Janine de la vega is joining us live from san jose state with more on the story. Jeanine. Reporter the news came as a shock to many students. A lot didnt even know about the allegations. A university spoke comsays two female students came forward in september saying they had been raped by a freshman water polo player at an offcampus party over labor day weekend. San jose state issued a temporary suspension that prevents the athlete coming on campus or attending any events including team practices. He has been not aarrested but the District Attorneys Office is reviewing the case. Students are frustrated that the university did not inform them about the investigation. Its kind of strange that they didnt let us know before because i think its something that we should know as students here. Its the policy they should tell us. Especially on campus, its like one of those topics that come up a lot. So by knowing youre more alert and more aware about it. I think you should definitely like it should definitely be heard about, you know. Reporter the accused student is not from the united states. And the University Officials say he apparently left the country. San jose state did not issue a crime alert because Campus Police who interviewed him didnt think he posed a danger. Were told that the alerts are issued when the suspect is unknown and at large and the Community Needs to take action immediately. But still, you know, back to you guys. This is just still very upsetting to some of the students. They just dont agree with how the university handled this. They wanted to be told sooner. No doubt. Thank you, jeanine. This comes a month after brock turner was released from jail. Brock turner the former stanford swimmer was accused of sexually assaulting a woman at a party. He was released from jail three months after serving a six month sentence. It inspired change to californias laws against sexual assaults. One bill expands the Legal Definition of rape. Another prohibits judges for giving probation for those convicted of assaulting an unconscious person. The u. S. Justice department will release its report on the San Francisco police department. It was launched after the shooting of woods last december. Alex savage joins us live from San Francisco. This report is being released at an interesting time for the department. Reporter yes, certainly. The sfpd facing a tough period right now. A transitional period, if you will, with an interim chief in place. We should point out that following the shooting death of woods last year as he was holding a knife, he was shot and killed by officers. After that shooting, mayor ed lee asked the department of justice to conduct a full review of the San Francisco Police Departments operations, particularly looking at the use of force by officers and the department of justice will be revealing those findings officially later on today. And also offering quite a few recommendations for changes. Now, this all comes amid a tough time for the department. Tony chaplain has been acting as the interim chief after the chief stepped down after controversial officerinvolved shootings and accusations of Excessive Force against people of color. I got off the phone with a pastor here in San Francisco that serves on the African American Advisory Board here. He says this outside review of the department will be critical to making changes. We cant put an importance on that. Because it doesnt come from an internal source. And we can take this report that we have requested not only from faith based organizations but a lot of different organizations wanting this to happen. And were glad that it did. And were going to fight to make sure that everything that is recommended in there is implemented. Reporter and in the meantime, we also may be close to learning who will become the permanent chief here in San Francisco. Tonight, the Police Commission will be meeting and will reportedly name three to five finalists for that position. And then at that point, the mayor will make his selection from those finalists. Theres no doubt that that decision could be influenced in part by the findings in that federal review. And of course whoever takes over, is the top cop here in San Francisco, will have to look at the results of this federal review by the department of justice and look at the recommendations as well moving forward. The official announcement will happen at 11 00 this morning. It will involve the mayor, the interim police chief and members of the department of justice. Officials dont expect to make a hire until early next year. Right now its the open application period. They will screen candidates next month. Monte francis takes a look at two tax proposals and a move to legalize Recreational Marijuana. The tax and prop 55 is not new. But an extension of a tax increase approved by prop 30. Prop 55 would extend that income tax by 12 years but only for californians earning more than 250,000 a year. It would generate 4 to 9 billion a year for public schools. And 2 billion a year for health care for low income patients. Prop 56 would also help fund the states med ecal program. The proposes increasing the tax on a pack of cigarettes from 87 to 2 to 2. 87. You might think this is steep but california has one of the lowest cigarette taxes in the country. In new york, for example, the tax per pack is 4. 35. An equivalent tax to also apply to ecigarettes and tobacco products. If it passes, the measure would bring in an additional 1 to 1. 4 billion to state during the next fiscal year. If prop 64 passes, california would become the fourth u. S. State to legalize the use of recreational miles an hour. It would allow adults 21 and older to possess an ounce of marijuana and allow individuals to grow as many as six pot plants. Voters turned down a similar measure in 2010. This time the initiative was partially bank rolled by former facebook president parker and gavin newsome. And thats why the Richmond Bridge commute and other commutes into marin look like this most mornings. Prices are getting so high in the rents and the sales. Its impossible to make ends meet under a certain income level. Reporter in pricey marin county, Real Estate Experts say prices are up 25 to 30 since 2007. When youre talking the median price being a million one. When youre talking average rents for a twobedroom being 2,800, try to do that on a regular salary working at the malls or wherever these jobs are. You know, underneath a very high level job, you simply cant afford it. Reporter since 2007, the price of a two bedroom apartment in san rafael has risen from an average of 2,575 to 32. I live down in novato for about 30 years. The cost of living went way up. So we ended up moving. Her drive to work is about 45 miles. Businesses are affected too. Don says he relocated his Construction Business across the bridge in large part because it was more affordable. Running out of space in marin that is affordable to have some type of construction yard. Reporter now his trucks are on the bridge in slow traffic like everyone else. And the slow traffic is also keeping people from spending money in businesses anywhere near the Richmond Bridge. Merchants at the marin country mart have noticed the drop were hurting from that time, 4 00 to 6 00. We dont have normal people that would be able to get on and off the ramp easily so they just dont