return to the bay area. This is a live look at oakland where the rain is coming down. We get ready for a wet morning commute. Here is a look at Storm Tracker 2. Chief meteorologist bill martin is tracking it all for us right now. Yes, a fairly light rainfall event. The most i could find was up in the north bay. Most of us getting. 1 or less. Those are some of the total inches. Pretty light rain event and how it goes into tomorrow morning. Tomorrow morning well have a few light showers. Well have a little morning commute. And then i think you will have a wet afternoon commute. This is just kind of the interim between now and the bigger storm which is coming as we head into tuesday. So as you look at the current radar where the scattered showers are, where they are not theres a winter storm warning in effect. Right now the showers are just pretty much all over the place and thats how it will go tomorrow morning and their morning commute be prepared for wet roadways, not a heavy windchill wiper deal. But thats how the forecast at 8 00 a. M. Tomorrow morning and youll see how they would get, but the roads will be wet and a Little Valley fog tomorrow. Tomorrow will be the transition for the stronger storm that shows up on tuesday. All right bill thank you. We have developing news right now in the east bay where police are investigating a deadly officerinvolved shooting in fremont where they are still closed at this hour following that shooting. Leigh martinez ktvu has been gathering the information joining us with the latest on the investigation. Leigh . Reporter well ten minutes ago i would talk to fremont police. The latest he can give me is that the officer who was involved in this shooting has been treated and released from the hospital. Out here on the scene they are still waiting for the coroner to show up to help aide in their investigation. What we do know there was a police call to the area as several officers responded. Fremont police would call it an altercation, but didnt elaborate any further on the investigation of the south side of murray avenue. Fremont police say fremont officers shot and killed a man after confronting him. The officer was taken to the hospital with medical attention, but his injuries are still unknown. We just know theyre not life threatening. There is also no gunfire exchange. The officer was not shot. It is unknown if any weapon has been recovered. There were some kind of incidents occurring, an altercation. One of the officers actually contacted one of the subjects involved. That area is location that area and low saying is where the suspect was actually shot and pronounced dead at the scene. The officer himself was also transported for medical attention. As a result of that incident. Reporter and now the sheriffs corner will be coming out to assist in their investigation as they say there are no outstanding suspects so there is no Public Safety threat. And now murray avenue will remain closed tonight. Its closed from blake hall road up the way and then all the way down two blocks to logan drive for this investigation. Theyre saying it will take several hours. Fremont police say this is the first homicide they have had for 2017. Leigh martinez in fremont tonight, thanks, leigh. San francisco upheld a ruling that set aside President Trumps executive order on the travel ban from seven muslim countries. There is a legal deadline in less than two hours in the fight over the president s travel ban. Ktvu ken wayne is here with the latest on that deadline and plus some statements made by President Trump on fox today. Reporter call attention on the federal 9th Circuit Court of appeals in San Francisco. That court denied the Justice Departments request to reinstate the president s travel ban. But it is asking the challenges of the ban to respond to the Justice Department appeal by midnight tonight. For his part President Trump thought the immigration ban was going well before the courts stepped in. I think it was very smooth to have 109 people out of hundreds of thousands of travelers. All we did was vet those people carefully. Still the president has tweeted anger at judges who ruled against the ban from seven mostly muslim countries. He must take action against california where lawmakers are considering legislation that would make california a sanctuary state. That could prevent local authorities from assisting federal immigration officials in certain cases. And so defunding is your weapon of choice . Well its a weapon. I dont want to defund anybody. I want to give them the money they need to properly operate as a city or a state. They could have sanctuary cities, then we may have to do that. Certainly that will be a weapon. On the other issue refusing to criticize russia. Instead offering some praise for president vladimir putin. I do respect them, why . I respect a lot of people, but that doesnt mean im going to get along with them. Hes a leader of this country. I say it it will be better to get along with russia. If it helps us, which is a major fight and islamic terrorism all over the world. Right. That is such a good thing. Will i get along with him . I have no idea. But putin is a killer. There are a lot of killers. What you think our country is so innocent . Reporter the president watched the super bowl this evening in florida and Vice President mike pence says the Trump Administration intends to move very closely as they will need to make all legal means to stay a federal judge. And declining to reinstate that travel ban. They are trying to decide who would have access frank and julie . A 12yearold girl got caught up in the travel banned, where it was suddenly shattered. She was able to complete the trip and she arrived at the airport today to big hugs and a tearful welcome. Ktvu Azenith Smith has her story coming up in about 20 minutes. White is in, patriots win the super bowl the new England Patriots completed the greatest comeback in super bowl history. They came back to win 3428 in overtime. James white scored the winning touchdown. Its the First Time Ever that the super bowl has gone to overtime. Fox reporter joel waldman was there finish the action for the action. It must have been something to be there tonight joel. I dont know what i did to deserve this. Man oh man they are