This is light stuff. 04 in richmond. San jose,. 03 of an inch of rain, so not a lot of rain, but enough to wet the roadways, slow things down, help the firefighters. Going to help fuel moisture. You can kind of smell it out there. The current imagery shows where the rain is occurring, mainly south of san jose in the monterey area, down toward salinas. That should be the end of it right now. A few light sprinkles later on tonight, then its over, and temperatures go the other way. They start to warm up. Turn to the ktvu weather team. The northern sierra in the past year actually had a slight improvement over last year, with precipitation at 75 of normal. The southern sierra, which in part serves the San Joaquin River watershed. Everyone is hoping that this el nino year will bring that rain and snow to where it needs to be, which is up in the sierras, where we store a lot of our water and snow. Now to washington, where president obama signed a spending bill tonight, which means the nation will avoid a government shut down, at least for now. Congress passed a stopgap measure a few hours before tonights deadline. The temporary spending bill finances the federal government through december 11. It gives democrats and republicans 10 weeks to negotiate a budget bill that would last past the 2016 president ial election. The fight over funding for planned parenthood was not resolved either. A new National Poll shows donald trump, and Carly Fiorina leading the pack of republican president ial hopefuls with the next debate less than a month away. New information on who might be left out of that debate, and another deadline tonight that is putting tremendous pressure on candidates fighting to stay in the race. Experts say its critical for the candidates to raise money, so they can stay in the game. With the field likely to shrink in the coming months according to teri bimes. Late today, the coroner says there were no signs of foul play in the death. They identified the inmate at 33yearold wallet roches. In oakland, they gathered to pay tribute to a man shot and killed while he was painting a mural under a freeway overpass. Also the special tribute planned for where he died. On a gray, drizzly day, a steady stream of people have been visiting the scene where the shooting happened. The 27yearold artist was shot to death while painting aal under an overpass. He wasnt painting, he was skateboarding, or helping his mom and dad out. But he was the type of person. He was a sweetheart. Im going to miss him. Reporter this morning, hundreds of people held a vigil, includes family, strangers, and fellow artists who worked on the mural with ramos, and were there when she was shot after a brief confrontation with someone who came by on foot. She did not want to go on camera, but said her family was overjoyed by the outpouring of community support, and that its been wonderful for the family, and she had these words for her brothers killer. Reporter some are getting creative. One woman said she is building an addition to house her three grown daughters who have good jobs, but cant afford rent. So that they can still live in a good quality place. Close to home, thank god. At home. You know, its just a sign of the times. The woman we talked to who is building that addition for her daughter says at that price, she fears her daughters will never know what it feels like it to own a piece of the american dream. Reporter yeah, its a proposal right now to have people who are arrested, just arrested, not convicted for a felony crime evicted. This wouldnt get here until probably late november. The councilmember told me there is still a lot to do. To make sure that if police are called for Domestic Violence and they arrest one spouse, that the other spouse is not evicted who might be a victim. Wall street staged a rally on this last day of the third quarter, but it still ended up going a quarter to forget. The nasdaq added 100, and the s p 500 was up 35. Now to a disturbing discovery in the Oakland Hills. A man on a morning bike ride finds a man dead. His body lying on the side of the road. Henry lee now with what investigators are saying about this victim and the one scenario being ruled out. Found a man down, bleeding from the head with a bullet casing next to the body. Near the speed limit sign. Reporter minutes later, officers arrived and confirmed that a man in his 20s was found dead. Although violence in the Oakland Hills is relatively rare, its not immune to body dumping cases. In todays case, police said the bullet casing found at the scene suggests that the victim had indeed been shot at that location. Neighbors who live in the area said they were surprised by the violence, given that the neighborhood is not known for shootings, or homicides. We would never have been concerned for my safety here. Drivers with less serious infractions will be able to pay 50, to 70 of what they owe. People who have had licenses revoked because of nonpayment would be able to reapply. But drunk driving, and reckless driving individuals are not eligible. Thousands of dollars in stolen property. Police say michael dehete was pulled over for a vehicle violation. He then led them to a Storage Facility in pacheco where even more stolen items were recovered. Investigators say the stolen property could be connected to more than ten vehicle and residential burglars in several east bay cities. Dozens of Senior Citizens in moran are facing off with state and federal