come. Even if prices stabilize or come down a little bit, that wouldnt help. Because they need to go way down so its becoming a place where only people with high income or double incomes with high incomes can live. And theres not a lot of room for expansion. No. Infrastructure wise. No and not a lot of options when it comes to public transportation. There is one bright spot. The smart train is starting up soon. But it wont help 580 going west into marin. It was a ups truck with packages and paperwork on board that flipped over on 580. The truck driver says he remembers eating pretzels but went unconscious. When he came to, the truck had overturned. Police in concord shot and killed a suspect who allegedly stabbed a man. The stabbing victim and a police dog were hurt but are both expected to recover. The District Attorneys Office is investigating the shooting. The man who died has not yet been identified by police. Police officers knew him from earlier encounters. The death toll from Hurricane Matthew keeps rising. At least 36 deaths reported here in the u. S. Blamed on the storm with about half in the state of North Carolina. More than 2,000 people were rescued in North Carolina from flooding. 4,000 people are still in emergency shelters. And 650,000 people still have no power. President obama declared a disaster for states including South Carolina and North Carolina. Switching to Something Else now. Omar was a 9yearold boy from palo alto who battled leukemia for most of his life. During his last days in his hospital he asked to attend school like any other boy so his parents set up computers and cameras in the hospital room so he could get his treatment but also go to school. Omar lost his battle with leukemia but his legacy lives on with omars dream foundation. The Organization Helps Sick Children stay connected with their teachers and classmates. Joining us in the studio is omars mother who is also the president of the foundation. And next to her is melanie sutton, omars former teacher. Thank you for coming in. So sorry for your loss. Let me begin by asking you about omar and his passion for education and what it meant for him to see his classmates, to be there in the classroom with his teacher through this technology. Logy. So i lost my son from leukemia. But while he was going through the treatment, he loved the idea even though, you know, Childrens Hospital had a Wonderful School program, he wanted to do attend his own school. Yes. So we provided him with that. He was so excited every single day. He was to log in and start skypeing at the same time that the school would start. He would tell you he was excited to go to school and see my friends and classmates. He even requested to wear regular clothes and not wear the gown to look formal on the screen to other kids. Right. And it went great. It was really great. And he enjoyed the whole experience. Uhhuh. Like any other little boy. Yeah. Hearing the gossip and learning the lessons and getting the art and music. Exactly. As his teacher, i imagine this may have been difficult to explain to the class why omar isnt here and why were creating this situation for him. Omar did a great job before he went into the hospital. He gave them a lot of details about the procedure from his 9 yearolds point of view. It fit well with their understanding. And they had known him since kindergarten. They were friends. They didnt have to miss him because they saw him every day online. Do you think this taught the children a valuable lesson. So omar was responsible for in a 9yearold way bringing up this subject to kids and teaching them a little something. Absolutely. It gave the other students a great perspective on what it was like for him to go through his treatments. They saw him every day online. He participated in everything. We had recorder lessons at the school. His parents brought the recorder. We would be playing in the classroom with 32 students in san jose and one kid up at stanford. The Omar Foundation is growing every year. Yes. Where is it at in regards to how many children are using the technology and get into their classrooms now . So we have currently more than 30 kids using the package at childrens high school. Some at valley medical in santa clara. So a number of hospitals. Yes. We just found out a couple of days ago, weeks ago at Good Samaritan high school, we launched a program at the Good Samaritan hospital. Have you interacted with the children. Yes. What is that like. Its amazing to see. Im glad and happy to bring the program to the kids. I feel so happy to see that the kids are well connected with their classmates and they feel so normal. They dont miss out anything when they go back after the treatment is finished. When they go back to their school. They are happy. And they dont feel as if they missed anything. Do you tell them the story of your son and how he wanted it to be how he wanted to be involved. Yes, do i. How did it make your son feel to be part of the class. I dont know how to describe it in words. It was great. He was completely distracted from his illness. He was focused on finishing his homework. And after the day finishes, he used to say oh my god i have to submit the work. Because he used to use webx to provide homework at that time. So worried about his homework. The doctors come n the cleaning lady comes inside the hospital room and he says please dont disturb me. Talk to me in the recess time. He had a schedule and everything. Yes. He followed the schedule. He was so tired by the end of the day that he goes to sleep on the regular time and wakes up on a regular time. It was a normal routine for him and he completely forgot about his illness and that he was in the hospital and getting so much medication. Youre a wonderful teacher and a wonderful mother. Im glad to see that youre leading the foundation. We need money to keep it going. This sunday the organization is holding its annual fundraising run. Omars dream run will take place at the park in san jose. It goes from 10 00 in the morning to 2 00 in the afternoon. It features a 5k or 10k run. Some moms in the monterey area heard about the story and asked the family if donated breast milk might be helpful for the little girl. When the family said yes, the moms gathered together 5,000 ounces of breast milk and packed it up in an ice chest and it had delivered to the family. Now you know why they call it liquid gold. A Hayward Police officer in the spotlight. He pulled over a car for expired tags but what he discovered was a family in real need. Ktvus henry lee tells us more about what the officer did next. But when he pulled over a woman and her two kids last week, he could tell this was different. I could tell they had either been living in the vehicle or they go from place to place in the vehicle. Reporter the woman stopped in the parking lot of the mcdonalds on a street. She gave me the license and told me right away, my license is suspended right now. And, you know, this is all i have. You know. Me and my children, we go from shelter to shelter. Reporter he could have towed the car. Instead he asked her a simple question. I said have the kids eaten or anything. She said no. I said were already here. Lets go inside and eat. Reporter look at this i can picture. It was taken by a man who saw the good deed. I asked if he told nip about what he did for this woman.