in par with each other. Which was better, it is too hard to really categorize that. But this was super bowl li. First it was the first super bowl to go into overtime. For tom brady the first quarterback to ever win five super bowl rings. Same deal for coach Bill Belichick. Now Bill Belichick could be kind of a sturly fellow. But actually caught a glimpse of him in the tunnel down here just a short time ago as he was heading out to the after party. He was smiling from ear to ear and that is not something you see every day. So obviously this was just a historic win here coming back as you said from such a major deficit down 213 at the half with them in the Third Quarter down 283. And they came back with 31 unanswered points to win super bowl li in dramatic fashion, frank . Tom brady is the greatest quarterback. Im curious as you mentioned bumping into Bill Belichick there and other celebrities while you were at the game tonight. I got to take the elevator up with usher who was a complete gentleman. But first only on fox 2 the janitor who made more than a quarter of a Million Dollars. Up next the Surveillance Video and town cars raising questions about management tonight. Its a 2 investigates exclusive. What happens when a bart janitor made more than a quarter of a Million Dollars . What was he doing to make all that money . Where were bart managers when he and nearly 50 others were cleaning up . Do you feel you are doing your job . We are talking about hundreds of thousands of dollars here paid out to janitors. Its been going on for years now. Ross palombo uncovered serious issues on a story youll see only on fox 2. Bart says those janitors get paid 60,000 a year. How did he make more than 250,000 in total compensation . How did nearly 50 others make more than 100,000 . They say it is overtime plain and simple and they would check with the the supervisors to make absolutely sure. But have those managers themselves been watching closely enough in managing your public money correctly . We investigated so you could be the judge. Sir, we just want your side of the story. A tightlipped janitor. An outrage analyst. And bart managers are trying to explain. Were not going back there. Reporter trying to stop us. Do you feel you were doing your job correctly managing money . Even trying to walk out twice. The best we can. While serious conditions about their management and your money remains. You have that mike on. But the squeals of the possible problems would began at their powell station. And as thousands of passengers moved through the dusty and sticky trash station. They also saw this custodian screening and cleaning and mopping. The price of their service in 2015 was 57,945. The riders are paying for it. Reporter but they are actually paying much more. While looking at all public salaries across the state, transparent california found this one janitor made an additional 162,050 bringing the total salary ask and benefits to 2015 to 271,243. Quadruple the salary to overtime. Have you ever seen anything like that . Not at all. It is completely outrageous. 2 investigates plotted it out across the calendar, discussing bart paid zheng in 2015 and sometimes for sick leave location every single day. The win overtime are almost always 17 hours long and many times paying 943 per day at one point in fact. Bart records showed he worked 17 hours a day for 18 in a row. Super human. You know that is it. Is that even possible . The average reaction is how is that possible . Most people say no to additional work with the exception of one disinservice worker. Reporter bart says there is so much work and so much overtime because of this. Again . Again and again and he says the homeless are overwhelming the staff and overwhelming their duty. Their primary duty is to come here and clean urine, okay . Feces. Theyre making up multiple numbers a day, which are unacceptable. That he says to make hundreds of hours of overtime acceptable. People are not raising their hands saying they want some of that overtime. He is saying yes, he has worked hard and completed their assignment, so i would stand by. Have you ever checked on him in four years . No. Reporter but 2 investigates checked it for him twice, randomly expecting the Surveillance Video system. While we see him working, mopping with this machine and emptying the trash, cleaning countertops, we did not see him at the elevator that is his primary duties. Their primary duty is to come here and clean urine. We do see him working on the phone with a coworker. Sandy around here and in and out of this door over and over again. There is nothing, but equipment back there. That is not their office, so that they seem to be spending a lot of time back there. What is it . Is it an office or a storage room . What is it . We are not going back there. Reporter but it appears zheng goes back there and often. Zheng goes in there in the morning and then two hours later he appears to go in there at 10 59 and the same thing on this day as he goes in and comes back out at 3 44 an hour and a half later. Then again for an hour and 18 minutes. We asked him about it at the same door. Why do you have so much time in your closet, sir . We have you on tape spending hours inside that closet. Yeah, two hours and one day. No. Yes, we do. Are you working inside the closet. Yeah, i was working there. How are you possibly working 17 hours a day . Is that possible . Then again he disappears behind this door. Why is one of your janitors in the closets for more than an hour during his shift . I dont know. Reporter barts general manager says she has never seen the video. This is the time card data. And has never seen this sample of the time card where their own record shows they failed to punch out to verify their hours again and again and again, this is just in two months, so knowing that is that concerning . Well this piece is news to me. Yes, it will be concerning if we had an examination with the supervisor and there wasnt a good reason for that. The supervisor did approve it, but there is no extensive numbers from the audit. And where he made more than 705,000 and pay and benefits. Police were generous. And there has been no audit for 49 other janitors who bart confirms they also made more than 100,000 in 2015. This has been