wildlife officials over a duck named juanita, and whether shes a wild animal, or a pet. The duck was adopted by two People Living in the belo gardens facility shortly after she hatched. But a couple of weeks later, she disappeared during a storm. The Senior Citizens want her back. Reporter it may be called Community Court, but unlike real court, there are no court stenographers, no court certified translators for people who dont speak english and the program is run by a for profit company. Some say those are real concerns, but found this is gaining support. Reporter arrested for the first time. How are you feeling right now . A little nervous. I definitely learned my lesson. Reporter popped for petty theft at macys in concord. Then, she got a letter from the city. A chance to make it right without facing a judge for a price. Were not using her name, but she allowed us inside her Community Court hearing in this Conference Room at the Concord Police department. Her punishment . 700 for the shoplifting, in exchange for police not sending her case to the d. A. For formal criminal charges. Concord is one of four cities in Contra Costa County, signed up with Community Court services. A private company used to resolve low level crimes from petty theft, to vandalism, to public intoxication. Keeping cases from piling up on californias already overburdened justice system. You understand this today is voluntary . Correct. Why did you elect to do it . Well, i didnt have a choice. Reporter if she sounds confused youre dealing with people who are not in the court system. When you have a system where theyre getting notified by a Police Agency that, hey, if you want to pay this fine, show up on this date, and then you wont be prosecuted . I think thats somewhat misleading. Reporter misleading, because prosecutors are unlikely to ever file charges on some of the low level cases in the court. It seems to me is really a money making scheme. Never been revenue for the city. Reporter attorney Michael Hinckley while a rent report found walnut creek makes as much as 80,000 a year in crimes. Hinckley says no one is forced to pay. A person can decide not to participate, and receive no negative consequences. Except for maybe it going to the d. A. s office. Sounds like a pretty good deal. Reporter Allen Cantando says his city wont be part of the program. I feel that our role as a Police Department is to make arrests, write police reports, send them to the attorneys office. Reporter when Antioch Police captain, sat in, he observed there was no court reporter, and a Spanish Speaking offender had to rely on interpretation from someone who was not a interpreter. She couldnt even formulate the right phrase to explain exactly what was being said. Larger cities are not really participating. Reporter enough to raise questions about due process at this meeting where Antioch City Council members voted to not participate in Community Court. Every step of the way theyre told this is voluntary. Its really a win one win. Reporter Sergeant Russ norris says Community Court has been a success in concord and the city is actually looking to expand the program. He dismissed concerns about due process. This happens predue process if you will. Doesnt due process start at the point of arrest. Certainly. Blue with regard to the court system. Reporter a resolution, somewhere between crime and punishment, that more first time offenders could be asked to choose. I checked with the other 14 cities in Contra Costa County that have been told to at least start considering a Community Court program. Three have decided to pass for now. But several other cities tell me theyre interested. In fact, lafayette, and moringa are looking into a joint community program. The woman for the theft, was charged 700 to make it go away. I get that its voluntary, but it seems like it would favor someone who has money. If you dont have 700, you dont even have the option of doing this. The point that was repeatedly made to us from everybody involved in this program, frank, is that its voluntary. At any point in the process. Even at the point of getting the fine, you can back out, and say, go ahead and file with the d. A. s office. Well see what happens. Ill tell you that we spoke to the district attorneys office, they say the program works. The departments who are using it now say theyve actually been able to reduce the number of reoffenders. So theyre in favor of this program. Once it gets to the d. A. s office, its too late then. I cant decide to pay at that point. At that point, the d. A. Decides to make a decision whether to file. Rebecca caplain is calling for a measure that would require landlords to pay relocation costs based on a formula that has yet to be worked out. It was found this summer on private property in Mountain View, but only turned over to police this week. As you move up the coast towards raleigh, and toward the carolinas, still a category 2. So this storm, this is on sunday. Late saturday into sunday, monday, this storm is going to have big impacts on the coastal areas of the northeast united states. Thats going to have an impact on anybody traveling that way. You can tie it to el nino if you want, but all of that subtropical moisture, all of that water in the pacific is creating cloud cover. Hurricane storms, and that cloud cover gets in the atmosphere and drifts up here and creates these stunning sun sets. The last three or four nights, the tropical clouds do that.