going on for years. Is there a problem there . Absolutely. I would say catastrophic. Do you think they deserve an audit to see whats happening . Not on the face of it. So we are talking about the overtime . We have increased their staffing two years in a row. We reduced that overtime the past year and we would reduce the number of years for overtime. I appreciate the time. You have a mic on, maam. Eventually she left and despite giving up the list it is very hard to get past number two right now. Reporter they say zheng might have worked their way down to number 11 and 20 and might have cleaned inside the closet for two hours a day. And despite for saying this. No, the break room is over here to the left. Reporter bart also said zheng might have been taking the 30minute break inside the closet for a part of the time. Despite their own Surveillance Video, bart says it is not certain zheng is in the video saying it is obvious he is in some. This is the cleanest i have ever seen it. Since the investigation began it has been. I do agree with those levels and those standards are not good. Reporter and while they maintain that highpaying janitor is squeaky clean. We will have it. It they do admit some kind of deeper cleaning might soon arrive. They will show you what they are paying for others. Thats what we want to do with management situation. Despite everything we have shown bart, tonight they still say no audit is warranted. For certain they are working and they said those three time card issues could be a mistake, but bart also says there have been 16 mispunchs in the last two years. Experts are telling us just three a year would be concerning to be with them. They hired 25 janitors, they have hired that many in the last three years, reducing their overtime in the past few months. The overtime certainly was reduced since our investigation began in november and he still made those as far as they could tell in overtime. The total compensation and it was 210,000. A lot of money as i want to point it out though, critics say they dont have a problem with the janitor making that much money if he is working the hours, but critics are all pointing to management saying they should have a better handle on the situation and not allow this in the first place. You mentioned bart has hired more janitors and the overtime rates are coming down . But it sounds like they could stand to hire a whole bunch more . Yes, in years past this has come up. They said it is simply an overtime issue and it would be more expensive to hire additional janitors at all the hr experts we have talked to who say that is simply not the case to hire two or three janitors for what they are paying this june janitor and most likely getting more work out of them because they will not be exhausted in working 17 hours a day sometimes for weeks in a row. Do they have any regulations before they could to prevent them from working this much . You think that there would be. Working 18 hours or 18 days in a row. But bart says there are noisy regulations or state regulations and no federal regulations to stop any of the employees from doing that. All right, thank you. Sure. Tomorrow morning will look a lot like the glaze on the roadway and a little bit of moisture coming from the sky. But the main system went through the area a few hours ago. The frontal band with scattered showers behind it. But look at where this is coming from with a low latitude of stretch in the moisture that will red the will be in the red. It is kind of warmer out there with the scattered showers throughout the place for san jose with some activity. Fairfield with heavy activity. That radar footprint is how the whole night into tomorrow is going to go with scattered showers right through tomorrow afternoon. Overnight lows tonight, another day time high in the weather event. So 53 is the overnight low in vallejo. 50 in liverpool and antioch. 51 tomorrow morning. Theyre going to get some breaks, but just enough to slow down your morning commute. He has not been seen in four years and the mom was born in yemen and they live in los banos. She was granted a visa and on her way to central california. Her journey hub last week was halted because of Trumps International ban. Leaving her stuck. Finally we have finished with the process. She is finally back home. I appreciate all your support. I agree with you. It was a great game. I wish the odds were a little better in them. Maybe its the wrong year for humor and sometimes the writers, you know, they just dont have it or the actress dont have it. So i think while we had a few that are probably about four we could think of that are really good. Kayla was funny and mr. Clean was pretty funny as well. You know it wasnt the year for them. What do you think with this year with a political sense. More of a social impact and political undertone to them. Have you heard reaction as to how people are reacting to those in particular . Yes, you have quite a few, budweiser, airbnb. Most are positive with a lot of blowback though for, example the 84 lumber, which we dont know out here. An audi specifically is an interesting conversation. Those are the ones that will be talked about tomorrow, probably not the funny ones. If you were advising a company who wanted to buy it out in the super bowl that is a very powerful thing. Would you advise them to do that . You know, i wish i could say. I would, hopefully i would in that situation that is a bold statement to make and the fact they dont do too much in advertising and instant 15 million to find that block of the media is exceptionally bold and they would pay it off. Highly produced ads for the money theyre spending. If there is one thing you would have liked to see them tonight how would that have been . I think the country probably wanted to last a little bit more and i think it will be better. More humor. You know thats what people will need to do to come to the super bowl to watch the ads. I have to say that is exactly how you would feel to give them the overall great. I know im speaking to the real player, but what would be the overall greatness . Solid for pregnancy and average. They helped those locate an arsonist who set this parked car on fire. The vehicle was found on fire in fruitvale and seventh street.
